Tato diplomová práce se zabývá obzvláště zajímavým obdobím v historii římské republiky, které se nazývá konfliktem stavů. Období konfliktu stavů je charakteristické bouřlivým rozporem dvou společenských skupin soupeřících o politická, ekonomická a sociální práva ve starověkém římském státě. Hlavním pramenem poznání pro tuto studii je rozsáhlé dílo Tita Livia Patavina, Ab urbe condita. Diplomová práce se člení na tři části, které se zabývají rozdílnými fázemi konfliktu. Cílem práce je popsat a analyzovat kritické body patricijsko-plebejského politického boje a také nastínit, jak konflikt ovlivnil ústavu římské republiky. První kapitola se věnuje několika problémům rané římské republiky: veřejné půdě, vytvoření dvou důležitých plebejských magistratur - tribunů lidu a plebejských aedilů, nejstaršímu pozemkovému zákonu, plebejskému shromáždění, důležitosti lex duodecim tabularum a leges Valeriae Horatiae. Druhá kapitola se zaměřuje na lex Canuleia, zavedení konzulárních tribunů, případ Manlia Capitolina a jeho důsledky a konečně popisuje leges Liciniae Sextiae. Třetí a poslední kapitola této práce mimo jiné analyzuje lex Genucia a lex Poetelia Papira de nexis, zákony Publilia Philona, zákon Oviniův, zákon Ogulniův a uzavírá Hortensiovým zákonem týkajícím se plebiscit. Zákon Hortensiův je považován za konec... This thesis is concerned with a particularly interesting period in the history of the Roman Republic. The period is called the Struggle of the Orders. The epoch is characteristic by turbulent conflict of two social groups competing for political, economical and social rights in the ancient Roman state. The most prevalent source among others for this thesis is work by historian Titus Livius Patavinus, Ab urbe condita. The study is divided into three chapters, taking into account the different phases of the struggle. The aim of this work is to describe and analyze the critical points of the patrician-plebeian political fight and also illustrate how the struggle affected the constitution of the Roman Republic. The first chapter deals with a several problems in the early Roman Republic: public land, creation of two important plebeian magistrates - tribuni plebis and aediles plebis, oldest agrarian law, plebeian assembly, importance of the Law of the Twelve Tables and Valerian- Horatian laws. The second chapter focuses on Canuleian law, introduction of consular tribunes, case of Manlius Capitolinus and its consequences and finally describes Licinian Sextian laws.
