Tato diplomová práce se zabývá rozborem problematiky skončení pracovního poměru z důvodu nadbytečnosti zaměstnance. Účelem této diplomové práce je detailní popis a analýza jednotlivých hmotněprávních podmínek, které musí být splněny, aby byla výpověď pro nadbytečnost daná zaměstnanci zaměstnavatelem platná, a to za pomoci relevantních případů ze soudní praxe. Za tímto účelem tato diplomová práce klade důraz na detailní analýzu soudních rozhodnutí, zejména pak rozhodnutí Nejvyššího soudu ČR a Ústavního soudu ČR. Text této diplomové práce tvoří úvod, pět hlavních kapitol a závěr. První dvě kapitoly se zabývají skončením pracovního poměru nejdříve z obecného hlediska a dále z pohledu nadbytečnosti zaměstnance, aby tak byl definován výchozí rámec pro následující kapitoly. Jádro této diplomové práce představuje kapitola třetí, která obsahuje obsáhlou analýzu všech nezbytných předpokladů a problematických aspektů souvisejících s výpovědí pro nadbytečnost zaměstnance. Na tuto třetí kapitolu navazuje kapitola čtvrtá, která se věnuje materiálním a procesním vadám v jednotlivých nezbytných náležitostech a jejich negativními následky na platnost výpovědi pro nadbytečnost. Poslední pátá kapitola této diplomové práce se pak zabývá skončením pracovního poměru z důvodu nadbytečnosti z pohledu důsledků neplatného... This diploma thesis deals with comprehensive analysis of the termination of an employment relationship due to employee's redundancy. The purpose of this diploma thesis is in detail description and analysis of material requirements that are needed to be fulfilled for the employer to be able to validly terminate the employee's employment for redundancy, considering relevant judicial cases. For this purpose, this diploma thesis puts emphasis on analysis of judicial decisions, especially decisions of the Supreme Court of the Czech Republic and the Constitutional Court of the Czech Republic. The text of this diploma thesis consists of an introduction, five main chapters and a conclusion. The first two chapters deals with termination of employment firstly from a general point of view and then from the point of view of employee's redundancy, to define the initial framework for the following chapters. The core of this diploma thesis is formed by the third chapter, containing comprehend analysis of all necessary requirements and problematic aspects related to termination of an employment relationship due to employee's redundancy.
