Předkládaná rigorózní práce se věnuje jednomu z nejčastěji páchaných trestných činů v České republice, a to trestnému činu zanedbání povinné výživy podle § 196 trestního zákoníku a obecně problematice neplnění vyživovací povinnosti rodičů vůči dětem, kdy záměrem této práce je komplexní výklad tohoto tématu. Práce je rozčleněna celkem do sedmi kapitol doplněných o úvod a závěr. V první kapitole je pozornost věnována historickým kořenům tohoto trestného činu, neboť trestnost neplnění vyživovací povinnosti má na našem území dlouhou tradici. Následně je v druhé kapitole nastíněna základní charakteristika tohoto trestného činu a je proveden detailní rozbor jednotlivých znaků dvou základních skutkových podstat v ustanovení § 196 odst. 1 a § 196 odst. 2 trestního zákoníku a kvalifikované skutkové podstaty k těmto dvěma základním skutkovým podstatám. Vzhledem k blanketnímu charakteru skutkové podstaty trestného činu zanedbání povinné výživy je v třetí kapitole tato práce doplněna o výklad soukromoprávní úpravy vyživovací povinnosti. Ve čtvrté kapitole této práce je provedena analýza nejčastějších důvodů a motivů neplnění vyživovací povinnosti a vliv těchto důvodů na trestní odpovědnost pachatelů. Nastíněny jsou i aktuální problémy, které se v praxi v souvislosti s trestným činem zanedbání povinné výživy... The presented Advanced Master's thesis describes one of the most frequently committed criminal offences in the Czech Republic, specifically the criminal offence of neglecting the duty to maintain and support pursuant to Section 196 of the Criminal Code and, in general, the issue of parents' failure to comply with the duty to maintain and support their children; this thesis aims to provide a comprehensive description of this topic. The thesis is divided into seven chapters supplemented by an introduction and a conclusion. Chapter one focuses on the historical roots of this criminal offence, as the punishability of non-compliance with the duty to maintain and support has a long tradition in this country. Subsequently, chapter two outlines the basic characteristics of this criminal offence and provides a detailed analysis of the individual elements of two basic merits under Section 196 (1) and (2) of the Criminal Code, as well as of the qualified merits with respect to these two basic merits. In view of the blanket nature of the merits of neglecting the duty to maintain and support, chapter three hereof describes the private-law regulation of the duty to maintain and support.
