obsahově zastřešuje plánovací smlouvy a smlouvy s příslušnými vlastníky veřejné dopravní uzavřené jako tzv. inominátní smlouvy dle občanského zákoníku, které jsou v nazývány jako "smlouvy o spolupráci se zájemcem (investorem) o výstavbu". Podstatou těchto smluv je snaha o úpravu finanční spoluúčasti zájemce o realizaci stavebního záměru na kompenzaci finančních prostředků, které obec musí v důsledku nárůstu počtu nároků vynaložit k zajištění svého fungování. Postupně se práce věnuje vymezení základních pojmů a subjektů. Dále nastiňuje důvody a obecná východiska vedoucí k uzavírání smluv o územním rozvoji. Následuje bližší nichž myšlenka podílu zájemce o výstavbu na realizací stavebního záměru vychází. V vymezuje základní obsahové náležitosti a právní formu těchto smluv a postupně přechází i upráci se zájemci o výstavbu. Část nazvaná "zákonné meze smluv o územním rozvoji" pojednává o závazcích, jejichž uzavřením by docházelo k zákonými ustanoveními. Tyto meze představuje zejména dvojí postavení obce v jako subjektu veřejné moci a jako osoby soukromého práva, nemožnost zásahů soukromoprávní smlouvy do výkonu přenesené působnosti obce a systémové riziko poslední praktické části práce nabízí několik příkladů z jakým způsobem jednotlivé tématem smluv o územním rozvoji řeší a jaké problémy tato řešení přinášejí.... Thesis title: territorial development contracts The topic of this diploma thesis is territorial development contracts. This term includes contracts for planning and assessment of the owners of the public transport and technical infrastructure resulting from Building Act and contracts not regulated by the law, concluded as so-called innominate contracts according to Civil Code, which are referred to as "cooperation agreement with person interested (investor) in construction". The essence of these contracts is the effort to adjust the financial participation of the person interested in the realization of the building project in the municipality on the costs incurred by the municipality caused by construction. In particular, it is mostly about compensation of the funds that the municipality must spend to ensure its functioning as a result of the increase in population and their entitlements. The beginning of thesis is dedicated to the definition of basic concepts and subjects. Furthermore, it outlines the reasons and general basis leading to the conclusion of territorial development contracts.
