Porušení právních předpisů o dokazování v trestním řízení a jeho důsledky Předkládaná rigorózní práce se zabývá problematikou porušování právních předpisů o dokazování v trestním řízení a jeho důsledky. Proces dokazování upravuje mnoho právních norem. Jádro právní úpravy se nachází v trestním řádu. Řadu pravidel lze však nalézt též v mezinárodních smlouvách týkajících se lidských práv a v ústavním pořádku České republiky, neboť dokazováním bývá často zasahováno do základních práv a svobod. V současnosti nabývá téma úpravy dokazování na aktuálnosti, a to vzhledem ke snaze zákonodárce přijmout nový trestní řád a s ohledem na některé mediálně známé trestní kauzy, v nichž nesprávný proces dokazování způsobil nezákonnost trestního řízení jako celku. K aktuálnosti zvoleného tématu přispívá také fakt, že v současné době se obhajoba v trestních věcech zaměřuje především na použitelnost důkazů získaných v přípravném řízení, přičemž formalisticky uplatňovaná pravidla mohou vést k nepotrestání pachatele trestného činu. Základním cílem této rigorózní práce je popsat účinnou a platnou právní úpravu dokazování a následky porušování předpisů o dokazování v trestním řízení. Čtenář se seznámí též s rozhodovací praxí českých soudů a judikaturou Evropského soudu pro lidská práva v oblasti dokazování. Teoretické... Violation of Regulations on Burden of Proof in Criminal Procedures and its Consequences This dissertation deals with the issues associated with violation of regulations on burden of proof in criminal procedures and its consequences. A great number of regulations stipulate burden of proof. The core of the regulation lies in the Criminal Code. However, another range of regulations can also be found in international contracts regarding human rights and the constitutional system of the Czech Republic since burden of proof concerns basic human and fundamental rights. In the present, the issue of burden of proof gains more attention due to the endeavour of legistators to adopt a new Criminal Code and due to some criminal procedures which appeared in the media and in which improper use of burden of proof caused illegality of the criminal procedure as a whole. Another fact that contributes to the topicality of this issue is that currently, defence in criminal procedures focuses especially on the utility of evidence collected during the preliminary procedure, where fomalistically applied regulations might lead to no punishment of the perpetrator.
