Předložená diplomová práce pojednává o výslechu svědka v civilním procesu. Jedná se o jeden z nejsložitějších důkazních prostředků s ohledem na jeho provedení a následné hodnocení soudem. Práce je vnitřně členěna do 10 kapitol, které na sebe vzájemně logicky navazují. Nejprve se v úvodu této práce věnuji výkladu pojmu důkazních prostředků a tomu, jak je lze dělit. Dále pak navazují kapitoly týkající se samotného tématu diplomové práce. Druhá kapitola se mimo seznámení se s osobou svědka, jeho zákonnou povinností vypovídat a způsobilostí, týká práva odmítnout vypovídat a povinnosti zachovávat mlčenlivost. Právě povinnosti zachovávat mlčenlivost je věnována značná pozornost. Zabývám se zde problematikou povinnosti zachovávat mlčenlivost podle zákonů, upravující tuto povinnost u advokátů, notářů, lékařů a duchovních. Dále se již práce týká postupu při výslechu svědka, tak jak jej upravuje zákon. To, jak soud svědka k výslechu předvolává a jaké dává zákon soudu možnosti k tomu, aby svědka donutil ke splnění povinnosti svědčit nebo ho sankcionoval za poskytnutí křivé výpovědi. V kapitole čtvrté a páté je věnována pozornost samotnému průběhu výslechu svědka a možným zvláštním způsobům výslechu jako je výslech dožádaným soudem nebo výslech provedený mimo jednání. Je zde uvedena možnost výslechu... This thesis is about the interrogation of a witness in civil proceeding. It is considered as one of the most difficult means of proof in terms of its execution and later evaluation by the court. This work is divided into 10 chapters which systematically follow each other. In the introduction I firstly define the concept of means of proof and the groups they can be divided into. The following chapters focus on the main topic. The second chapter is composed of introduction of the witness, their legal obligation to testify and their capability. Also, it deals with the right to reject to testify and the obligation of confidentiality which receives extra attention. I deal with the obligation of confidentiality based on laws regulating this obligation for attorneys, notary, doctors and clerics. Furthermore, the work deals with the procedure of interrogation of witness as the law dictates it. Particularly, the way the court summons the witness and which lawful means does the law allows the court to enforce the duties among the witness to testify or punishing them for false testimony.
