Shrnutí v českém jazyce Název práce: "GATCA" a její promítnutí do právního řádu České republiky Práce se zabývá právní úpravou automatické výměny informací při správě daní založené Společným standardem pro oznamování a náležitou péči v oblasti informací o finančních účtech označované jako systém GATCA a jejím provedením do právního řádu České republiky. Cílem této právní úpravy je zajistit vyšší příjmy veřejných rozpočtů a snížit využívání daňových rájů daňovými subjekty pro daňové úniky. V souladu s tímto cílem je v práci zhodnocena právní úprava systému GATCA a její provedení do právního řádu České republiky. Jedním z hlavních závěrů obsažených v této práci je upozornění na některé aspekty systému GATCA, které mohou daňovým subjektům umožnit vyhnout se povinnostem, které jim jsou v rámci systému GATCA ukládány, a dále návrh řešení těchto problematických aspektů. Za slabé místo systému GATCA lze označit též jeho vztah k systému FATCA, který je založený federálním zákonem Spojených států amerických a mezivládními dohodami mezi Spojenými státy americkými a dalšími zeměmi. Systém FATCA je v zásadě konstruován jako jednostranně výhodný pro Spojené státy americké a umožňuje tak daňovým rezidentům jiných států využít toho, že se Spojené státy americké neúčastní systému GATCA. Resume in English Name of the thesis: "GATCA" and its integration into legal order of the Czech Republic The diploma thesis deals with legislation regulating automatic exchange of information in tax matters based on the Common Reporting Standard On Reporting and Due Diligence for Financial Account Information (also known as Common Reporting Standard) usually referred to as a GATCA system and its integration into legal order of the Czech Republic. A main goal of the legislation is to secure higher public incomes for public budgets and to weaken a position of tax havens in relation to tax evasion by taxpayers. The GATCA system legislation and its integration into legal order of the Czech Republic are evaluated in accordance with this goal. One of the main conclusions of the diploma thesis is considering some possible loopholes of the GATCA system that may be used by taxpayers to avoid duties imposed on them by legislation regulating automatic exchange of information in tax matters and suggesting solutions that should be used to close these loopholes.
