Tato bakalářská diplomová práce se zabývá spoluprácí Chorvatska a Srbska s Mezinárodním trestním tribunálem pro země bývalé Jugoslávie (ICTY). Pomocí komparace spolupráce těchto dvou zemí odhaluje příčiny toho, proč Chorvatsko dosáhlo uspokojivé spolupráce o šest let dříve než Srbsko. Protože studie vychází z předpokladu, že příčiny lze najít zejména ve vnitropolitických záležitostech, analyzuje politický, společenský i legislativní vývoj spjatý se spoluprácí s tribunálem v obou zemích. Jelikož ale spolupráce do velké míry závisela na vnějších aktérech zejména EU, je zde často analyzována i její role. Práce je rozdělena na dvě hlavní kapitoly, z nichž každá obsahuje tři podkapitoly - politickou, společenskou a právní. Analýza se soustředí na období po roce 2000, kdy došlo k významné demokratizační politické změně v obou zemích. V případě Chorvatska končí v roce 2005, kdy byl předán jejich poslední obžalovaný, což se v případě Srbska stalo až v roce 2011, tudíž analýza Srbska sahá až do tohoto roku. Práce dochází k závěru, že v politické rovině byl významným přelomem rok 2003, kdy se v Chorvatsku konsolidovala situace a politická scéna se spojila v podpoře spolupráce s ICTY. Nic podobného se v Srbsku neudálo a většina stran byla minimálně do roku 2008 proti spolupráci. Veřejné mínění zřejmě nemělo... This bachelor thesis deals with the cooperation of Croatia and Serbia with the International Criminal Tribunal for the former Yugoslavia (ICTY). Using the comparison of cooperation of these two countries reveals the reasons why Croatia reached a satisfactory cooperation six years earlier than Serbia. Since the thesis is based on the assumption that the causes may be found in domestic political affairs, it analyzes the political, social and legal developments linked to cooperation with the Tribunal in both countries. However, since cooperation is also largely dependent on external actors, in particular the EU, its role is often analyzed. The thesis is divided into two main chapters, each of which contains three subsections - political, social and legal. The analysis focuses on the period after 2000, when the major democratic political changes in both countries occurred. In the case of Croatia the analysis ends in 2005, when the last Croatian accused have been transferred, which in the case of Serbia happened in 2011, so the analysis of Serbia dates to that year. The thesis concludes that an important turning point on the political level happened in 2003, when the situation in Croatia has been consolidated and political parties joined in the promotion of cooperation with the ICTY.
