SHRNUTÍ Tato diplomová práce pojednává o orgánech společenství vlastníků jednotek a o způsobu, jakým takové orgány rozhodují, se zaměřením na časté výkladové problémy, které v praxi v souvislosti s touto problematikou vznikají. Společenství vlastníků jednotek je právnickou osobou, jíž toto postavení přiznává zákon o vlastnictví bytů, a vzniká za podmínek stanovených tímto zákonem. Jeho existence je vždy spjata s konkrétní budovou rozdělenou na bytové (případně i nebytové) jednotky - členy společenství vlastníků jednotek jsou pak jednotliví vlastníci těchto jednotek. Zákon o vlastnictví bytů dále vymezuje, že společenství vlastníků jednotek má pouze speciální právní subjektivitu, je tedy způsobilé vykonávat práva a zavazovat se pouze ve věcech spojených s předmětem své činnosti tedy se správou, provozem a opravami společných částí domu - souhrnně se celá tato oblast nazývá správou domu (popřípadě vykonávat další činnosti s tím spojené, stanoví-li tak zákon). Přesnější vymezení činností, jež lze zahrnout pod pojem správa domu, spíše než zákon o vlastnictví bytů nabízí nařízení vlády, kterým se vydávají vzorové stanovy společenství vlastníků jednotek. Podrobnější vymezení této otázky zahrnuje kapitola 1 - úvod do problematiky hned na začátku této práce a dále kapitola 2 - prameny právní úpravy. Realizaci výše... This thesis deals with the governing bodies of the association of unit-owners and the way of their decision-making. It is focused on usual interpretative problems, which appear in practice in association with this problematic . An association of unit-owners is an legal entity, which originates on the grounds of The Act of Housing Property. Its existence is always connected with a concrete building divided into residential (in some cases also nonresidential) units. Membership in the association of unit-owners is inseparably linked to the ownership of each unit in this building. The Act of Housing Property also establishes that the association of unit-owners has only special legal personality. It means it can execute that kind of discretions and duties which deal with an object of their activities, such as administration, operation and repairs of common parts of the building (in case The Act of Housing Property states, also other associated activities) - this whole area is called administration of the building. The Decree of the government, which issues the model statutes of the association of unit-owners, offers more exact features of the activities, rather than The Act of Housing Property.
