[cze][eng] Závěr Závěrem musím konstatovat, že tato práce rozhodně nemohla obsáhnout informovaný souhlas v celé jeho šíři a se všemi úskalími. I kdyby totiž nebyla omezená svým možným rozsahem, nebylo by možné zachytit vše. Je tomu tak zejména proto, že každý člověk je jedinečný a i kdybychom vytvořili dokonalá pravidla informovaného souhlasu, v praxi se pravděpodobně najde případ, který do nich nebude zapadat. Udělala jsem si malý internetový průzkum. Za 27 vteřin mi vyhledávač www.google.cz našel více jak 52 tisíc odkazů rovnajících se informovanému souhlasu. Pokud jsem zadala pojem v angličtině, informed consent, dostala jsem ani ne za vteřinu více jak 6 milionů odkazů. I když uvedená čísla beru pouze jako orientační, je zřejmé, že problematika informovaného souhlasu je velice rozsáhlá a zasahuje do dalších oblastí medicíny i práva. Můžeme na ni nahlížet z různých úhlů pohledu a obvykle, když už máme pocit, že jsem prozkoumali vše, objeví se nová literatura nebo nový rozsudek, který změní nebo alespoň usměrní nahlížení na situaci. Pro právníka je jistě zajímavý i fakt, že se v jednom jediném tématu střetává právo soukromé i veřejné, že je třeba hledat souvislosti v právu občanském, správním, trestním atd. Zabývat se informovaným souhlasem, nesouhlasem, zákroky provedenými bez vědomí pacienta a všemi souvisejícími...The informed Consent of a Patient Informed consent from the patient is one of the most interesting institutes of the medical law. Today it belongs to the basic principles of the medical law, but its development was rather complicated. Initially, this may date to the late 18th century, when the requirements governing the relationship of doctor and patient appear. Over time, the courts handle issues concerning informed consents or patients' non-acceptance. Until the middle of 20th century, almost the whole Europe discovers paternalistic understanding of the relationship doctor and patient. It is on such a concept, when a doctor determines the treatment and the patient is only a subject to the treatment. The doctor has a critical position and the patient must slave his decisions. Change in the concept came after the World War II. Doctor's and patient's relationship slowly begins to change and it becomes closer to a relationship of service providers and clients. In the Czech Republic, a mix of both can be found.
