The Czech National Bank, its legal position and scope of activities This diploma thesis evaluates the legal position and scope of activities of the Czech National Bank through the analysis of the current legislation, literature and other sources. Partial aspects affecting the legal position and activities of the Czech National Bank are described separately, but due to their mutual connections it is important to see them as a part of the whole context. The thesis also points at questionable issues and offers both expert's as well as author's attitudes. This diploma thesis is divided into five chapters. The first chapter characterizes central banking itself, defines the role of the central bank in the banking system, shows the differences in conception of central bank and outlines the methods of establishing of central banks. The second chapter briefly describes the evolution of central banking in our country, focusing on the importance of historical events, which contributed to the creation of the Czech National Bank, as we know it today. The central bank, its activities and position Abstract Central banks are in today's global banking system an indispensable part of a stable functioning market economies. I was always interested in these issues. I studied these issues in another master's degree course. The subject of this thesis is the central banking system in the Czech Republic and in the European Union. In the first chapter I focus on definition of banking and on the characteristics of three models of the banking system (single-stage, two-and three-stage banking system). The second chapter is the largest of all chapters. In this chapter I deal with the formation of Monetary Union, the creation of the European central banking system and the foundation of the European Central Bank. I analyze the legal base of European Central Bank, its organizational structure, issuing of legal acts, the capital. I deal with the introduction of the euro in member and non-member countries too. Special attention is paid the independence of the European Central Bank. I analyze its institutional, personal, financial, material and budgetary independence. The main objective of this thesis is to describe the functioning of the central bank, the historical development of the Czech National Bank, its organizational structure and internal decision-making mechanisms, activities carried out, its purpose, function and objectives and to incorporate it in the legal system of the Czech Republic. This thesis addresses the involvement of the Czech National Bank for the European System of Central Banks, the functioning of the European Central Bank and the aforementioned European System of Central Banks. Part of the work is devoted to the process of adopting the euro and the relation between Czech Republic this currency. The thesis gives a comprehensive view of the functioning of the Czech National Bank. Thesis is divided into several chapters, and each chapter neatly summarized some part of the whole and to ensure easy orientation at work. The work is drawn from literature, case law and legislation. The work includes the connection of the scientific literature and the author's views. There is a widely used quotes personalities and capabilities in their field and provisions of the legislation, so that the work was valuable informative.
How Can the Czech National Bank Eliminate the Zero Lower Bound on Interest Rates? A Case Study

The thesis provides case study research on the feasibility of the negative in- terest rate policy in the context of the Czech Republic. No major obstacles opposing the policy itself were found in the bases of the Czech legal system, however, a list of acts explicitly affected by the value of policy rates needs to be adjusted to prevent misinterpretations. Moreover, it was identified that tax prepayments held by the Tax Authority and free reserves kept at the Czech National Bank at zero interest rate create room for escaping from the policy. Additionally, debt repayments in cash and interest-free accounts of government and public institutions administrated by the Czech National Bank could lead to undesirable advantages. A complementary VAR model analysis of the interest rate transmission under negative policy rates was performed to evaluate quan- titatively the experience from European countries, however, short data series available provided merely indicative results.

RESUMÉ - THE STATUS AND THE ROLE OF CENTRAL BANKS IN THE EU This diploma thesis compares the Czech National Bank, the Slovak National Bank, the Bundesbank and the European Central bank. Central banks play a significant role in every state and they have big influence on economy of each state. Therefore, their legal regulation as well as precise definition of their competencies are essential. The thesis focuses on their establishment, legal base and legal form, organisation and independence (institutional, financial, personal and functional). Its aim is also to compare tasks, monetary policy, issuance of banknotes and coins, banking and financial regulation and supervision. Establishment of a central bank depends significantly on the historical background of the given state (or union). All of the described banks are settled in regulations of the highest legal importance on the particular state (or union), which is not usual, and also in many other legal acts. Members of the highest body are selected after the agreement of the legislative and executive powers. The Czech National Bank is an exception, since the members of its Bank Board are appointed by the president without a counter signature. Use of the monetary instruments of the Czech National Bank Abstract The aim of the thesis is to chronologically analyze the use of the monetary instruments of the Czech National Bank with emphasis on the issue of changing the primary objective of our central bank in the legislation order and answer the question whether there was a change in the use of the monetary instruments of the CNB or not. The thesis uses mainly descriptive method, analytical method, and comparative method. The sources of this thesis are mainly professional economic publications (professional articles, textbooks), legal regulations, including the case law of the Constitutional Court, and freely available data listed on the website of the CNB or the website of the Czech Statistical Office. The first chapter of my thesis defines the term "Monetary Policy". It theoretically analyses the basic types of the monetary policy and functions. 1 ABSTRACT STATUS AND ROLE OF CENTRAL BANKS IN HISTORY This diploma thesis describes and compares the regulation and status of two central banks in our history, the central bank of the independent Czechoslovak Republic and the central bank of the Czech Republic. The aim of this thesis is to present and compare selected aspects of both central banks through the method of analysis and comparison. The hypothesis is that both banks, as central banks of democratic states, are similar in their regulation and status. The intention is to verify this hypothesis and find out whether the Czechoslovak Republic legislation was a source of inspiration for the creation of central banking legislation when the Czech Republic was established. The first part of the thesis describes the banking system, the characteristics and origin of central banking in the world and the Czech region. Subsequently, the circumstances of the establishment of the National Bank of Czechoslovakia and the Czech National Bank are presented. Relations of the central bank to commercial banks Abstract The thesis follows up the relations of the central bank towards commercial banks, with the main emphasis being placed on the Czech Republic, where the role of the central bank is carried out by the Czech National Bank. The main aim of this work is to describe and evaluate the relations between these institutions in terms of current legislation and focus on situations where this legislation does not evolve in the right direction. The first part of the thesis is theoretical and deals with the definition of institutions crucial for the topic itself. By both institutions, commercial banks and the central bank, are emphasized their legal anchoring and their main activities. Within this part, a separate chapter is devoted to the Czech National Bank and its independence, without which CNB would not be able to carry out its activities properly. This part will also analyze the banking system, which represents a summary of banking institutions in a certain state and a summary of individual links between them.
