Legal regulation of renewable sources of energy in the Czech Republic

This diploma thesis deals with the legal regulation of renewable sources of energy in the Czech Republic. It appraises the efficient legal regulation of renewable energy sources by taking in consideration the economic and legal perspectives while respecting the current economic situation trends and policies of the European Union and the Czech Republic. Emphasis is placed on the differences of various types of renewable energy and describing their characteristics for utilization in the Czech Republic. The new role of entities in the electricity market after the Act No. 165/2012 Coll. about Supported Energy Sources has come into force, is discussed. The ascertained deficiencies reflect future recommendations for changing the legal regulation and strategic documents which define the further development of renewable sources of energy in the Czech Republic.
Czech Energy Law in the Context of Environmental Protection

The dissertation deals with legal regulation of energy in the Czech Republic in the context of environmental protection. Power is the broadly conceived by the author because it includes not only the stage of obtaining energy resources, production, and the distribution of energy, but also the activities related to energy conservation and dealing with energy waste. For these individual phases, the author introduces the concept of the energy chain which is understood as a set of interrelated developmental stages of energy. Energy law is defined by the author as a law that regulates people's behavior towards usable energy at all stages of the energy chain. Endangerment and damage to the environment may occur (and often does occur) at each stage of the energy chain. This work emphasizes the principles and instruments of environmental protection which can effectively fulfill their function in energy legislation. The aim of the work is to find and understand the context of principles and instruments of environmental protection in the Czech energy law. This knowledge may then allow for an assessment of energy legislation de lege lata, including introducing specific proposals de lege ferenda and possible policy changes. Czech Energy Law in the Context of Environmental Protection

The dissertation work analyzes the Czech energy law in the context of environmental protection. The thesis seeks out the contexts of principles and instruments of environmental protection in the legal regulation of energy. Emphasis is placed on the analysis of conceptual, administrative, and economic tools and their application at different stages of the energy chain. Attention is paid to the issue of energy terminology in the Civil Code and its importance in the construction phase of the energy infrastructure. The work analyzes the contexts of principles and instruments of environmental protection in thematic areas focused on business regulation in energy, supported energy production, nuclear energy and energy conservation, i.e. according to the areas regulated by the four basic pieces of energy legislation in the Czech Republic. Furthermore, activities in the energy sectors are described in terms of threats and damage of the individual components of the environment. The conclusion of the work points to the main problematic areas of the Czech energy law, including recommendations for their solution.
