The liability of the carrier in international carriage of goods (focused on carriage of goods by sea)

The liability of the carrier in international carriage of goods is a classical issue, which is well known, but still actual. The increasing intensity of international trade has impact on the demand for the transport services. Different rules in different legal systems constitute a hindrance for a proper functioning of international transport services. Nowadays, this problem is well solved by the international conventions containing certain rules, regarding contract of carriage in international transport of goods. However, these conventions govern the contract of carriage only in particular mode of transport which is the reason why it is necessary to describe the liability of the carrier in all these particular modes of transport. The starting point of this thesis is to describe the applicable sets of rules, which can govern the contract of carriage in international transport. Today, the relation among these sets of rules can appear be genuinely complicated. The most crucial point seems to solve the problem of relation between the conventions containing certain rules regarding contract of carriage and the legislation of the EU. Key words: emergency medical service, urgent premedical care, organization, technical conditions, statistics, analysis The topic of this bachelor thesis are historical developments of Emergency Medical Service (EMS) with a special focus on significant changes in its technical, personal and organizational arrangements on the territory of contemporary Czech Republic. The thesis major objective is to contribute to the discussion on the EMS current organization as well as its work effectiveness and reserves. Following this objective, the text is aimed at comparison of recent situation in selected regions and the Czech Republic as a whole. In particular it deals with current regional differences in the EMS technical conditions and outputs regarding urgent premedical care provision. Contemporary possibilities of the EMS evaluation and informational value of statistical data are examined and extensively discussed.

The liability of the carrier in international carriage of goods by road

Even if the international carriage of goods by road has been regulated by the Convention on the Contract for the International Carriage of Goods by Road since more than 50 years, there are still differences in application of this Convention by courts, some differences could also be find in the approach of the doctrine. This situation decline of course the certainty of the carrier concerning the probable solution of the dispute in international carriage of goods by road. The purpose of the study was the systemic description of the liability of the carrier according to the Convention on the Contract for the International Carriage of Goods by Road and finding of a solution of some problems, which could occur by the application of the convention. This solution should be based on the knowledge of the theory, the opinions expressed by courts and doctrine and on the knowledge of applicable law.
