Das Ziel deiser Diplomarbeit ist mit den Einzelansprüchen den Schadensersatz bei Körperverletzung und Tötung in der tschechischen und deutschen Rechtsordnung zu beschreiben. Die Diplomarbeit ist in vier Kapitel eingeteilt. Das erste Kapitel beschäftigt sich mit den Grundlagen des Gesundheitsschutzes aus der Sicht des tschechischen und deutschen Staatsrecht und deren Verankerung in den internationalen Menschenrechtsabkommen. Die Aufmerksamkeit ist auch auf die Verankerung der Grundprinzipien in dem tschechischen und deutschen bürgerlichen Recht gelegt. Das Kapitel beschäftigt sich weiter mit dem Gesundheitsschutz durch das bürgerliche Recht. Das zwite Kapitel beschäftigt sich mit der Haftung, besonders mit den theoretischen Ausgangspunkte der Haftung und Voraussetzungen für die bürgerliche Haftungsbeziehung in der tschechischen und deutschen Rechtsordnung. Die Aufmerksamkeit ist besonders auf die Rechtswidrigkeit, die Kausalität, der Schaden, das Verschulden geleget und die Unterschiede zwischen den beiden Rechtsordungen. Das dritte Kapitel beschäftigt sich mit dem Ersatz des materiellen und immateriellen Schadens und mit der Hilfe der Einzelansprüchen beschreibt den Art und den Umfang der Schadensersatzpflicht in der Tschechische Republik. Evaluation of effective properties of basalt textile reinforced ceramic matrix composites

The present paper is concerned with the analysis of a ceramic matrix composite, more specifically the plain weave textile fabric composite made of basalt fibers embedded into the pyrolyzed polysiloxane matrix. Attention is paid to the determination of effective elastic properties of the yarn via homogenization based on the Mori-Tanaka averaging scheme and the 1st order numerical homogenization method adopting a suitable representative computational model. The latter approach is then employed to simulate the response of the yarn when loaded beyond the elastic limits. The required mechanical properties of individual material phases are directly measured using nanoindentation with in-build scanning probe microscopy. Using homogenization and nanoindentation for microfibril angle determination of spruce

This paper is concerned with the evaluation of microfibril angle of spruce. The microfibril angle is defined as an inclination of microfibrils from the longitudinal axis, the direction of lumens. It is well known and further supported by the present study that the microfibril angle has a great influence on the final mechanical properties of wood. This angle could be measured either directly using, e.g. polarisation microscopy, X-ray diffraction, infrared spectroscopy, or indirectly, as used in this study, by employing the nanoindentation measurements. Therein, the measured indentation modulus is compared with that obtained numerically using the anisotropic theory of indentation. The latter one depends on the entire stiffness matrix derived through homogenization and the searched microfibril angle. In view of the cell wall microstructure, the effective cell properties were found using the two-step micromechanical homogenization adopting both the Self-consistent and Mori-Tanaka methods.
Strength of composite yarn under biaxial loading

The present paper is concerned with two types of periodic unit cell of composite yarn with different geometry but the same material properties. Their macroscopic response under tensile and compressive loading in the transverse direction and their combination are plotted in the graphs. Based on stress-strain curves the failure envelopes are constructed. A simple maximum stress criterion and linear softening law is used in the adopted progressive damage analysis to outline the softening part of stress-strain diagrams. Finally the impact of selected representative volume element is observed through the comparison of results gained for both designed periodic unit cells in the microlevel, meaning the level of yarn.
The effect of micro-silica on the microscopic features of the UHPC composite and its inter-facial transition zone

The uplift of concrete overall macroscopic performance by way of alternative additives is commonly used technique. In case of ultra high performance concrete (UHPC), micro-silica is added to the mixture as a micro-filler to the structure of cement binder. As a result, the cementitious matrix macro-mechanical performance is elevated. This paper is aimed on the UHPC micro-scale enhancement by different micro-silica additive content in the mixture. More closely, the study investigate the impact of the micro-silica on the inter-facial transition zone (ITZ) between the binder matrix and basaltic aggregate.
Micro-mechanical performance of concrete used as recycled raw material in cementitious composite

The reduction of industrial pollution is recently one of main goals over all fields. In civil engineering, re-cycling of structural waste provides wide opportunity contributing this effort. This paper focus on re-use of concrete waste, which after further processing can be used in new constructions as partial supplement to the mixture. To investigate the impact of re-cycled concrete addition, it is necessary to determine mechanical and structural parameters of individual phases in the “raw” material. For this purpose, grid indentation and scanning electron microscopy with energy-dispersive X-ray spectroscopy (SEM, EDX) are combined to determine properties of concrete sample.
Grid indentation and statistic deconvolution: limitations and accuracy

Early stage microstructure development of cement paste modified by crystalline admixture

This paper deals with the effect of crystalline admixture (CA) on the microstructure of the cementitious composite in first four weeks after the production. Previous investigation was performed on reference specimens consisting of pure cement. Samples of pure CA and cement modified by 1% of CA with the same w/c ratio were examined and compared in this paper. By investigation of these materials on the micro-scale, it is possible to identify the development of the microstructure of each and determine the impact of the modification. For this purpose, backscattered electrons microscopy (BSE) with energy-dispersive X-ray spectroscopy (EDX) was used for phase analysis as well as instrumental nano-indentation to obtain micro-mechanical properties. Presented results show the evolution of mechanical properties and microstructure in time and the impact of the crystalline admixture on modified cement.

Tolerance raka mramorovaného vůči zvýšené salinitě vody

Eastern Europe comprises a significant part of the native ranges for indigenous crayfish species (ICS) belonging to the genus Astacus. This region has been largely overlooked by astacologists and considered relatively immune to the impacts of non-indigenous crayfish species (NICS). The recent discovery of two marbled crayfish Procambarus fallax f. virginalis populations in Ukraine has changed this view. The potential increased propagule pressure (mainly due to pet trade), has raised concerns of NICS which may negatively impair the ecosystems of Azov, Black and Caspian Seas and their tributaries inhabited by ICS. In this study, we provide the first insight into salinity tolerance of marbled crayfish. We performed a 155-day experiment using 5 different salinities (6, 9, 12, 15, and 18 ppt) and a freshwater control. Evaluation of survival, growth and reproduction suggests that marbled crayfish have a lower salinity tolerance than other crayfish species, which may limit their invasive potential in brackish environments. However, its ability to survive for more than 90 days at 18 ppt opens up the possibility of gradual dispersion and adaptation to brackish conditions. Our study highlights the need for further studies elucidating the potential for marbled crayfish to negatively impair these ecosystems.
