Legal and economic aspects of foreign direct investment and historical evolution

The aim of the present thesis is to introduce the topic of foreign direct investment (FDI) from the multiscience (multidiscipline) perspective. FDI is a phenomena that cuts across many fields of human activity. It is of major significance for the national economies and an important factor for the global economic growth. Although these characteristics of FDI are widely known today, it was not always the case in the past. Since the sixties, it has been a focus of deeper studies and an object of interest especially for the international organizations that supervise the global economy. As each socio-economic phenomena, the issue of FDI has its historical background and this thesis seeks to comprehend this subject and further tracks the emergence of the business climate and economical processes that show the characteristics of later defined FDI. The historical formation of FDI is related to qualitative and quantitative development of the phenomena, and to its temporal and geopolitical context. The thesis presents the most relevant factors and causes of the present state of FDI, and monitors the crucial moments of the elements contributing to the evolution of the international investment environment. The African Union: Legal and economic analysis

African Union: Legal and Economic Analysis The diploma paper primarily focuses on African integration process, both from the legal and economic point of view. It provides a brief outline of the history of African integration, as well as the socio-political background surrounding the current attempt to unite the African region. In the first chapter, I focus on the political and legal concept of Africa, which is regarded by the preamble of the Constitutive Act of the African Union as seamless and clear. However, the idea of Africa is difficult to grasp, as multiple concerns exist within the geographic borders of Africa. This chapter also introduces in brief the theory of economic integration. The second chapter provides us with the history of African integration, which was for the most of its time closely bound with the project of decolonization and ideas of panafricanism. The adumbration of the African Union, the Organization of African Unity, evolved in a non-operational entity discredited by the respect to many African authocratic rulers who mostly demonstrated little or no sentiment to privation of their peoples. The thesis analyzes and describes recent global financial and economic crisis, some current economic problems and historical roots of the crisis. First passages of the work characterizes theoretical terms and historic economical crises, recessions and important economical events. Next part of the thesis is focused on events of the recent financial and economic crisis. The work contains description of the problems with financial innovations, rating agency, banks, modern capitalism and prevention of the crisis. The text also presents some new economical legal rules in USA and EU related to financial and economical crisis. Last chapter of the work is focused on the crisis of the European currency EURO and Greek economic situation.

English Title & Summary Marketing And Its Role In Current Economy In initial part of this diploma work, its author tries to define marketing in its actual meaning, to desribe marketing trends from the historical and contemporary view and to analyze marketing activities in relation to marketing mix. He emphasises the boundary of these activities to their economical consequences, revealing these consequences and their analysis on theree levels - single bussines, regionaly and in scale of international economy. This work evaluates all ascpect of marketign mix on each level, aimed to map single marketing activities, which can have potentional influence for the economic of a bussines, in region or in the global scale, whether in a good or a bad way. However, target here is not to make some complete list of them, but to mark and analyse the actions and marketing activities, which bring the most noticable economical consequences. This thesis is dealing with problems connected with the term The care of proper manager, that forms the basic requirement of quality of work margin in czech companies. The content is divided into nine chapters. The first chapter brings an introduction into the dilemma. It is stated here why have I chosen this topic, why do I consider this topic to be important and I am laying down the aims of my thesis. In the end, there are mentioned the methods which has been used while writting this thesis. The second chapter, the most extensive one, is focused on Proper manager' s care as a term. It is trying to define, describe and file this term legislatively; not only in terms of company law, but also in the scope of other legal enactments. Money laundering is marginalized phenomenon with high social impact which comes from necessary connection of this activity with illegal activities, especially organized crime. Since the goal of almost every illegal activity is to create profit (and since the biggest profit comes from the activities which are highly dangerous for the society, such as drug trafficking) it is vital for the society to fight money laundering effectively. It is in the best interest of the whole society to fight this phenomenon and cut the organized crime out of their resources through effective control of the money laundering. The goal of this thesis is to explain the issue of money laundering in detail, to map the whole process while using mostly comparative and analytic methods and summarize the international and Czech anti- money laundering legislation. I would be glad if the reader had truly concrete idea about the phenomenon of money laundering after reading my thesis. Lobbying - Economic and Legal aspects Abstract The diploma thesis deals with lobbying and its economic and legal aspects. The aim of the thesis is to present lobbying from a broad perspective in the context of other regulations by using descriptive, comparative and analytical methods and to provide a comprehensive overview of the development of efforts to regulate lobbying in the Czech Republic. Particular attention is paid to the analysis of the last governmental regulatory initiative where I am testing a hypothesis of whether the underway regulation is systemically correct in light of examples in other countries. I also conducted two surveys aimed at finding out the attitudes of members of the law academia and members of the lower house of the Parliament of the Czech Republic to the regulation of lobbying in the Czech Republic. The data serve both to (i) illustrate the interpretation of lobbying across the work, (ii) but also because of the specific proposed variant of lobbying within the framework of the approved substantive intent of the lobbying law (the deadline for submitting a paragraph to the government is set to end 2018), and (iii) I believe that they can be useful even when finalizing the bill, or other later proposed measures under the de lege ferenda considerations on lobbying. Capital adequacy of banks

This work concentrates on the issue of capital adequacy of banks. Inadequate capital base of the banking sector is often referred to as one of the causes of the latest financial crisis. Such topic is currently very actual. Even banking regulators pay high attention to this topic. In my thesis I focus on legal and economic aspects of this topic. It is typical for the banking sector that banks operate with much more leverage effect than enterprises belonging to other sectors. Therefore, I focus on the root cause of this phenomenon in the third chapter. I assess the bank indebtedness using the theory of optimal capital structure and I also address the relations between economic and regulatory capital. In the fourth chapter I focus on the concept of capital adequacy and its comparison with leverage indicator. The next chapter concentrates on the development of regulatory minimum capital adequacy standards developed by the Basel Committee on Banking Supervision, known as Basel I and Basel II. The last but one chapter focuses on the latest regulatory rules Basel III governing the capital adequacy of banks and their legal implementation.
