66 Legal regulation of air protection against pollution from stationary sources Abstract This thesis deals with the legal regulation of air protection against pollution from stationary sources. The thesis provides an overview of individual administrative-legal instruments of environmental protection, through which air protection against pollution from these sources is regulated. The thesis is divided into five chapters. The content of the first chapter are basic definitions and objective of air protection legislation in general. The second chapter deals with the definition of stationary source of pollution, its meaning in the legal system of the Czech Republic according to Act No. 100/2001 Coll., on Environmental Impact Assessment, Act No. 76/2002 Coll., on Integrated Prevention and Act No. 201/2012 Coll., on Air Protection and the definition in the legal system of the Federal Republic of Germany according to Act No. BGBl. I 1974 S. 721, Federal Immission Control Act and Act No. BGBl. I 1990 S. 205, the German Environmental Impact Assessment Act, and a comparison of the two. Legislation on air protection against mobile source pollution

Mobile sources, i.e. self-propelled or portable devices equipped with an internal combustion engine, are a significant contributor to air pollution and the regulation of air protection against pollution from these sources is an important part of environmental law. This area of law is currently evolving and changing very rapidly, as it is closely linked to a number of current issues, in particular climate change. The question posed by the diploma thesis is what is the current level of air protection against pollution from mobile sources in the Czech Republic, whether it is sufficient, and what is the possible development in the future. Therefore, the thesis contains a comprehensive analysis of current legislation, taking into account the various approaches by which the law seeks to regulate mobile sources and their operation, and includes topics such as introducing mobile sources to the market, regulating their operation, setting fuel quality requirements; further deals with legislation on alternative fuels and, last but not least, deals with legal instruments of air protection, which aim to maintain or improve air quality in a certain area in relation to mobile sources. Legal Regulation of Air Quality Protection Abstract This diploma thesis provides an overview of the legislation on air quality in the Czech Republic with a focus on the regulation in the Act No. 201/2012 Coll., on air protection including a detailed analysis of some problematic aspects and current issues. Air pollution is the actual global issue that is discussed not only in the Czech Republic but also all over the world, mainly because of the harmful effects on human health and the environment. This paper is organized as follows. The introductory chapter defines the necessary terms, which are essential to the following text of the paper. This chapter also describes the distribution of air pollutant sources and the importance of this distribution for subsequent obligations. The next chapter provides an overview of the historical development of Czech, international and European air quality legislation following by chapters, where the individual types of regulatory instruments to reduce air pollution are analyzed.
