The institution of superficiary right of building in the private law restatement in the Czech Republic

The Institute of the Right to Build in the Context of the Recodification of Private Law in the Czech Republic Abstract This master thesis is devoted to a comprehensive analysis of the legal regulation of the right to build as a legal institute reintroduced into the legal system of the Czech Republic on 1 January 2014 with the entry into force of the Act No. 89/2012 Coll., the Czech Civil Code, including the placing of the right to build in the context of its historical background or its comparison with the corresponding applicable legal regulations of foreign countries, which represent sources of inspiration for the legal regulation in the Czech Republic. The right to build allows, in particular, the construction of a building by the builder on land that is not owned by him, or, in general, allows the builder to have a building on such land. This legal institute represents a special temporary exception of application of the legal principle of superficies solo cedit. The building, which becomes part of the right to build for the duration of the right itself, does not, according to the general rules of law, accrue to the land on which it has been built. Owneship Development based on Land Book in Cadastral Unit Solopysky u Třebnic

In the first part of my thesis I focus on the historical development of real estate records from the Middle Ages to the present land register of Czech Republic. I focus mainly on description of the land terriers, recording system and individual registers. The second part documents and clearly defines the ownership structure and other in rem laws to the land since the second half of 19th century until 1950, according to the individual library insertions of land terriers kept in the cadastral Solopysky at Třebnice. Moreover, it also allows comparison of data collected from the land terriers and the current state of ownership and land fragmentation.
Conception and Idea of Property, Historical Development of Property Rights on the Territory of the Czech Republic and Germany

In my thesis I follow historical development of property rights in Europe. I focus in particular on relationship to land and records of property conditions in law. The important moments are relation between ownership and state and landed property as a policy instrument. The aim is to reveal, when and how the ownership as a legal institution came into being and how the status of an individual reflected his or her ability to acquire property. I pay attention to the most significant law-making factors and to the way how the ownership relations affect social order and economic performance at the particular time. The theoretical part firstly defines relevant terms of law and then deals with the institution of property in the history of philosophy and economic thoughts. The analytical part compares development of property rights in the Czech lands with that of state forms on the territory of nowadays Germany. The comparison sets this development in a wider frame of legal, political and economic history and observes the interaction of the both lands in the area of property conditions in the past.
