CCTV systems in the workplace Abstract This thesis focuses on the topic of CCTV systems in the workplace, both from the perspective of Czech labour laws and the european General Data Protection Regulation. The thesis focuses on the analysis of individual legal sources and presents an overview of the legal obligations and criteria that the employer is obliged to fulfil in order to install and use CCTV systems in the workplace. The thesis is divided into four thematic parts. In the first part of the thesis, space is devoted to the definition of the term "CCTV system" and the division of CCTV systems into types according to criteria relevant to the legal regulation of personal data protection. Subsequently, with emphasis on the development of the opinion of the Personal Data Protection Office, it is examined whether the defined types of CCTV systems fall within the scope of the GDPR. This section also defines the concept of 'dummy' cameras. The second part of the thesis focuses on the interpretation of Section 316 of the Labour Code, which regulates the possibility of employee surveillance in the workplace. Camera system in the workplace and its encroachment on personal rights of employees

The topic of this thesis is the legal regulation of camera system in the workplace and characterization of its encroachment on personal rights of employees. The main emphasis is put on conditions, which employer must fulfil to install a camera system in the workplace in compliance with the legal order of Czech Republic. Furthermore this thesis is devoted to issues of discreet surveillance and of defence of employee options in case of illegal monitoring. This thesis is divided into three following chapters. In the first chapter, technological development of video camera and its components as well its gradual using as surveillance equipment in public space and afterwards in private life of persons are described. This chapter deals with today's situation and number of video cameras in society, not only in Czech Republic but also in the whole world. Increasing amount of video cameras represents as its consequence a reason for legal disputes, especially neighborhood's legal disputes. Considering that mentioned fact, the relevant decisions of the Supreme Court illustrating attitude of judicature to camera surveillance are incorporated in the first chapter. Personal Data Protection in Labour Law Relationships The thesis deals with personal data protection in relation to employees as a subject of data and an employer as a person processing such data. At the beginning, general issues of personal data protection are analysed, including a short overview of data protection regulations within both an international and domestic context. The introductory part also includes an explanation of terminology and a description of individual rights and obligations in the field of data protection. In the following part the author concentrates on the regulation of disposal of particular types of personal data that are processed in relation to creation, duration or termination of labour law relationships, and also on the relationship between the Act No. 101/2000 Coll., on Personal Data Protection, and the Labour Code, as well as other related legislation. Attention is devoted to the extent of personal data that the employer may request from candidates for a vacancy, as well as to the necessity of the employee's consent to the processing of their personal data by the employer. This thesis deals with the issue of privacy in the workplace. Employees expect to have some privacy at work, even when they are using the employer's equipment. On the other hand, employers need basic information about their employees and they have the right to know that work is being done properly and efficiently. Finding the balance between the interests of both sides is quite complicated and the disputes regarding privacy infringement in the workplace are often decided by highest courts. In concrete, this thesis deals with the processing of personal data in the employment context and with the surveillance of employees. The aim of this thesis is to provide a comprehensive overview of this issue and assess the current level of protection of privacy of employees in Czech Republic. The thesis is composed of nine chapters. The first introductory part of this thesis (chapters 2 - 4) describes the fundamental human right to privacy and personal data protection in general. Employees surveillance from a data protection perspective Abstract The topic of the thesis was employee surveillance from a data protection perspective. In the first chapter I outlined the issues of the right to privacy with regard to the employee's workplace and the protection of personal data in employment relationships, together with the relevant legislation, including subsidiary and European regulations. The most relevant regulations in this field are the Labour Code and the directly applicable EU GDPR. In the second chapter, I have slightly stepped forward from the theoretical to the practical level by analysing what the employer-employee relationship might look like under Section 316 of the Labour Code and, in particular, I have discussed the basic principles, conditions and rights of the GDPR such as legality, transparency etc. and then I have presented some more problematic practical examples. In the last part of the chapter, I introduced the concept of connected vehicles, which we cannot yet encounter in full. In the third chapter, I discussed purely practical cases decided before the European Court of Human Rights. In particular, the judgment in Barbulescu v. Monitoring of Employees Abstract The thesis aims to provide a critical review of the complex topic of employees monitoring to the reader. The thesis summarises the information from the le- gislation connected to employees monitoring concerning the legal aspects of per- sonal data protection. The thesis also takes into account the recent changes in European legislation. The primary legislation related to this subject is the pro- vision of Section 316 of the labour code, as well as the European regulation of personal data protection GDPR. The thesis is divided into four chapters. The first chapter offers a historical overview of the labour law and the protection of privacy and personal data. In the second chapter, the particular legal bases of employees monitoring are analysed. The third part is focused on the history and the activity of the supervisory authorities which are the Office for Perso- nal Data Protection and the State Labour Inspection Office. In the last chapter, the particular methods of employees monitoring, namely closed-circuit television, control of correspondence, phone calls and business computers, location tracking and biometric identification are described and analysed. Personal Data Protection and Labour Law Relationships

This thesis deals with the protection of personal data in relation to the labour law relationships. Considering the extensiveness of the topic of personal data protection, the aim of this thesis is not giving an all-encompassing explanation, however, to introduce the general legal regulations together with the explanation of the principal legal concepts and their subsequent application on the labour law relationships. The author divides this thesis into 6 chapters. Apart from the relevant legal regulations the author focuses on the main case law and opinions issued by WP 29 and UOOU (the Office for Personal Data Protection) as well, which interpret some legal uncertainties. By reason that the personal data protection is integrally connected to the inviolability of the person and privacy itself, the first chapter focuses on the concept of privacy and its interpretation. The second chapter discusses the privacy and data protection legal regulation. The submitted thesis deals with personal data protection in the context of labour-law relationships. This is an actual and discussed issue in current society, which has constitutional aspects as well. Due to the extensiveness of the topic, the aim of this thesis is not giving a comprehensive explanation of the personal data protection in labour-law relationships area. My effort is to perform the reader with this issue from the general introduction including a survey of the legislation and explanation of main concepts to outlining the fundamental principles of the legislation and focusing more thoroughly on the several selected questions. The thesis itself is divided into four chapters. In my thesis I am trying to point out to the most important court decisions and also the opinions of The Office for Personal Data Protection and The Article 29 Working Party. In the first chapter I deal with the concept of privacy, because I consider it to be a "foundation stone" of the whole issue of personal data protection. This chapter demonstrates how the concept of privacy has developed in the course of time, in the next chapter the legislation of privacy protection and, as well, a conflict with other values are pointed out.
