Reasons for intervetion in the exercising of parental rights

Grounds of intervention in execution of parental rights (abstract) The upbringing of a child is the major right and duty of its parents. The Convention on the Rights of the Child binds signatory states to respect the privacy of the family and the rights of parents to raise their children. According to this international treaty and also to national legal documents, such as the Charter of Fundamental Rights and Freedoms and the Family Code, the only acceptable ground for state intervention into the family is the interest of the child. The child can be separated from its parents only when this action is in accordance with the child's best interest and if the conditions for such action given by the law are met. The aim of my thesis is to introduce the institute of intervention in parental rights in czech family law and focus on the grounds and conditions for its application. The purpose of my thesis is to look at this institute from a different perspective than everybody else. During my studies I came across many textbooks, articles, papers and lectures concerning this matter. Each one of them focused on the means of state intervention. In the press we see confused interpretations of court's rulings concerning children taken from their families and speculations of state despotism in this matter. I realized that...
The legal analysis of registered partnership

The subject matter of this diploma thesis is an institute of register partnership analysis effective in Czech Republic. The initial chapters define terms such as family, marriage, discrimination or process of legalisation. Those terms are subsequently confronted with the subject matter of this diploma thesis. The main part of this thesis is focused on the law analysis with its legal effects in other branches of law. The diploma thesis also includes a chapter about parental right of homosexual persons. Last of all I mention proposed amendment about registered partnership. The aim of my diploma thesis is to give a complex grasp and survey about contemporary legal situation of the registered partnership issues.
Public attitude towards parenting of homosexual individuals and couples

The master thesis "Public attitude towards parenting of homosexual individuals and couples" deals with an attitude of Czech public towards parental rights of homosexuals and attitude of European public towards alternative family forms with focus on homoparental families. The topic requires attention as part of Czech legislators currently tries to pass the novella of Registered Partnership Act, which would enable homosexuals to adopt children of their partners; and with regard to the impact of public attitude towards homoparental families on these families. The current legislation concerning homosexual rights is described in the paper along with the up to now legislative process of submitted novella of the law. Also other ways of becoming parents besides the adoption of partner's child which homosexuals can use in the Czech Republic or elsewhere are presented. The thesis then focuses on adoption and assisted reproduction. Attitude of Czech public towards these parental rights of homosexuals is subject of own quantitative research, in which also predictors of this attitude and groups of people with more negative and more positive attitude than the rest of the population are identified.
