Work from home Abstract The subject of this diploma thesis is work from home, which refers to work performed partially or entirely from an employee's domicile. The purpose of the thesis was to analyze the legal regulation regarding working from home and address selected problematic aspects related to it. The objective was to propose suggestions according to the designed law, which would help to align work from home with the current needs of employees and employers from a legal perspective. The diploma thesis is comprised of an introduction, seven parts, and a conclusion. The first part discusses work from home as dependent work, as well as two modes of performing work at home depending on whether the employee schedules their working hours or not, and what the consequences are for both the employee and employer. An amendment to the Labor Code which became effective from 1 October 2023 is also mentioned here in connection with the changes made to the regime of employees working from home who schedule their working hours, which now falls under section 317 subsection 4 of the Labor Code. On 1 October 2023, most of the so-called transposition amendment to the Labor Code came into force, which brought many significant changes to the Czech legal system. Among them is also the anchoring of the new legal regulation of remote work, the legal regulation of which has been very austere until now. The aim of this Diploma thesis is to analyse the legal regulation of remote work with a focus on the transposition amendment. This analysis is intended to enable the evaluation of both the various forms of the amendment during its preparation, as well as the final wording of the provisions in the Labor Code that relate to remote work. In the first part, the Diploma thesis is devoted on definition of remote work as one of the atypical forms of employment, looking at its definition, as well as its relation to related concepts and its historical development. Furthermore, the thesis deals with the legal regulation at the international and EU level, when the expiry of the deadline for the mandatory transposition of the WLB directive was one of the main impulses for the adoption of the new legal regulation. Zvýšená prevalence práce na dálku v důsledku pandemie covid-19 vedla ke zvýšenému zájmu o tuto formu organizace práce a její dopad na pohodu a zdraví zaměstnanců. Práci na dálku lze definovat jako jakýkoli typ uspořádání práce zahrnující používání osobních počítačů, chytrých telefonů, notebooků, softwarových balíčků a internetu k práci z domova nebo obecněji mimo pracoviště zaměstnavatele po většinu pracovní doby nebo její část.

This bachelor thesis deals with work performance and work management on re-mote work conditions in a selected company. The aim of the thesis is to assess the home office as one of the options of work organization and in terms of its long-term functioning, especially in the field of performance and work management of remote workers. The thesis is divided into two parts. The first part contains a review of the litera-ture dealing with the issue. The second part of the thesis contains the actual re-search, which is divided into two parts. The first part of the research is based on a questionnaire survey, which was participated by the employees of the given com-pany. The second part is structured interviews with 5 senior employees of the company.

The aim of the bachelor thesis is to provide recommendations for the employer that will help him effectively utilize the home office within his company. The bachelor thesis is divided into literature research, methodology, analytical part, suggestions, and discussion. The literature research provides an overview of ex-isting knowledge on the topic, while the methodology sets research methods and questions that are then answered in the analytical part. The suggestions section provides proposals that should contribute to the appropriate use of work outside the employer's workplace. The discussion compares research results with previ-ous studies, presents research limitations, and proposes further research.

Remote Work Abstract This thesis deals with the issue of remote work, or in other words, mobile work as this thesis calls it. In the first chapter, the concept of mobile work is defined, while the lack of unified terminology in both, academic literature and practice, is addressed. The thesis then analyses the current legal framework concerning mobile work, demonstrating through specific examples that practice, expert community, as well as the Ministry of Labour and Social Affairs and the legislator (through the respective explanatory report), often consider the provisions of Section 317 of the Labour Code as the regulation of mobile work. The thesis critically examines this approach, identifying Section 317 of the Labour Code as a relic of the historical legal institute of so-called home employment, concluding so, among other thigs, on the basis of a direct comparison of the wording of Section 317 of the Labour Code with relevant historical legal regulation. Consequently, the thesis concludes that mobile work per se, strictly speaking, is not regulated by the law, even though the regulation of home employment bears a significant resemblance to mobile work. Vliv pandemie koronaviru na pracovněprávní vztahy Abstrakt Diplomová práce se zabývá vlivem pandemie koronaviru na pracovněprávní vztahy. Cílem práce je zaměřit se na právní instituty, které se ocitly v centru zájmu v souvislosti s příchodem pandemie a posoudit, zda právní úprava byla dostatečná a jaký dopad měla na adresáty právních norem. Diplomová práce je rozdělena do sedmi kapitol. První kapitola je zaměřena na překážky v práci praktikované na situace, které vyvstaly s příchodem pandemie. Tato kapitola klade důraz na otázku, kdo nese, popř. by měl nést náklady za negativní dopady způsobené pandemií. Druhá, třetí a čtvrtá kapitola se věnují jednotlivým subjektům a míře, jakou byly dotčeny pandemií Covidu-19. Druhá kapitola se zaměřuje na zaměstnance pracující distančně a možné potíže, které jsou s prací mimo pracoviště zaměstnavatele spojené. Třetí kapitola se zabývá právním postavením povolaných studentů, kterým byla za nouzového stavu nařízena pracovní povinnost a vhodností využití tohoto institutu. Předmětem kapitoly čtvrté jsou pak zaměstnavatelé a jejich nárok na státní pomoc.
