Comparison of Tax Evasion in Value Added Tax in Selected EU Countries and Estimation of the VAT Gap

The diploma thesis deals with the finding and evaluation of the usefulness and influence of tax authority tools in the Czech Republic and in selected countries of the European Union according to similar indicators. The aim of the thesis is to analyze the effectiveness and utility of the tools used. The number of information in the international exchange of information is compared and the number of tax subjects in the gray economy and their involvement in tax evasion is evaluated. The theoretical part defines core elements of the diploma thesis which are the value added tax, the VAT GAP and the division of tax authority instruments. Concurrently, it describes related mechanisms which shall ensure the elimination of tax evasion. The practical part analyzes selected instruments and their values that the tax authority has at its disposal to combat tax evasion. From the output data, the VAT GAP is estimated using a calculation using the gross domestic product adjustment method. All results found within the Czech Republic will be compared with available comparable data in the EU countries. To conclude, the results are valorized, and instruments are evaluated internationally. It is estimated the amount of the VAT GAP and the possible prediction of future developments.
Value Adedd Tax Optimization in a Selected Company

The diploma thesis deals with the value added tax in the company. An important area in the company is the optimization of value added tax, leading to a legal reduction of its tax liability. Tax optimization is the main aim of this thesis. The effort is to approach the issue of this tax with an insight into the activities connected with it directly to the selected organization. This organization is a South Bohemian company whose main activity is production for the processing industry. The thesis focuses on record keeping of invoices, associated with this tax. Further, the study describes the tax codes, which are an integral part of compiling tax statements. The issues of customs and exchange rates are also not forgotten. At the end of the thesis, there is an analysis of these tax statements and proposals aimed at optimizing the value added tax. The last chapter of the thesis is devoted to carousel frauds, which are among the most sophisticated tax frauds in the VAT field.
Financial Law Instruments Combating Value-Added Tax Evasion in the Perspective of European Union

This dissertation broadly focuses on the problematics of the tax evasion in the field of the value-added tax from the perspective of the European Union law wherefore it does not contain parts devoted just to the national instruments combating tax evasion. The aim of the dissertation is the analysis of the terms which could be met due to the inconsistent terminology concerning tax evasion, then the aim is to provide classification of the tax evasion and to analyse individual measures combating tax evasion recognised by the European Union law. Therefore, the case law and opinion of the professional community are examined by the descriptive, analytical and comparative scientific method and later, founded conclusion are generalized by the synthetic method pointing out the pitfalls of their application in the Czech legal environment. The result of this dissertation shall be the coherent insight to the terminology connected with the tax evasion in the field of the value-added tax and the analysis of legal instruments combating tax evasion established by European Union law containing the evaluation of individual aspects of this issue. The Reverse Charge and the Institute of Review Statement in Value Added Tax Act

The final thesis deals with the amendment of Act no. 235/2004 Coll., Value added tax Act, as amended, which extends the reverse charge and introduces new institute of review statement. The aim of the thesis is to evaluate the new regulation in terms of its suitability and potential benefits and also in terms of its failings and disadvantages. Concurrently the thesis focuse on the evaluation of the impact of extending the reverse charge and introducing the institute of review statement on the fight against value added tax evasions, which are represented mainly by carousel frauds. The thesis is divided into three chapters. The first chapter describes the basic characteristics of value added tax as an indirect tax, based on the principle of paying the tax on output and consecutive application of the deduction, and further discusses the basic structural elements of the tax. The explanation focused on the value added tax frauds is given at the end of the firts chapter, where is detailly described the functioning of the carousel frauds with cross-border element, which are becoming more important. This thesis deals with the impact of significant changes to the VAT Act in the con-struction industry. It evaluates the impacts of the introduction of the reverse charge regime for construction and assembly work on the economic indicators of construction companies and VAT collection. The work also evaluates the effects of changes in the rates of value added tax on economic indicators of construction company, construction work prices, property prices and VAT collection. Based on the results, the author puts forward suggestions and recommendations.

This diploma thesis deals with the tax and accounting specifics in construction industry. The work is divided into theoretical part and own work. The theoretical part is divided into tax and accounting. The tax part is mainly devoted to changes that occurred on 1 January 2012 when the reverse charge was introduced in the construction industry and illegal activity was enacted and accounting part analyzes specific items of balance sheet. The aim of the work is partially contained in the chapter "Vlastní práce" where is evaluated the impact of the reverse charge procedure on the cash flow of the recipient and the provider by classification of products CZ-CPA 41-43. It is also described the impact on the real company and the state budget. There is also evaluated the impact of employ the employee in employment and in the so-called "švarcsystém". In conclusion the theoretical and practical knowledge to lead to expressed the objectives of work which was to introduce measures that will lead to the elimination of the negative effects of the reverse charge and proposals that could lead to tax savings.
System reverse charge for VAT in civil engineering

In the first part of this thesis is characterised VAT, is mentioned its principle, basic terms. Then is characterised reverse charge system on the level Directive 2006/112/ES principle, reasons for implementation, application in the Czech republic, etc. The second part of this thesis is described the system reverse charge in civil engineering in detail. There are mentioned principles of uses. Then are analysed problems, advantages and disadvantages related to this system of taxation. These aspects evaluated the subjects of taxation a electrician, a joiner and construction company (from viewpoint customer and supplier) and tax administrator.
Value added tax in accounting

This diploma work focuses on the context of value added tax and accounting. The first part is devoted to the description of the sales tax and its difference from the value added tax. The sales tax was replaced with value added tax by the European Union so it is under the harmonization process control, which is briefly mentioned in the work. Furthermore diploma work contains general principles on which value added tax works, and describes the development of the reverse charge procedure, which is used for domestic transactions. Attention is also paid to the issues of tax evasion and fight against them. The last part focuses on the relationship between value added tax and accounting. Difference between tax and accounting documents, diagrams showing the charging of value added tax and the relationship between the revenues and the date of the chargeable event are mentioned.
