Legal aspects of on-site inspection of the Office for the Protection of Competition and the European Commission

The Master's thesis describes and analyses the legislation of the on-site inspections conducted by the Czech Office for the Protection of Competition and the European Commission. The competition authorities may investigate business and other premises in order to find evidence proving the violation of competition rules. The on- site inspection or so called dawn raid is a main investigative and the most effective tool of the competition authorities in proceedings concerning the possible breach of competition law. The main aim of this thesis is to provide a detailed description of the relevant legislation and case law, to highlight any legal issues connected with on-site inspections and offer solutions of these issues, and finally to examine guarantees of the fundamental rights of the undertakings during the inspection. The thesis consists of eight chapters. Chapter One and Two are introductory and describe basic terms connected with the competition law. In Chapter Three the thesis deals with the scope of relevant Czech and EU legislation. Chapter Four is concerned with the guarantees of fundamental rights within on-site inspections. Unannounced on site inspections in competition The purpose of my thesis is to analyse unannounced on site inspections in the competition law with regards to the Czech and European Union legal system. The thesis is composed of six chapters. Chapter one is introductory and defines the aims of the thesis. Chapter Two briefly discusses the basic legal framework of this area of law. Chapter Three is subdivided into six subchapters and sets out the competence of competition authorities including the cooperation within the European Competition Network. Chapter Four consists of two parts and concentrates on problems resulting from specific administrative proceedings before the Office for the Protection of Competition. Chapter Five is composed of fourteen subchapters. Each of them deals with specific aspects and details of inspections in a broader perspective. Providing measured documentation of existing structural and technical conditions of a single-family house in Brno

The diploma thesis deals with the passport of family houses and its creation. The first part describes the building condition survey from a theoretical point of view, its advantages, purposes and sorting, possible owners and so its legislative background. Thereafter it describes in detail the procedure of making the passport and applies the procedure on a particular family house in Brno. Medium passport of the family house focuses on describing the structural and technical condition. It also describes the current faults, errors and methods whose reveals them. Subsequently, the proposals for solution of these adjustments follows together with the resolution of emergency in specific cases.
Analysis of the Location Impact on the Price of Housing Units in Olomouc

The master s thesis deals with the influence of location impact on the price of housing units in Olomouc. The theoretical part describes some basic concepts, whitch are necessary for understanding the issue and also provides valuation methods used in this thesis. The practical part of the thesis describes the location Olomouc and its parts specifically. The following is a description of the apartments, their location, quality and other facts identified by the place investigation. Other chapters focuses on comparative technique method to estimate the administrative price and market valuation to estimate the market price. Finally are compared unit prices of the apartments to each other and evaluated teh influence of the estimated price of the apartment.
Methodology of Surveying Real Estate for the Assessment of Selected Types of Non-residential Buildings

The aim of the thesis is to design procedure of inspection non-residential immovable property. There will be done analysis of methods used to evaluate immovable property, with focus on local investigation in the master thesis. Based on this analysis there will be set common and specific recommendation for preparation of source data, for evaluation of buildings, and for local investigation in case of evaluation buildings. The purpose of this thesis is to help experts with preparation of source data to make evaluating report.
Issue of detailed building condition survey processing of building constructions

Processing of expertises in litigations in the area of damages caused by civil engineering on other owners‘ surrounded ground constructions led the author to write this contribution. Condition survey of current state is done on other owners‘ surrouded buildings before working constructions, mainly on underground structure, engineering and ground constructions, start. There are sometimes protracted litigations and expertise processing in determination of damage level in case of damage in connection with such construction. That is why the author deals with the issue of building condition survey and decisions made by both a client and a processor about details and distances from a place of constructions when building condition survey is proceeded.
