Legal regulation of experimental animals handling This thesis deals with the legal regulation of experimental animals handling and their protection in international law, European union law and national law. Its goal is to complexly capture current legislation in this field, point out unsystematic or otherwise unsuitable institutes and propose means of their change. The core of the thesis is a description and an analysis of relevant parts of the Act on Animal Protection Against Cruelty, directives and regulations of the European Union and international treaties. Furthermore the thesis includes a treatise on the legal status of an animal, a brief introduction into ethical issues of animal experiments, historical evolution of relevant legal regulation and questions of administrative and criminal liability in the field of experimental animals handling.

Due to the comprehensiveness of the topic of animal protection, the thesis focuses on its specific segment - liability in tort in the field of animal protection as individuals. In the diploma thesis the term "animal" is used stricto sensu - it means individuals falling under the term "animal", as defined by the Act No. 246/1992 Coll., on the Protection of Animals Against Cruelty - ie every living vertebrate, except humans, but not the fetus or embryo. The aim of the diploma thesis is to give an explanation of tortious liability in the field of administrative and criminal law in animal protection, to critically evaluate the current legislation, identify problematic areas and suggest possible changes. The secondary goal is to present the basic scope of the primary obligations set by the Act No. 246/1992 Coll., on the Protection of Animals Against Cruelty. The diploma thesis is divided into a total of six chapters, introduced by the introduction and supplemented by the conclusion. The first chapter provides an explanation of the basic concepts that are used in the field of animal protection, such as the term "animal" and similar terms or for example term "welfare". Where is the legal protection of animals heading for?

In the last decades, the society worldwide becomes more sensitive to animal suffering and this new ethical approach has already been deeply reflected by law. In many states, an increasing interest in animal issues mirrors in the civil, constitutional, criminal and administrative law, in order to ensure the animals better living conditions. Now, new voices call for recognizing animal rights as rights similar to basic human rights, to get even stronger position of animals in law. The paper shows that the legal treatment of animals is coming to an intersection, with an open question, to what direction will the future animal protection head for.

The Act on the Police of the Czech Republic empowers policemen to enter certain types of premises of the keeper even without his or her consent if there is a reasonable suspicion of animal abuse. The article deals with the description of relevant legal provisions and gives some remarks of their practical implementation.
