"Crime of murder under Section 140 of the Czech Criminal Code, criminal-law and criminological aspects"

This thesis called "Crime of murder under Section 140 of the Criminal Code, criminal-law and criminological aspects" focuses mainly on description of variety aspects connected with the above mentioned crime. It does not thus concentrate only on a legal standpoint. In the beginning, it contains history of legal regulation of the crime of murder, depiction of punishment for such crime in a "historical" area of the Czech Republic within past centuries, as well as development of principles governing the main criminal codes (or regulations) throughout history. Term and principle of protection of the human life is, as an integral part and key term of the thesis, mentioned therein including very precise and detailed definition of the commencement and termination of the human life such moment being very important for determination whether the murder may have been, in certain cases, committed or not. Actually, right to life is also one of essential notions used also in international-law treaties and declarations whose list is also contained in the thesis. As it follows from the title of the thesis, its core shall be (and, indeed, is) represented by the valid legal regulation of the crime of murder under Czech law. Murder and manslaughter within the Czech criminal law

The crimes of murder and manslaughter described in this thesis consist in intentional killing of other person. These crimes are very serious ones and are contained in the first part of first chapter of Act No. 40/2009 Coll. the Criminal Code, as amended, and attack against one of the highest and the most protected interest - the human life. The aim of this thesis is to provide its reader with a rather complex and well arranged description of the above-mentioned crimes from the criminology and criminal law standpoint. The author tried to capture the most essential differences between the murder and manslaughter, both being often called the intentional killing. The author endeavors to briefly outline in this thesis a historical development of legal regulation of intentional killing from the past to the present day. The thesis also defines the human life, the moment of its commencement and termination as a crucial moment from which the crimes of murder and manslaughter are considered accomplished. Furthermore, it describes their basic and qualified facts of the case, a possibility of punishment of its offenders and individual phases of both crimes described in this thesis. Crime of murder under section 140 of the criminal code: criminal law, criminological and criminalistic aspects Abstract This thesis is intended to provide the reader with a comprehensive overview of the crime phenomenon of murder not only from a criminal law point of view, but also from a criminological and criminalistic point of view. Before the analysis of the actual questions is first described the history of the legal regulation of murders in the territory of nowadays Czech Republic, as the outline of the development and approach to punishment of murders in history serves to better understand the form of the present arrangement and its meaning. Subsequently, the term human life is described, in which it is important to define its beginning and end, as it is highlighted that it is the object of the murder crime and the most important criminal code protected by the interest. After that, the issue of the crime of murder from the point of view of criminal law is already addressed, especially by its inclusion within the system of intentional killing, which is contained in the current Criminal Code. This master's thesis entitled "The Crime of Murder under Section 140 of the Czech Criminal Code, Criminal-law and Criminological Acpects" provides a comprehensive analysis of the most relevant criminal-law and criminological aspects of the crime mentioned above. As the aim of this thesis is to compose a comprehensive text, this thesis also refers to related legal institutes. It is composed of seven chapters and other subchapters and parts, which are connected and arranged in a logical order. There are also considerations de lege ferenda throughout the entire text. The opening part of this thesis deals with the historical development of the legal codification of murder from the Middle Ages until the contemporary Criminal Code which came into effect in 2010.
