Tato diplomová práce "Trestný čin vraždy dle § 140 TZ, trestněprávní a kriminologické aspekty" se soustředí na rozbor nejdůležitějších trestněprávních a kriminologických aspektů souvisejících s trestným činem vraždy. Cílem práce je komplexní zpracování tématu, proto se snaží zpracovat i související právní instituty. Práce je členěna na 7 kapitol, které jsou provázané a logicky na sebe navazují. Napříč prací jsou vyjádřeny i návrhy de lege ferenda. Úvodní část práce se zabývá historickým vývojem právní úpravy vraždy, a to od středověku až do nabytí účinnosti nového trestního zákoníku z roku 2009, který v oblasti vražd přinesl hned několik významných změn. Práce se dále zabývá vymezením lidského života, přesně vymezuje jeho počátek a konec, neboť definice lidského života jako objektu trestného činu je pro účely práce stěžejní. Práce tedy podává výklad o tom, kdy lze z hlediska trvání lidského života hovořit o vraždě a kdy nikoliv. V rámci komplexnosti je stručně zpracován i přehled vnitrostátní a mezinárodní úpravy týkající se ochrany lidského života. Jádro práce tvoří rozbor současné právní úpravy vraždy. Jsou rozebrány a popsány jednotlivé obligatorní znaky skutkové podstaty, dále jsou rozebrány jednotlivé typy vražd a definovány pojmy, které jsou pro jejich správnou kvalifikaci klíčové. V... This master's thesis entitled "The Crime of Murder under Section 140 of the Czech Criminal Code, Criminal-law and Criminological Acpects" provides a comprehensive analysis of the most relevant criminal-law and criminological aspects of the crime mentioned above. As the aim of this thesis is to compose a comprehensive text, this thesis also refers to related legal institutes. It is composed of seven chapters and other subchapters and parts, which are connected and arranged in a logical order. There are also considerations de lege ferenda throughout the entire text. The opening part of this thesis deals with the historical development of the legal codification of murder from the Middle Ages until the contemporary Criminal Code which came into effect in 2010. This Criminal Code introduced some significant changes to the area of intentional killings and murders, especially. This thesis also characterises human life and precisely defines the beginning and end thereof. Such moments are pivotal for the purpose of this thesis as these moments are important for determination whether the murder may have been commited or not.
