Regions and environmental protection

Thesis titled `Regions and environmental protection` is divided into three parts. The first part is devoted to planting regions in the necessary historical context. The second part describes the constitutional anchoring region, and their constitutive elements defining the concept of independent and delegated powers. In the last section, I focus on linking the county institute, and environmental protection. The conclusion is devoted to the role of the county in a separate and delegated powers in selected components of the environment. Counties in the environmental protection acts as a necessary link between the state and municipalities, since they deal with things that goes beyond the possibilities of their own communities, but also below the national importance.
Environmental protection instruments in Czech law

This diploma thesis deals with the instruments of environmental protection which are used in the Czech legal system. Thanks to these instruments, the state and other institutions try to assign the most effective environmental protection possible. We can divide these instruments into two main categories, direct and indirect. The direct instruments are divided into conceptual, administrative - law, vindicatory and voluntary. The indirect are represented by the economic instruments, which can be divided into instruments of positive and negative stimulation. The thesis also contains specification of the particular basic principles of the environmental protection and the concretization of the institutions responsible for the protection. Each chapter also contains a demonstration of how each particular group of instruments can be practically applied in the nature and landscape protection.
Instruments of environmental protection in Czech law

The subject of this diploma thesis are instruments of environmental protection, which are used in the Czech legal system. With the aid of these instruments the state and other institutions try to ensure the most effective environmental protection. The instruments of environmental protection are divided into two basic groups. On one hand there are instruments with direct effect, on the other hand instruments with indirect effect. In the first group belong instruments administrative, conceptual, vindicatory and special. Economical instruments fall into the second group. Administrative instruments include primarily different commands, restrictions, permissions, standpoints, expressions, standards and limits. They are about actions that are applied by public authorities. To the conceptual instruments belong different conceptions, plans and programs that represent certain long-term documents of human aiming in a certain area. To the vindicatory instruments belong fines and other forms of penalties. We distinguish tort liability and responsibility for environmental damage. Legal instruments of waste management

The purpose of my thesis is primarily to describe the system of the waste management instruments and their role in the environmental protection and to analyse if the system is working well and is able to reach the outlined binding goals in the future. Due to the planned legislative changes the attention is paid to the individual sources of law. Although I focused more on the national law, I did not forget to mention the international and European law either. In the partial conclusions and in the finale of the thesis itself I summarize and generalize acquired knowledge and try to indicate some of the weak spots in the waste legislation.

Economic instruments of environmental protection

The economic instruments of environmental protection form an important part of environmental policy of each state and play a substantive role in forming of specific policy packages. Reagulation founded in Czech law with regards to the system of environmental fees is an object of this thesis. The thesis is dividend into four chapters. The first chapter brings a general characterization of the environmental policy tools and it defines them in contrast to direct regulation instruments. The second chapter mentions the historical development of economic tools, discribes them and explains their functions. The main third chapter deals with emission fees legislation mainly. However, the system of the fees is assessed according to accomplishing the functions typical to economic tools. At the same time it is evaluated in accordance with the overall effectivity point of view. The fourt chapter focuses on the other economic instruments and it endeavours to evaluate the positive and negative aspects of its actual regulation.

Tools for environmental protection in Czech law

The thesis is concerned on the topic "Instruments of environmental protection in the Czech Republic". The environmental law knows some categories of instruments. Mostly they are divided according to the influence to the subjects, respectively if they have direct influence to subjects or not. First category of direct instruments is called conceptual instruments and includes group of plans, programs and other documents concerned on scheming in area of environmental protection. Second group of direct instruments is called administrative instruments. These instruments contain commands, prohibitions, permits and approvals. They also contain standards categorization and ecologically-legal liability. Third group of direct instruments is called voluntary instruments. These instruments contain voluntary agreements, environmental managements systems and eco-labeling. Last group of instrument described in this thesis are institutional instruments. They are concerned on system of institutions which have some competences in environmental protection. They are divided according to area of their competences or according to the kind of competences they have. Indirect instruments are represented mostly by the economical instruments.
