Felling woody plants which grow outside of the forest and a transport infrastructure Abstract The subject of this diploma thesis is a legal regulation of felling woody plants located near road and rail transport infrastructure. It focuses mainly on the analysis and evaluation of the current legal regulation of this area, together with de lege ferenda proposals that could lead to the improvement of this legal regulation. This thesis is divided into three sections, which are further divided into individual chapters and subchapters. The first section is focused on the description of the general legal regulation of felling woody plants which grow outside of the forest. This general legal regulation form the basis of special legal regulations of felling woody plants located near road and rail transport infrastructure. In this section there is an illustration of the central concept of woody plants which grow outside the forest, an exploration of three basic principles of this regal legulation and, above all, a description of the individual regimes under which it is possible to fell woody plants. Special protection regimes of woody plants which grow outside of the forest are also briefly discussed. The bachelor thesis analyses the current state of the woody plants at the grounds of Hamza Specialist Sanatorium at Luže-Košumberk, and suggests their treatment. More than 200 specimen of the tree TIlia L. and Fagus L. were scrutinised for the purpose of this thesis; all the basic dendrometrial measurements were taken for each one of the trees, their physiological age was determined, as well as their vitality and state of health. Individual treatment was devised for particular trees, and their price was evaluated.

Resumé Právní úprava ochrany dřevin Tato práce se zabývá problematikou právní ochrany dřevin rostoucích mimo les. Okrajově je předmětem této práce i problematika právní ochrany lesa. Autor se ve své práci zaměřuje na praktické otázky zkoumané materie, s ohledem na své praktické zkušenosti a navrhuje některá dílčí řešení. Prioritním cílem autora není vyhledání všech problémových ustanovení, která se dotýkají zkoumané materie, ale posoudit úroveň právní úpravy v globálním měřítku. Blíže se zabývá těmi nedostatky, které považuje za závažné z pohledu předmětu ochrany a pokouší se o odstranění těchto nedostatků vlastními návrhy, případně zahraniční, konkrétně slovenskou legislativou, která z globálního pohledu upravuje zkoumanou problematiku v některých případech efektivněji a může tak sloužit jako inspirativní vzor pro Českou republiku. Analýza a návrh optimálního řešení stavu vybraných druhů dřevin v Komenského sadech ve Frýdku - Místku

The coexistence of people and trees in common environment is of great importance to society. As we take care of ourself and of our property, we should take care of trees as well, thanks to them we exist. Healthy, vital and safe trees are important for us, therefore we should look after them and increase this care permanently. In a first stage concentrates this work on the review of chosen woody plants in Komensky park in Frýdek-Místek. There were specified the basic dendrometric figures and physilogical age by individual trees and there were also evaluated signs and parameters, on whose basis were determinated a vitality of trees and analysed the state of health together with operating safety. In a second stage there were proposed the optimal interventions, incl., valuation, which contribute to improving of tree status. In conclusion of this work were designed the recovery of park including a financial evaluations.
