Juridical Consciousness of Roma Children

This bachelor´s thesis deals with the legal awareness of Romani children from Český Krumlov and České Budějovice. The theoretical part of the thesis deals more with the concept of child, from several perspectives, children's rights and also legal awareness. In several chapters, I focus on the Roma minority, its history, culture and the upbringing of the Roma child as such. Another important part of the theoretical part are Methods and Techniques of Social Work with the Roma Minority, Social and Legal Protection of Children and Projects Focused on Legal Awareness. The aim of the thesis was to find out the situation of legal awareness of Romani children in Český Krumlov and České Budějovice. The method used a quantitative research strategy using the technique of a partially standardized tool of G. Melton - a questionnaire to determine legal awareness. The questionnaire contains general questions, model situations and the rights and obligations of children and adults from the perspective of children. 93 respondents from Český Krumlov and České budějovice took part in the research. The results were processed in SPSS 16.0. programme. Research has found that legal awareness increases in children as they grow older. The results can serve as information material for the public, for organization working with the Roma minority, or social workers.
Child Soldiers: Recruitment and Abuse of Children in Armed Conflicts

The main aim of this Master's thesis is to analyse how children are recruited and abused as soldiers in armed conflicts, and how international humanitarian law protects their rights. The thesis is divided in two main parts, theoretical and empirical. In theoretical part are introduced the most important documents of international humanitarian law and international human rights law, including international governmental and non-governmental organizations which promote these rights. In empirical part, the author focuses on case studies, namely the case of the Lord's Resistance Army (LRA) and the case of the Islamic State of Iraq and Syria (ISIS). The author was not interested in finding similarities in these two cases, but conversely, to point out on the uniqueness of each case. To precise, the thesis is analysing reasons for the recruitment and abuse of children by the LRA and ISIS, and the legal responsibility of both groups. The author of this thesis chose as a methodology an instrumental case study which is useful for providing a general understanding of a phenomenon by using a particular case. Restorative juvenile justice in criminal law

Restorative Juvenile Justice This thesis is dealing with restorative juvenile justice. It aims to summarise and critically discuss this topic. It seeks to classify terms and theory used in order to help its readers with orientation throughout this issue as different terms and theories may often lead to unclarity and confusion. Subsequently it comes to a deeper analysis of selected parts. In particular, it examines international standards, describes thoughts of world-leading experts and eventually compares them and shows them on practical examples. Last but not least, it depicts selected theoretical foundations and draws connection between human life, inherent human nature, and use of restorative justice that is accepted as one of the main arguments for a higher effectivity in comparison to retributive justice. The thesis is divided into three parts. The first part deals with juvenile justice, children's rights and relevant international documents. The second part analyses restorative justice in general, compares different points of view and its types, and places it into a broader criminal justice framework. Mgr. Radka Dohnalová CHILDREN'S RIGHTS IN THE LIGHT OF LEGAL OBLIGATIONS IMPOSED ON THE CZECH REPUBLIC 2012 SUMMARY The main purpose of my thesis is to analyse the level of implementation of legal obligations imposed on the Czech Republic by international child law. For this purpose, the study maps out the ambit of the international child law relevant to the Czech Republic; it deals especially with binding documents, but it does not ignore non-binding legal instruments, as far as their influence on child rights is certain. The wide range of subject matter is examined with regard to particular analysis of the two most important treaties - the UN Convention on the Rights of the Child and the European Convention for the Protection of Human Rights and Fundamental Freedoms. Clarification of the obligations and an evaluation of their impact is mainly undertaken through an analysis of the outcomes of the control mechanisms. The introduction is followed by two chapters dealing with the theoretical background for the ensuing research. Chapter Two briefly examines the basic theoretical origins of children's rights, since this question is seldom discussed in Czech legal literature. Increasing The Legal Awareness Among Children In Bohemian Region

In this thesis I have concentrated on legal consciousness of children but not from their point of view, how it was in most cases of the elaboration of this topic, but from the point of view of people who actually work with children. This regards pedagogues, social workers, further school psychologists and psychologists. The theoretical part of the thesis deals with the right, legal consciousness, further then with the important conception ?child?, namely from the point of view of pedagogy, psychology as well as from the viewpoint of law. The thesis deals with morals itself and also its comparison with law, further with the value system and education, on important documents regarding the rights of children, educational program and its focus on the education of law in elementary and high schools. The important section of the theoretical part are also projects focused on increasing of the legal consciousness executed in the Czech republic as well as in the Southbohemian region. 144 respondents from the Southbohemian region took part in the research, either respondents who work in an elementary or high school, eventually in non-profit organizations which work with children. The difference of the opinions between pedagogues nad other workers was found out by the research. In contrast to other workers, the pedagogues think statistically more often that children have the legal consciousness. A very interesting moment is the age since which children should be acquinted with their rights. Other workers consider the beginning of the school attendance (or even the end of the preschool attendance) as the optimal age for familiarising the children with their rights in contrast to the pedagogues who would shift this limit almost to the second degrese of elementary schools. Next founded and documentary fact was the difference in methods used for familiarising children with their rights. The pedagogues combine discussions and lectures as well as model situations. Other workers prefer only lectures and discussions. They vary also in the evaluation of time dotation devoted to the rights of children during school education. Other workers are much more critical than the pedagogues in this regard. It was proved that the pedagogues more often do not know the organizations which deal with the rights of children whereas other workers do. The whole research is assumed into SWOT analysis which determined children´s interest in their rights and their familiarising with the right already since 1st class as the most strong sides. A weak spot showed to be the lack of time in school education devoted to children´s rights together with obtaining the biggest amount of information in the family. A chance is the realization of more new projects focused on concrete spheres of the rights and also the fact that the legal consciousness should be constantly increased. The risk is insufficient knowledge of rights in the sphere of the protection of personality when easy misuse and also insufficient knowledge of rights threaten. The insufficient knowledge could result in the increase of transgressions even criminality.
PHDR. BRETISLAV HOFBAUER´S LIFEWORK

This thesis analyses Bretislav Hofbauer´s writings. It begins with his biography which makes his works easily to be classified. Next to this, the thesis gives mapping and analysis of Hofbauer´s works he wrote or he helped to write. It refers authors who influenced Hofbauer´s philosophical thinking and his complex view of leisure time, education and pedagogy of leisure time. The other part puts obtained data together and divides them in three thematic parts which are possibly defined as main. Consecutively it formulate conclusions and states Hofbauer´s asset into leisure time´s theory. His complete articles and books are to be found in the supplement.
Czech family in the early 21st century - an attitude to the punishment of children

The topic of this bachelor?s thesis is A Czech family at the beginning of the 21st century ? the attitude to punishment of children. The theoretical part deals with the characteristics of a family and its functions. It also includes a historical outline which summarises the development of family since the Middle Ages till present day. The next chapter concerns upbringing and the styles and models thereof. The chapter that describes methods of upbringing is divided into two parts; it covers reward as well as punishment, both physical and psychological and the thin line which separates harmless punishment from abuse. Another essential part of this thesis focuses on crucial documents and the effort to legally protect children. The last chapter compares using physical and psychological punishment and their consequences. The aim of this thesis is to find out how the selected generations, within the framework of the family, view punishment as a component of traditional upbringing. This thesis uses qualitative research. The researched objects are represented by multi-generation families (parents and grandparents). To find out the necessary information, a structured semi-stanradised interview was used. Parents and grandparents from 3 different families from Třebíč were asked about their opinions on upbringing and their views on children punishment.The results of the research confirmed that present-day parents have not, to a large degree, deflected from the methods of their parents. Therefore, the most commonly used practice is inflicting punishment, including that of a physical nature. The respondents also disagree with the proposed change of law that would prohibit punishment as they appear to fear that it would eventually lead to excessive democracy and parents would lose control over their children. The work could serve for professionals who deal with the issue of punishment of children.
Family, family upbringing, family functions, malfunctions and its impact on child?s development.

The theoretical part of the present bachelor thesis deals with the characteristics of a family, its development, types and functions as well as with upbringing, system of rules and the impact of the upbringing on child?s development. Rights of the child, fundamental bills and the Convention on the Rights of the Child are also commented upon. In the methodological part of the thesis, individual methods and strategies of the empirical part of the work are described as well as the technique of selection of sample families and the criteria of categorizing of the families into individual groups. The empirical part of the thesis includes an analysis of the SPOD official documents. Individual instances of functional, problematic, dysfunctional and afunctional families are described. More specifically, the thesis comments upon the development of each such family, its type, system of rules and their type , fulfilment of basic functions, completeness of the family and its impact on the development and behaviour of the children. In the appendix, numbers of the SPOD curatorial files from the years 2003 ? 20011 in bar charts are attached for comparison as well as the number of the minors with upbringing issues from the years 2003 ? 2011 and a pie chart overview of the number of children and minors with upbringing issues. Also attached are four tables summarizing individual above mentioned families, their functions, types, system of rules they use and their impact on the child behaviour and development.
Children°s Rights in RVP and their aplication on teaching schedule.

The thesis focuses on the issue of children rights and their application in the educational process. The lesson plans and worksheets can be used as teaching aids, especially in the 6th grade of elementary school. The theoretical part is devoted to some basic information about the Framework Educational Programme and the history of children rights not only in the world but also within the Czech Republic. In addition, some important declarations and conventions on children rights and children obligations have been included. The practical part is based on methodological analysis of some particular lessons and also contains some examples of pupils{\crq} worksheets and a follow-up examination of the lessons that have been carried out.
