Deficiencies in the conduct of contracting entities from the perspective of case-law of the Office for the Protection of Competition

The purpose of this thesis is to identify the most common and the most severe deficiencies in the conduct of the contracting authorities in the case law of the Office for the Protection of Competition and based on the data about numbers of these deficiencies in the past years and by taking into consideration the proposed legislative changes forecast the future development in the numbers and severity of the deficiencies in the conduct of the contracting authorities. In case of an adverse forecast correct aim of future legislative changes will be suggested so that the principles of transparency, equal treatment and non-discrimination would be protected and more efficient use of public funds would be ensured. The thesis is composed of eight chapters, each of them dealing with different aspects of the deficiencies of the contracting authorities. Chapter One is introductory. Chapter Two describes how the case law of the Office for the Protection of Competition was researched and used in this thesis. Chapter Three briefly describes the history of the Office for the Protection of Competition as the body which supervises the adherence to the Act on Public Procurement and as such provides the main source of case law and information for this thesis. Public tenders in the Czech Republic - their potential and application

The topic of this submitted diploma thesis is an analysis of the commissioning and evaluation of the public procurement in the Czech Republic. I pay attention to the most frequent mistakes at spending public funds through the public procurement. The first chapter is devoted to the theoretical description of the Czech public procurement system. The next chapters include the overview of the evaluation system and evaluation criteria in the public procurement. The forth and the fifth chapters are focused on the general and individual mistakes during the commissioning and the application procedure.

Bid Preparation and Financial Assesment of Construction Order before Realization

This Master´s Thesis deals with the issue describing preparatory work for a construction contract submitted for a public tender. Its main objective is to demonstrate the negotiation procedure with sub-suppliers the purpose of which is to obtain more advantageous offer and the assignment of a contract. Last but not least, the thesis analyses appropriate steps leading to financial savings. The theoretical part is dedicated to the explanation of basic terms and definitions circumscribing public contracts, their contracting authorities, types of public contracts and the tendering procedure and its actions. The practical part then analyses and demonstrates on the specific example preparatory work of the contract for a public tender, its assessment and potential ways of financial savings.
Tendering Procedure in Process of Investment Construction

The issue solved in this thesis is the procedure for the award of public contract with extensive subject matter of the construction works. In accordance with assumed level of fulfillment, over limit public order is awarded in open procedure. Afterwards, the analysis of submitted bids from contenders was created in parallel with an assessment of the impacts, which have occurred during the implementation of the fulfilling of the public contract. The thesis is examined from the perspective of the Act No. 137/2006 Coll., on Public Procurement, as amended. Future recommendation is the establishment of new amendment to that Act, with the aim to increase the evaluation criterion of economic advantageousness of tenders.
Management of Building Order by the Submitter

The thesis deals with the topic of building orders are how they are managed by contracting authority or client. It presents building order as a project, and describes the way in which this project is organized, prepared and implemented. It also highlights all the factors that have impact on how building orders are managed. And since the most important of these factors is construction costs, the thesis provides an analysis of one particular building order from this perspective, listing all the things that are involved in the construction costs and pointing out in what way. The accuracy of the expected costs is then compared with construction engineering price indicators.
Economic Aspects of Public Orders Submitting

The issue solved in this thesis is the procedure for the award of public contract, which is explored from the perspective of the Act No. 137/3006 Coll., on Public Contracts, as Amended. With the help of latest Amendment No. 55/2012 Coll., number of changes was allocated into the tables. These changes fundamentally modify the view on the Act of Public Contract. Process of the award of public contract is then analyzed and evaluated by the tender dossier, from which the data about qualification requirements and evaluation criteria was drawn. Evaluation is performed using graphs and tables. The result of this thesis is to demonstrate a significant effect of the Amendment on the entire procedure and the decrease of assigned public works contracts with regard to public supply contracts and public service contracts. Future recommendation is to re-amend the Act on Public Contract and try to allow the re-growth of awarded public contracts, and to reclaim significant negative impact of the Amendment.
Public procurement in the programming period 2007 - 2013 under the Operational Programme Education for Competitiveness

This thesis deals with public procurement within Operational Programme Education for Competitiveness during the period 2007 2013. The introductory part of the thesis contains a brief description of Operational Programme Education for Competitiveness and its implementation into targets of regional politics. The following parts are dedicated to the public procurement in general and then in a specific envoronment of Operational Programme Education for Competitiveness. The fundamental part of the thesis illustrates process of supervision of the public contracts (ex-ante and ex-post), results of the checks and most frequent mistakes revealed during checks with a brief analysis of their causes and suggested steps to eliminate them in future. Next part of this thesis is aimed at ineligible expenditures caused by mistakes in public procurements. The final part contains a closer look at area of public procurement in the frame of current programming period 2014 and 2020.
Application of Combinatorial Auctions on Public Procurement

The public procurement draws a lot of attention in terms of treatment with public resources. Unfortunately this attention has mostly negative character. The aim of this Diploma Thesis is to bring an untraditional overview on the processing of public procurement and introduce one of the modern ways of using auction mechanisms. Combinatorial auctions can, as it already happened in other areas, open new possibilities for contracting authorities and bidders who participate in procurement conducted in accordance with Czech legislation. Also this Diploma Thesis can be the inspiration for thought if the current rules for public procurement are in accordance with the best interests of contracting authorities and bidders. In order to present the application of combinatorial auctions on public procurement the mathematical model based on partially real data was compiled in software Lingo. The results of such model were used as the source for the effectiveness analysis of discussed topic.
Audit system and contracting of public procurements

The aim of the thesis is to analyze the audit system of public procurements and to evaluate whether the audit system is sufficient. The first part focuses on contracting authority and regulations which must be complied with to act upon the public procurement law. The second part characterizes the segments of audit system which proceed in the connection with the public procurements contracting. The last part deals with the real state of execution of the public procurements audit in the state administration and its evaluation.
