Legality of extraterritorial processing of applications for international protection under international law

The presented diploma thesis called "Legality of extraterritorial processing of applications for international protection under international law" explores the phenomenon of offshore processing of applications for international protection, a practice that has a long history in Australia and that has recently inspired similar practices in Europe. The thesis aims to determine whether existing offshore systems are consistent with fundamental international human rights treaties, and to subsequently identify whether there can potentially be such a system in line with those treaties. In its first part, the thesis differentiates the term "applicant for international protection" from the term "refugee", while highlighting the specific legal status of an applicant, who is provisionally afforded certain rights until the application is resolved. The first part also enumerates the international treaties, which form the frame of reference used to determine legality in this thesis. The second part begins with description of Australia's system of removing people seeking protection in Australia to offshore detention centres in Papua New Guinea and Nauru. Asylstreit - Dispute over the Asylum and Refugee Policy in Germany

The bachelor's thesis deals with the dispute over the asylum and refugee policy in Germany between the CSU and CDU political parties from the beginning of the dispute in 2015 until the escalation in 2018. First, the thesis summarizes the development of asylum policies in the Federal Republic of Germany and the current attitude of the German government in this respect. Following chapters explore the beginning of the dispute during the refugee crisis and its next development in the years to come, including the escalation in 2018 and the resulting compromise between the German coalition government of the Union and the SPD that settled the dispute. The thesis also analyses the attitudes of the individual political subjects, the aftermath of the dispute and the further development of the asylum policy both in the Federal Republic of Germany and the European Union.

Procedure for Granting International Protection in the Form of Asylum in the Czech Republic Abstract The content of this work is mainly the course of the asylum procedure from the submission of application for international protection to possible appeals, but also the definition of fundamental concepts, the historical development of the asylum institution, international, EU and national sources related to this procedure. In the introduction of this work I introduced and explained the different concepts without which it would be difficult to understand the asylum issue. In addition to outlining the historical development in this area, I have also taken the liberty of mentioning several major migration waves. Another important part of this thesis are the individual legal sources of this issue. The key documents of international regulation are described. Within the framework of Community law, the thesis lists the essential directives and regulations with a view to the necessary Europeanisation and subsequent incorporation into our legal system. The present work focuses on Europeanisation and the related influence of the CJEU case law on the interpretation of legal norms in the individual Member States of the European Union. Diploma work is intent on problems migration, refugees and asylum proceedings. In the first part is explaining elementary conceptions, that are joint with migration and refugees. In the second part engage in a problem refugees in Czech Republic up year 1989 and positron refugees in Czech society. The third part a diploma work refers to, that in Czech and Czechoslovak history visit to situations, when the people on the contrary left from Czech country. The fourth part a diploma work engage in situation in Czech Republic as state, that became a constituent of European union. This part intends over this, how European union sloves questions as regards asylum and migrations politics. What standpoint European union takes and how the situation in asylum politics in European union changed and how develop now.
