Application of municipal and regional legislation in ligt of their right to self-government

57 Aplikace právních předpisů obcí a krajů ve světle práva na jejich samosprávu Abstrakt: Tématem práce jsou podzákonné právní předpisy vydávané územními samosprávnými celky a především otázka jejich aplikace. Obecné soudy jsou dle článku 95 Ústavy oprávněny samy posoudit soulad podzákonného předpisu se zákonem. Autor se v práci zabývá otázkou, jak mají postupovat správní orgány, pokud se dostanou do obdobné situace. Autor v práci shrnuje dosavadní diskusi k vázanosti správního orgánu podzákonnými právními předpisy a rozšiřuje ji o úvahy ve vztahu k podzákonným právním předpisům, které vydávají územní samosprávy. Dochází k závěru, že Čl. 95 odst. 1 Ústavy je třeba vykládat tak, že shledá-li správní orgán, že je k tomu oprávněn, smí při vydání rozhodnutí neaplikovat podzákonný právní předpis územně samosprávného celku. Je zohledněn mezinárodněprávní dopad, především dopad do práva Evropské unie. Autor položenou otázku poměřuje s judikaturou Nejvyššího správního soudu, dle které je správní orgán povinen při své činnosti posuzovat soulad vnitrostátního práva, které aplikuje, s právem Evropské unie. A dále rozvádí úvahy, jaké má tato judikatura dopady na řešené téma. Iura novit curia in international arbitration

Iura novit curia in international arbitration Abstract The thesis deals with the application of the iura novit curia principle in international arbitration. At the outset, it explains the function of the principle in the civil law tradition of court procedure and the potential issues arising out of its application in arbitration, in particular with regards to the limits of arbitral power and due process. Since the rules on conduct of arbitral proceedings provide no specific guidance in this respect, the ultimate limits of the use of the principle in arbitration are set by the national courts in proceedings on annulment and recognition of arbitral awards. The thesis attempts to delineate these limits on the case law of a few chosen countries and observe the potential similarities with their civil procedure. Despite the differences in the legal traditions in the respective countries, the analysis of the case law finds a number of common features in the approaches to the application of the iura novit curia principle in international arbitration across the chosen countries. When assessing the powers of the arbitrator to apply the law as he deems appropriate, the courts seem to share similar concerns about the observation of the parties right to be heard. - Handling the problem of deconstruction of the law in perspective of the interpretation of the law methodology The target of this thesis is firstly to describe the concept of the deconstruction of the law - the phenomenon of the last and probably also future decades. Secondly, the thesis describes the influence of the deconstruction of the law on the interpretation of the law. The thesis is dived into the three main parts and the conclusion. The concept of the deconstruction of the law and its causes are described in the first part. The deconstruction of the law is a process changing quality of legal order. As a consequence of that interpretational difficulties come in specific situations (or more precisely - it is not sufficient to infer a legal rule from regulatory legislation just by standard interpretative methods). This process has its several causes. Decomposition of religion and ethics (as the two significant social regulatory systems) and perception of the law as a technical instrument guiding the society, they both caused the extension of the law. If the law is now understood as the technical instrument guiding the society, then an acceleration of social development results in the acceleration of changes in legal rules. Incorrect application of the EU law by authorities of Czech Republic

The goal of this dissertation is to evaluate Alternative Dispute Resolution (ADR) methods and eventually the possibility of success when seeking redress for damage resulting from incorrect application of the EU law by the authorities of the Czech Republic. This goal will be achieved primarily by using analysis and comparison. With help of these two methods it is possible to find out how individual institutions of ADR (SOLVIT network and Czech Ombudsman) proceed in resolving specific cases where, due to the incorrect application of european law, there has been some damage.

Legal consciouness of kindergarten workers.

This Bachelor Thesis deals with the issue of scholl and labour law in the practice of kindergartens. It analyses the basic concepts of law which should form the basic of legal consciousness of every kindergarten worker as well as the fundamental legal regulations relating to the profession of kindergarten workers and the knowledge and application of these legal regulations in practise. The thesis focuses on legal consciousness of kindergarten headmasters and teachers and their copying with the laws that are constantly being amended.The thesis includes a proposal of an information system of kindergarten workers in the sphere of law. The work also contains a brief overview of the basic legal regulations concerning the activity of kindergartens and their employees.
