Functional parts valuation of the building

Diploma thesis deals with comparing of current awards by Classification of building structures and works and awards by Functional parts. It is possible to calculate Building life cycle costs by Functional parts. This is definately the advantage of the system because the calculation cannot be done by Classification of building structures and works. A new law on public procurement deals with Building life cycle costs as an evaluation criterion. So it is recommended to use Functional parts awards. The other goal of the thesis is to find bridges between Functional parts and the issue of BIM. BIM is a trend of global construction industry.

Title: Modes of Public Tender Author: Ing. Adéla Kohoutová Department: Department of Business Law Supervisor: JUDr. Tomáš Horáček, Ph.D. In my diploma thesis I focus on the topic of public procurement, especially the modes of procurement. This issue is very topical mainly due to the existence of the new Law on Public Procurement which is currently in the middle of the legislative process. In the very first I deal shortly with the history of regulation of public procurement. Further I think of the status of procurement law in the legal system and I also introduce the basic principles of public procurement including its application on small-scale public tenders. In chapter three I try to give brief overview of all modes which can be used in public procurement according to the current legislation. For each of them I concentrate on its specific characteristics and highlight the peculiarities that distinguish it from others. It is not my intention to submit precise instruction for the procedure under the Law on Public Procurement or exhaustively comment on the statutory provisions. Rozsypalová, L., New Public Procurement Act. Bachelor thesis. Brno: Mendel University, 2017. This bachelor thesis analyses new Act No. 134/2016 Coll., on Public Procurement. The thesis concentrate on evaluation of tenders, especially on the quality criteria and Life-Cycle Costing. The process of evaluation is shown on some practical examples. Whole thesis contains suggestions for contracting authority. At the end of thesis, there is a comparison between Czech and Slovak Public Procurement Act.

The area of public procurement funded by the European Structural and Investment Funds is interwoven with many material and formal sources of law that the contracting authority must follow. The ambiguous hierarchy of legally binding standards has adverse consequences for contracting authorities. The aim of this thesis is to give an explanation of the links between the legal regulations of these contracts, in which the problems associated with these uncertainties lie and, on this basis, submit proposals for possible solutions to the given issue. The theoretical part of the thesis explains the basic concepts such as the contracting authority or the concept of public support within the EU. In this section there are also mentioned the formal and material sources of law related to the examined topic and the interconnection of the national legislation is explained. The practical part is devoted to the impact of ambiguity in the legal regulations of procurement in the Czech Republic, ie possible sanctions, in case of any of the errors made by the contracting authority, when these facts are demonstrated on actual cases. At the end of the thesis there are outlined the potential starting points for avoiding the negative consequences of wrongly processed and subsequently implemented public procurement, which was supported by EU funds.

Title: Public remedies of defense in tender procedure focusing on review in administrative procedure Abstract: I have chosen the topic related to the public procurement law for my rigorous thesis. With regard to the fact that the issue is really extensive, I decided to focus just only on the specific area which is the control mechanisms of public procurements. Thus, the name of the thesis is derived from this issue and it is as follows: "Public remedies of defense in tender procedure focusing on review in administrative procedure". The main purpose of the thesis was a systematic analysis of public remedies of defense of suppliers against illegal procedure of contracting authorities in respect of the relevant practice of the Office for the Protection of competition and administrative courts and then the review of their effectiveness. Public procurement in the fields of defence and security after adoption of the Act on awarding public procurement and comparison with the previous legislation Abstract This thesis is focused on the analysis of the legal regulation related to public procurement in the fields of defence and security. Major part of this thesis is devoted to specific rules for the public procurement of defence and security contracts. However, a significant amount of space is also devoted to selected provisions, which are not listed in Book Ninth of the Act no. 134/2016 Coll. on Public Procurement, and yet they are significantly related to the issue of defence and security. For a comprehensive and sufficiently detailed analysis of the relevant legal area this work draws not only from the personal experience of the author of this thesis with the topic, but also from doctrinal literature, but also from case law of the Office for the Protection of Competition, the Regional Court in Brno, the Supreme Administrative Court and also from selected decisions of European case law. Selected institutions of public procurement in the light of new legislation

This thesis 'Selected institutions of public procurement in the light of new legislation' describes the new legislation in the Czech Republic regulating the public procurement process, introduced by the new Public Procurement Act (Act No. 134/2016 Coll., on the Public Procurement Process, as amended - the "PPA") and its implementing regulation, and compares it to the previous legislation under Act No. 137/2006 Coll., on Public Procurement, as amended. The PPA came into force as of October 1, 2016 and has thus been in effect for a period of less than one year. As such, the PPA is considered a relatively new regulation which is still being explored, and which above all requires new case law to provide much- needed interpretation of some provisions which remain unclear or ambiguous. The PPA regulates the procurement process and establishes the rights and obligations of contracting authorities in the Czech Republic and of bidders and contractors, in accordance with the new EU directives. Process view on Law of Public Procurement

This study contains groups of tasks for public procurement contracts in reference model Management Business Informatics (MBI). The tasks are sorted in chronological order in regard of procedure of public procurement contracts. The tasks contain new law on public procurement contracts, elaborated in the procedural point of view, and are complemented with a best practice. Process view in the reference model is intended for public procurers. It enables for the public procurer that he can have better control during public procurement. A separate chapter is devoted to specificities of public procurement contracts to the fulfilment of ICT. The study contains recommendations for the preparation of tender documentation of ICT procurement.
