Tato diplomová práce analyzuje právní základy a užití občanského zákoníku, majetkových zákonů, občanského soudního řádu a exekuční řádu v obchodu s nemovitostmi. Skrze případové studie se snaží poukázat na kritická místa a proveditelnost jednotlivých investic do exekucí zasažených či jinak právně znehodnocených nemovitostí. Závěrečná část hledá standardizované postupy, které nachází optimální mix rizika a profitability.
The restriction of real property for the protection of nature and landscape

The aim of the diploma thesis is the analysis of legal instruments regarding the restriction of the ownership of real property arising out of the protection of nature and landscape. This diploma thesis is divided into 7 chapters including the introduction and the conclusion. The second chapter deals with the constitutional origin of the respective legal institutes. The third chapter deals with the conflict of the fundamental rights. The fourth chapter provides for the fundamental institutes, their basic components, and their legal basis in private and public law. The fifth chapter is concerned with the particular restrictions of the ownership of real property as stipulated by relevant legal regulations. This chapter is divided into the analysis of the act no. 114/1992 Coll. in general and the analysis of the general and special protection of nature and Natura 2000 and provides examples of the respective legal institutes. The sixth chapter defines the restriction of the ownership rights arising out of other acts. The conclusion is concerned with the comparison of the aforementioned legal institutes and the evaluation of the particular features thereof. The conclusion also provides proposals for prospective changes in the relevant legislation.
Ownership of real estate

Even though we may not realize it, immovables are all around us. Because immovables are usually considered very valuable, ownership of real estate is examined more comprehensively in comparison to other things. Therefore, the laws of different states pay detailed attention to ownership rights and real estate. The same applies to the Czech Civil Code which came into effect as of 1 January 2014. This thesis is focused on a general explanation of ownership rights and immovables. Furthermore, it focuses on the theoretical analysis of the most important changes and developments that relate to real estate ownership rights brought about by the new Civil Code as well as on the consideration of the practical impact of these changes on legal relationships. Within the framework of these particular topics, the thesis refers to court decisions issued prior to the new Civil Code becoming effective, which are, in the author's view, also applicable to legal relationships established under the new civil rules. The basic principles of the operation of the Real Estate Register are also the subject of this thesis because the registration of the ownership rights of the majority of immovables in such a public register is necessary.
Ownership acquisition of immovable thing

This thesis is concerned with the theme of characteristic of immovable thing and ownership acquisition of them. The main aim of this thesis is to analyze and appraise legislation of immovable thing and ownership acquisition of them in Czech legal order. One of the main aims is to provide a comparison of our legislation and legislation of Federal Republic of Germany. This thesis is composed of four chapters, which are divided into relevant sections and subsections for better lucidity. Chapter One contains characteristic and historical development of the concept of immovable thing including comparison of this concept with the German legislation. Chapter Two comprises chronologic historical development of acquisition of property law within the civil codes from common code of civil. The core of this thesis is chapter three, which deals with acquisition of property law in present legislation. This chapter gradually analyses individual way of acquisition of property law to immovable thing. Chapter four compares our legislation of acquisition of property law to immovable thing with the German legislation, the accent puts on description of identical and different characteristic of both legislations.

Real property taxes after recodification of private law

The aim of my thesis is to introduce the legislation related to real estate tax in the Czech Republic, to offer its critical evaluation and suggestions for its modification in the future. The work is divided into two parts, a theoretical part, which includes four chapters and a practical part, consisting of six chapters. The general part is devoted to the process of recodification of private law in the Czech Republic. It describes recodification in a broader context, it identifies legal institutes connected to real property tax and summarizes selected changes in terminology. In the next chapter is summarizes general theoretical introduction of taxes, with an emphasis on property taxes and briefly described elements of the tax structure. Fifth chapter and the next ones deals specifically with the real estate tax. First, the tax is described in general terms, then the amended changes are summarized and the scheme of the Act is introduced. The sixth chapter provides a complete analysis of the land tax, seventh chapter the tax of buildings and units. In both chapters the thesis consistently addresses all elements of aforesaid taxes. The Bachelor thesis "Women of town České Budějovice in the light of testaments" proceses the last wills and the give up the possesion from 14931550, which are deposited in SOkA České Budějovice. Another used source is the town lawcode from Brikcí of Licko, which is editorially processed. The attention is devoted to inheritance and property law of townwomen in default standard. From testaments is made a picture of women in role of women-testators, heiress and trusteers. The thesis includes the ortographic analysis of sources and results of diplomatic analysis of testaments are compared with testaments from another towns. The thesis include selection of edited testaments.
