House arrest as an instrument of penal policy

This thesis, dealing with "House arrest as an instrument of penal policy", reflects problems of ineffective system, increasing the number of prison sentences imposed, exceeding prison capacities and consequential violation of fundamental human rights. In response to improperly configured system of penal policy, in 2010 a new Act no. 40/2009 Coll., The Penal Code was implemented, introducing new institute of house arrest to the Czech justice system. Philosophy of house arrest is in punishing the perpetrator, while maintaining positive relationships that would be otherwise disrupted by his imprisonment. Presented thesis evaluates the implementation of the punishment, reflects benefits, disadvantages and actual barriers in its successful implementation, using expert interviews.
Influence of Probation and Mediation Service in the Czech Republic to social rehabilitation of sentenced people of the South Bohemia.

The goal of my thesis called ´The influence of Probation and Mediation Service in the Czech Republic on the resocialization of convicted persons in the region of South Bohemia´ is a mapping of the work of Probation and Mediation Service in the CZ with perpetrators of crimes. In my thesis I was trying to map out fundamental concepts important for a clarification of Probation and Mediation Service´s activities, I was trying to explain the term and activities of the Probation and Mediation Service and its basic principles. I focused on the history of Probation and Mediation Service´s origin in the Czech Republic, further on I mentioned the goals of this service as well as the basic activities which are implemented by the Probation and Mediation Service CZ while working with their clients, i.e. perpetrators of crimes. In my bachelor thesis you will find a concise mapping of provided probation programs in the Southern judicial region. In the thesis there are specific examples of probation programmes for underaged as well as for adult perpetrators of crimes which were implemented in the past, or of those that are active in the Southern judicial region just currently, elaborated on. I implemented the qualitative research of my thesis on a research sample of eight probation workers from Southern judicial region. I carried out the research with communication partners in the center of Probation and Mediation Service in the CZ in Pelhřimov, Tábor, Český Krumlov and České Budějovice, using the method of interviewing and semi-structured interviewing. The main goal of my thesis is the finding of methods through which the Probation and Mediation Service in the CZ is trying to affect convicted people. Results have proven that probational workers believe that one of the useful methods used while working with convicted people is going through a probation programme, a quality proffessional interview, but also individual work within the imposed probation surveillance. Results have further proven that probation clerks are informed enough within probation programmes. Probation programmes are meant mostly for underaged perpetrators, there are also programmes meant for adult perpetators, but in a lower amount. The thesis should bring a clearer view of the problem of Probation and Mediation Services in the CZ, of the activities of the Probation and Mediation Services in the CZ working with criminal perpetrators, a view into probation programmes that crime perpetrators may go through within their resocialization.

Educational and Psychological Profiling of the Juvenile Delinquent

The thesis presents the educational and psychological profiling of the juvenile delinquent. The theoretical part focuses on the definition of the juvenile delinquency, its specifics and developmental trends in this field. Next, it deals with the description of the juvenile's profiling from the perspective of the developmental psychology and then with the explanation where juvenile delinquency stems from. The empirical part deals with the results of the qualitative research collected in the center of the Probation and Mediation Service of the Czech Republic. The research is realized by the combination of three methods - the content analysis of documents, the semi structured interview and Tarter questionnaire in order to get anamnestic data about chosen clients of the Probation and Mediation Service of the Czech Republic and to find out the most hazardous areas of their lifes.
Actual Problems of Saving and Imprisonment of House Arrest in České Budějovice

This Bachelor?s Thesis on Actual Problems of Saving and Imprisonment of House Arrest in České Budějovice deals with the issues of home confinement. This institute has been active since 1.1.2010. The condition of its imposition is a letter of assurance from the convict that he will stay within the residence of a given address during the determined period. Thanks to this type of sentence the family, economic and other relations of the convict will remain intact as this sentence shouldn?t restrict the convict in his occupation or profession. Last but not least the government could also conserve service costs. The goal of this thesis was to research the issues of home confinement. Another part was discovering the problems associated with the imposition and carrying out of home confinement in České Budějovice and finding out how to solve these problems. To fulfill the goal of this thesis the two following questions had to be determined. The first question is aimed towards the problems accompanying the imposition and carrying out of home confinement in České Budějovice. Then it continues in finding solutions to the ascertained problems according to experts involved in this domain. The research was done in the form of a qualitative survey. The data was collected by a method of inquiry, the technique of structured conversation. The inquiry was done with ten respondents who where in some way involved with the issues of home confinement in České Budějovice. When concerning the questions of the survey the biggest problem which the respondents encountered looked to be the form of surveillance. Most of the respondents don?t believe that random inspections done by the probation officer are sufficient enough and are afraid of the obstruction of the sentence. Another problem is the housing of the convicts. Before the imposition of home confinement the conditions that may affect the imposition must be ascertained by the probation officer. Housing has been experienced to be very problematic by the respondents. The most common cases are when the owner of the residence does not agree with the sentence to be carried out. Another problem deals with the form of surveillance. It is just a mere legal adjustment. Even though it is listed in the penal code that the inspections are carried out by the Probation and Mediation Service with the help of the electronic surveillance system operator, electronic surveillance hasn?t yet been put into commission. The thesis then deals with methods of how to effectively solve or reduce these problems. For understandable reasons the motivation of the convict and his will to carry out the sentence is necessary. It?s able to respond to this problem with the legal adjustment by changing the law by introducing clear and accessible resources. In the case of the methods of surveillance it would be beneficial to establish an electronic surveillance system. This solution is backed by the respondents within the research survey and also by experts involved with home confinement in specialized literature. There is also an option of imposition of home confinement in certain cases instead of prison. Experience from abroad shows that custody in the form of home confinement isn?t a bad option. Considering the fact that custody is stricter than prison, home confinement could help secure the period before the legal decision. I assume that this thesis will help describe the institute of home confinement and will introduce readers with the positive as well as the negative sides of this institute and will provide solutions how to effectively solve these problems. Another assumption is that it will serve as research material for the expansion of the general knowledge and awareness about home confinement as well as feedback for people that are interested.

Mediation and Probation service in the Czech Republic - The Enforcement of Community service

The topic of the thesis is one of the most used alternative punishments in the Czech Republic, the community service punishment. The aim of the thesis was to evaluate the development of sentencing of this kind since its implementation to legal order of the Czech Republic, with the focus on the structure of an offender, who is imposed the sentence on, and the effectiveness of this punishment execution. Further the aim is to find out the evaluation of prepared legislative changes regarding this punishment by the workers of Probation and Mediation Service in the Czech Republic. Theoretical part outlines main thoughts of restorative justice, from which alternative punishment sentencing results. It describes the kinds of alternative punishments used in the Czech Republic; it focuses on the definition of community service punishment and its current legal regulations. It also introduces Probation and Mediation Service in the Czech Republic, first of all its activity within the execution of community service punishment and its realization. Finally, the theoretical part presents forthcoming legislative changes concerning the community service punishment. The practical part is divided into two parts. In the first part the development of sentencing and execution of community service punishment is evaluated by means of the analysis of secondary data. In the second part the workers of Probation and Mediation Service in the Czech Republic were interviewed on the basis of structured dialogues and their evaluation of prepared legislative changes in the sphere of community service punishment was found out. The thesis may serve as a general survey of these problems.
Supervision as an Alternative Form of Punishment

The main goal of my work is to describe supervision as one of the alternative form of punishment. In the first part is described development of supervision in the world and Czech Republic and for comparison how supervision works in other countries of Europe. Other part is dedicated to work of Probation and Mediation service in Czech Republic. Main part of work is about description of the most important institutes with supervision, mainly to work of probation officer with clients. This part is supplemented by graphs and casuistries. Last part contains description of differences in supervision of children and juveniles.
Resocialization of offenders of drug related crime

The bachelor{\crq}s treatise ``Resocialization of offenders of drug related crime{\crqq} deals with the issue of the criminal activity associated with drugs and possibilities of integration of the offenders of these criminal acts back into the society, first of all in co-operation with the Probation and Mediation Service of the CR. The drug related crime and the drug dependence are among the most important socially pathological phenomena and they shall be seen in the social context. The importance of the resocialization consists in the social integration of those persons which is conditioned by acquiring or renewal of social skills and accepting shared social standards. The so-called drug related crime may be understood in the narrow as well as broader sense. The first case involves criminal activities of the not permitted production and holding the narcotics and psychotropic substances and toxins pursuant § 187, § 187 a, § 188 of the Criminal Law and the criminal act of spreading addiction pursuant § 188a of the Criminal Law. In the second case the concern is all the criminal activity in the scope of which the drugs play a certain part (criminal acts on property, violent offences). Besides the criminal acts suppression, in these cases alternative measures and alternative punishments shall play a very important part as they can represent a very suitable step to the mentioned resocialization. The Probation and Mediation Service has been working on the territory of the Czech Republic since 1st January 2001. The theoretical part of the thesis deals at the beginning with the social context of drugs, development and contemporary state of the criminal and anti-drug policy in the Czech society, moreover it informs of the alternatives of imposing the punishment of imprisonment including the therapy. The conclusion of the theoretical part includes summary of the activity of the Probation and Mediation Service of the CR including the presentation of alternatives other than the direct imprisonment. The research part of the thesis involves the qualitative study of positives and problems associated with the execution of punishment by work beneficial to society of drug related crime offenders. Moreover it involves the analysis of the annual reports and materials of the Probation and Mediation Service of CR. The author would like to contribute to the understanding of the activity of the Probation and Mediation Service of CR and to outline the possible treatment of the situation of drug related crime offenders.
