Intelligent Log Book

The topic of this thesis is the proposal and creation of the Intelligent Log Book application, which is used for user-friendly view of the company vehicle's rides history. Data can be analyzed to check exceeding of the speed limit or unreasonable standing with running engine. Vehicles and their tracks are plotted into Google Maps. Application is deployed in a specific company. Its employees provided cooperation during development. Project is implemented as a web-based application due to request for usage on different machines (PC, mobile phone) and different platforms.
Camera system in the workplace and its encroachment on personal rights of employees

The topic of this thesis is the legal regulation of camera system in the workplace and characterization of its encroachment on personal rights of employees. The main emphasis is put on conditions, which employer must fulfil to install a camera system in the workplace in compliance with the legal order of Czech Republic. Furthermore this thesis is devoted to issues of discreet surveillance and of defence of employee options in case of illegal monitoring. This thesis is divided into three following chapters. In the first chapter, technological development of video camera and its components as well its gradual using as surveillance equipment in public space and afterwards in private life of persons are described. This chapter deals with today's situation and number of video cameras in society, not only in Czech Republic but also in the whole world. Increasing amount of video cameras represents as its consequence a reason for legal disputes, especially neighborhood's legal disputes. Considering that mentioned fact, the relevant decisions of the Supreme Court illustrating attitude of judicature to camera surveillance are incorporated in the first chapter. Personal Data Protection in Labour Law Relationships The thesis deals with personal data protection in relation to employees as a subject of data and an employer as a person processing such data. At the beginning, general issues of personal data protection are analysed, including a short overview of data protection regulations within both an international and domestic context. The introductory part also includes an explanation of terminology and a description of individual rights and obligations in the field of data protection. In the following part the author concentrates on the regulation of disposal of particular types of personal data that are processed in relation to creation, duration or termination of labour law relationships, and also on the relationship between the Act No. 101/2000 Coll., on Personal Data Protection, and the Labour Code, as well as other related legislation. Attention is devoted to the extent of personal data that the employer may request from candidates for a vacancy, as well as to the necessity of the employee's consent to the processing of their personal data by the employer. 1 Monitoring of employees in context of General Data Protection Regulation Abstract This diploma thesis focuses on the supervision and monitoring of employees from multiple perspectives. Based on the relevant European and national caselaw the thesis specifies whether employees shall have right to the protection of their privacy and integrity at the workplace. Thesis also analyses selected aspects of personal data protection with emphasis on personal data of employees as data subjects processed by employers as controllers. In particular attention is devoted to selected obligations, which arises from General Data Protection Regulation for such personal data processing in the light of relevant statements and guidelines provided by the European Data Protection Board, Article 29 Data Protection Working Party and the Office for Personal Data Protection. Thesis in detail addresses the supervision of employees carried out by § 316 of the Labour code, whereas interprets its provisions as well as conditions for establishing the supervision of employees arising from such interpretation. Monitoring of employees Abstract The theme of this diploma thesis is, as the title suggests, the monitoring of employees. With the continuous development and progress of technologies and their increasing availability, the privacy of citizens is becoming increasingly more endangered. Even more concerning is the privacy of employees in the workplace, where an employer has inexhaustible possibilities to monitor activity at work - and sometimes outside of the workplace as well. On the other hand, the intention of the employer to protect its assets and the financial means invested in the operation of its business is appreciable and in some ways necessary to align with the employer's obligations to their shareholders. Therefore, the chosen subject brings to the surface the conflict of two equal rights, as the right to protection of privacy collides with the right of protection of property. For this reason, the whole thesis takes into account both the labour law regulations and the regulations on the protection of personal data - since personal data of employees can be threatened by monitoring. With regard to the fact, that Regulation (EU) 2016/679 comes into effect soon, it is briefly mentioned in the relevant parts, especially when assessing whether it will impact the legal interpretation in the future or not....
Monitoring of Employees and its Methods

This thesis intends to offer a balanced legal standpoint on monitoring of employees from the point of view of employer's rights and interests protected by law as well as from the point of view of employees' right to privacy. The surveillance of employees is governed especially by Section 316 (1) through (3) of the Labour Code1 . However, in case personal data of employees are processed within such monitoring, the personal data protection regulation must be applied as well. This thesis distinguishes between a so-called one-time or random inspection of employees performed within the meaning of Section 316 (1) of the Labour Code for the purpose of checking their observance of ban on using the employer's production and working tools for personal purposes and between continuous monitoring performed under Section 316 (2) of the Labour Code. At the same time, it is necessary to assess whether the employees' personal data are processed as well. Therefore, in practice, four different types of inspections/surveillance of employees have to be distinguished, each of them being governed by slightly different regulation. Personal Data Protection and Labour Law Relationships

This thesis deals with the protection of personal data in relation to the labour law relationships. Considering the extensiveness of the topic of personal data protection, the aim of this thesis is not giving an all-encompassing explanation, however, to introduce the general legal regulations together with the explanation of the principal legal concepts and their subsequent application on the labour law relationships. The author divides this thesis into 6 chapters. Apart from the relevant legal regulations the author focuses on the main case law and opinions issued by WP 29 and UOOU (the Office for Personal Data Protection) as well, which interpret some legal uncertainties. By reason that the personal data protection is integrally connected to the inviolability of the person and privacy itself, the first chapter focuses on the concept of privacy and its interpretation. The second chapter discusses the privacy and data protection legal regulation. The submitted thesis deals with personal data protection in the context of labour-law relationships. This is an actual and discussed issue in current society, which has constitutional aspects as well. Due to the extensiveness of the topic, the aim of this thesis is not giving a comprehensive explanation of the personal data protection in labour-law relationships area. My effort is to perform the reader with this issue from the general introduction including a survey of the legislation and explanation of main concepts to outlining the fundamental principles of the legislation and focusing more thoroughly on the several selected questions. The thesis itself is divided into four chapters. In my thesis I am trying to point out to the most important court decisions and also the opinions of The Office for Personal Data Protection and The Article 29 Working Party.
