International and European aspects of protection of industrial property

Resumé The field of legal protection of industrial property has gone through a turbulent period since the end of the 19th century, as it has had to react, not only to the fast development of international trade but also to the increasing importance of research and technological progress. This requested creation of international systems of protection for individual subjects of industrial property, as well as the conclusion of many multilateral international treaties, which aim to ensure minimal standards of protection and unify fundamental principles and substantive and procedural rules, has significantly helped to simplify the position of applicants seeking protection in more countries, as well as those responsible for overseeing these rights. This thesis aims to provide a complex view of the field of industrial property rights and their protection, which will also be reflected in the individual breakdown of the chapters. After the introductory explanation of the industrial property concept and the clarification of the importance of its legal regulation, an analysis of the historical context and development leading to the gradual internationalization of the field, follows. Legal regulation of horse breeding

This diploma thesis focuses on the legal regulation of horse breeding. It analyses and describes the applicable legislation in the Czech Republic, evaluates its shortcomings and suggests possible improvements. At the same time, the thesis connects the description of the legal regulation with best practise examples. The legislation of horse breeding is mostly represented within public law, but it can be found also in private law, making the orientation on this topic much more difficult. The knowledge of legislation and their provision to the widest possible range of people plays the key assumption for the better following of regulations. Despite the annual increase of horses in the Czech Republic, less attention is paid to this area. The diploma thesis consists of nine chapters, which are divided for simplicity into subchapters. The first chapter creates an introduction. It refers to the development and changes in the use of horses in the Czech Republic and it sets goals of the thesis. In the chapter two, the legal status of horse is defined in both, private and public law. The third chapter consists of legislation of horse breeding, taking evidence and labelling of horses. Protection of Industrial Property and International Law Václav Vymětal Abstract The submitted thesis "Protection of Industrial Property and International Law" and deals with the international aspects of the industrial property rights protection. The thesis begins with defining the industrial rights as a term and its relation to the broader area of intellectual property rights. The main international classifications of industrial property rights are introduced along with the basic principles of their international protection. The thesis subsequently approaches the historical introduction to the examined issues beginning in antiquity and progressing until the great industrial revolution of the nineteenth century which has led to the adoption of The Paris Convention for the Protection of Industrial Property. The general provisions of The Paris Convention and The Agreement on Trade-Related Aspects of Intellectual Property Rights are dealt with in a separate chapter, including the historical basis of both treaties, their main principles and contribution to the international protection of intellectual property generally, and industrial property specifically. An Analysis of the Legal Protection of the Disappearing Island States Population Rising ocean levels, which occur as a result of global warming, currently pose a threat to low-lying island states. The so-called "disappearing island states". This thesis deals with the legal protection of the disappearing island states population. The main objective is to provide a basic overview of protective instruments for this scenario, and assess their potential application. This text is divided into three parts. The first chapter deals with the concept of disappearing island nations, the reasons behind their disappearance and some of the consequences. Of particular importance is the subchapter, discussing the dissolution of the state in general. Even though in theory a state's dissolution due to climate change effects is viable, in practice this event has never occurred before. Therefore, international law does not offer a clear answer to the legal personality of the state that has been affected by climate change-induced sea level rise. This question needs to be answered in order to define the status of the population, and to define the tools that can be used to ensure its protection. Protection of rights of indigenous Australians in particular in relation to media and intellectual property rights

The diploma thesis concentrates on legal protection of indigenous peoples in Australia. The topic itself is too wide, therefore it was shortened to predominantly concentrate on analysis of two up-to-date topics. These were, firstly, legal protection of indigenous peoples in relation to media and then, secondly, legal protection of indigenous peoples in relation to intellectual property rights. The paper is divided into three main chapters. The first chapter's goal is to introduce some parts of Australian history that are connected with Aboriginals to Czech readers. The topics discussed are, for example, colonization of Australia, genocide as perceived by international community, policy of assimilation, era of Stolen Generations etc. This chapter highlights a necessity of always dealing with current issues in proper historical context and, as it is found in the second chapter, also with deeper understanding of differences of indigenous culture. The second chapter is an outcome of the author's study stay at University of Queensland where she conducted a research on two topics connected with legal protection of indigenous peoples that were being currently discussed. Resumé - Protection of Selected Industrial Property Rights and International Law Within the last approx. two hundred years, industrial production has made a huge progress and at the same time international trade has grown very significantly. The need of industrial property protection of a good quality at the international level led to conclusion of many multilateral international treaties mainly at the WIPO and also to the creation of international systems which ensure the needed level of industrial property protection and also facilitate international cooperation as well as the process of applying and administration of rights in several countries. At its very beginning, the thesis describes the industrial property in general and it deals with its definition, conception and specificity since it is essential for better understanding of the following chapters. In the next step, the thesis presents the cornerstones and the most important treaties of the industrial property field from the international perspective. These are the Paris Convention and the TRIPS Agreement - two treaties that even today keep their high significance. This thesis deals with the legislation related to the protection of animals against cruelty. The focus is mainly given to the present legislation, though the historical development is mentioned as well. The international and european legislation is resumed in the thesis as the european legislation has signifiant impact on the czech one. However the utmost focus is given to the czech legislation. The fundamental legal regulation in the domain of protection animals against cruelty is Act No. 246/1992. The main aim of this thesis is to provide comprehensive review of legislation, which concerns with the given domain of law and its projection into the practice.

in English - Environmental migrants The purpose of my thesis is to analyse both the status quo as well as the possible evolution of the policy framework of the environmental migration. The thesis is composed of five chapters, each of them dealing with different aspects of environmental migration. Chapter one is introductory and describes an overview of the historical content of environmental migration. Environmental migration is not a new phenomenon. Natural and human-made environmental disasters have caused migration of people in the past and continue to do so. This chapter addresses the linkage between environment and migration, which led to the elaboration of a typology of environmental migration. Chapter two characterises the most frequently used definitions of environmental migrants. Environmental migration has been the subject of lively debate in recent years but there is still no internationally agreed definition of environmental migrant. Chapter three examines relevant current legislation concerned to environmental migration. It discusses refugee law, statelessness, humanitarian law and human rights law. (English) The purpose of my thesis is to analyse possibilities provided by current legislation to protect individuals against negative effects caused by exessive noise and vibration. The reason for my research is that at the beginning of the new century noise and vibration became one of the most dangerous sources able to threaten or even demage men's health and environment. The thesis is composed of six chapters, each of them dealing with different aspects of noise and vibration. There is always a short summary at the end of each chapter. Chapter One is introductory and defines basic terminology used in the thesis: sound, noise and vibration. The chapter is subdivided into five parts. Part One explains the physical and legal meaning of noise and vibration. Part Two describes the main sources of exessive noise and vibration. Part Three analysis negative effects on human health. Legal regulation of animal testing The diploma thesis is analyzing current legislation in the field of animal experiments. It is formed by five chapters and each chapter is concerned with different aspects of animal protection, when focusing on experimental animals in particular. The first chapter is divided into three subchapters and it is successively describing development of animal experiments, progress of legislation dealing with animal protection and experimental animal protection on the international and European level, when analyzed is also Czech legislation in the last subchapter. Second chapter is focused on the basic legal sources and its legal foundation. It has four subchapters, when every subchapter explains relevant terms, which are being formulated in the experimental animal protection law. This chapter of the diploma thesis also involves sections dedicated to experiments and alternative methods of the experiments.
