Terrorism from the perspective of public policy

Area of interest regarding this master thesis is the fight against terrorism at European Union level. The work then aims to analyze how effective the EU institutions in the fight against terrorism, Europol, Eurojust and the CTC, are. The first part focuses on the issue of terrorism itself, by the help of comparative analysis and data analysis the possible root causes of terrorism and issues regarding radicalization are discussed. The second part is devoted to the actual effectiveness of the main EU institutions in the fight against terrorism and consequently to the security threat associated with the issue of foreign fighters that became a priority agenda within the EU counterterrorism. These sections has also been prepared on the basis of empirical research since semi-standardized interviews with experts in this field were conducted. It was investigated, that the EU institutions in the fight against terrorism have several weaknesses, and there are several limits in their fight against terrorism. Conversely, in the context of foreign fighters the EU has managed to adopt several concrete and directed measures.

Judicial and Police Cooperation in the European Union

The criminal justice as well as the persons participating in criminal proceedings, they both are currently facing number of newly posed challenges and unanswered questions so far, due to the onward going integration of the European Union and much closer cooperation of the Member States, in the field of the Procedural Criminal Law. There have been established many new institutions within the field of the European Union in last few years and there were adopted many legal tools which directly influence the cooperation between the judicial and police authorities of individual countries. In connection with newly emerging forms of the crime and more coherent cooperation of the perpetrators of severe crime, the relevant authorities at the union level as well as at the national level encounter situations not being resolved at all, or which are specified by theoretical standards only and have not been put into practice yet. Legal Regulation of Extradition

The aim of this bachelor thesis is beside legal definition of extradition also to answer a question, whether the replacement of classic extradition within the European Union by European Arrest Warrant was successful and what its tendency is since the implementation. The thesis also deals with a change of the role of Eurojust which was brought by the Lisbon Treaty. In the theoretical part the thesis focuses on historical development of extradition within the international judicial cooperation, explanation of basic terms and legal regulation of extradition. Development of extradition within the European Union is also described there and so is the comparison of extradition to European Arrest Warrant. The practical part is then dedicated to analysis of particular court decisions as an example how extradition and European Arrest Warrant work in practice.

Již před přijetím Lisabonské smlouvy vnitrostátní parlamenty aktivně monitorovaly a připomínkovaly návrhy unijní legislativy a s přijetím Lisabonské smlouvy se tato úloha ještě posiluje. Práce přináší přehled aktuálních změn, které vnitrostátním parlamentům Lisabonská smlouva přináší, a věnuje se také meziparlamentní spolupráci, která je základním předpokladem realizace některých nově zavedených kontrolních mechanismů.

Studie se věnuje v první části obecným souvislostem boje proti obchodování s lidmi, včetně vnitrostátního i mezinárodního rozměru. Těžištěm práce je pak přehled a analýza legislativních opatření EU, zahrnujíc v to primární i sekundární prameny práva EU. Závěrem je nastíněn vývoj této oblasti z hlediska de lege ferenda. Processing of personal data in the EU within police and judicial cooperation

The thesis deals with the approach level, meaning, purpose and benefit of personal data protection in their processing within police and judicial cooperation in the EU. In the introduction the fundamental issues of personal data protection in the context of the EU and the Czech republic are defined, focusing on terminology and explanations of current issues, particularly the area of biometric data and data retention. Extra attention is also given to the conflict of the right to privacy, and the related right to personal data protection and protection of public interests and safety. After that the thesis deals with a performing of police and judicial cooperation in the EU through specific subjects, in particular Europol and Eurojust. The final part of the thesis focuses on the practical implementation of personal data protection in police and judicial cooperation in the EU, and secondly the importance of personal data protection in police and judicial cooperation, as a deduced basic human right, and the difficulties with which the personal data protection in police and judicial cooperation in the EU are joined. The final part of this thesis consider the main sections in which we can find area for adjustment towards more effective police and judicial cooperation in the EU, with full respect for the right to personal data protection.
