Personal bankruptcy of a consumer

The bachelor thesis deals with debt relief for non-business individuals. The indebtedness of Czech households is high and growing. If a debtor does not have the means to repay his or her outstanding liabilities, he or she can easily fall into a debt trap. For many of them, the only way out is debt relief, which is one of the options for resolving bankruptcy. For debtors, insolvency represents the chance of a new life without debt if they successfully go through the insolvency process. The bachelor thesis describes the issue of household debt, compares the development of the legal regulation of the insolvency law, explains the basic concepts of insolvency proceedings and describes the process of the insolvency process itself. The practical part focuses on the development of the number (and success rate) of personal bankruptcies, evaluation of the data obtained and testing of hypotheses. The aim of the work is to compare the development of the legal regulation of debt settlement, describe its course and evaluate the use of this insolvency instrument by consumers on the basis of data obtained directly from the insolvency register.

The first part of the bachelor thesis is an analysis and comparison of legislation related to consumer credit and identify significant changes for consumers. The application part describes the development of household debt and the development of interest rates on consumer loans for housing and consumer loans other than housing. The community of property stands out as a key institution of matrimonial property law, but at the same time it is a very specific type of common property; it is the community of property that gives the marriage an indispensable property basis after all. The establishment and subsequent building of a family background simply cannot be done without property. The civil law tries to strengthen the security of the spouses in the area of property in every possible way, in particular by the broadness of the concept of community of property. In the name of marriage, all assets acquired by one or both spouses during the marriage fall within the scope of the community of property, with the exceptions expressly provided for by law. However, during the marriage, the spouses do not only acquire assets but also enter into obligations which give rise to debts. Whether the debts are debts common to both spouses or only of one spouse, they can often be satisfied by means of the marital property. The attachment of the spouses' community property means a more or less substantial interference with the matrimonial property base. The legislation therefore seeks to respond adequately to this phenomenon, and therefore differentiates between the various debts in order to protect the community property or the non-debtor...
Usury as the ethical question in the social work

The thesis deals with the manifestations of usury in our society and outlines possible solutions from the perspective of social work. The phenomenon of usury is set in the historical-philosophical context, from which the moral and legal rejection of usury practices grows, and subsequently the current forms of usury are defined. Over-indebtedness is connected with usury as its consequence and cause, so the thesis brings a closer look at the issue of debts and debt. Possible solutions to over-indebtedness are outlined, the work emphasizes debt counseling, which identifies the approaches, methods and procedures used by social workers.

Furthermore, the thesis also submits possibilities and consequences, which are related to consumer loan. The survey displays knowing of consumers about terms of consumer loan. The thesis was written by using sources, such as legislation, internet references and also book publications. This bachelor thesis should be helpful to all the consumers, who are considering a consumer loan.
Changes in Debt Relief Self-Employed Persons after Amendment to the Insolvency Act

The bachelor thesis describes the main changes in debt relief after the amendment of Insolvency Act No. 31/2019 Coll, which is effective from the 1st of June 2019, amending Act No. 182/2006 Coll., Bankruptcy and the Methods of its Resolution. The thesis provides basic information on insolvency proceedings, the historical development of the Insolvency Act, the characteristics of debt relief, bankruptcy and reorganization. Another part of the thesis also deals with the amendment to the Insolvency Act, which aims to alleviation the negative consequences of the covid-19 pandemic on the economic situation of citizens and self-employed persons. The practical part detects the view of amendment No. 31/2019 Coll., from insolvency administrators and judges of the insolvency section of the Regional Court in České Budějovice and evaluates the results with predetermined hypotheses.
Debt spiral of an individual entrepreneur and possibilities of its solution on the example of a case study

This bachelor thesis examines the causes, course and current financial crisis of an individual entrepreneur caused by a debt spiral. The theoretical part focuses on debt and indebtedness, which is one of the causes of poverty. It describes the debt spiral, its causes, prevention and solutions. It examines the role of institutions and personal bankers in resolving the debt spiral, the legal circumstances of debt relief and personal bankruptcy. These theoretical findings are applied to a case study that deals with a specific debt situation. In cooperation with an indebted businesswoman, it solves her financial situation. The work focuses on compiling a private budget that stabilizes the current situation. The aim of this work is to propose a solution of the debt spiral, to describe the course of the solution and to evaluate the results of the proposed solutions. The research method is a case study. Two types of questionnaires are used in this case study. The interview is further developed from the facts that emerged from the answers to the questions in the questionnaires.
The debt traps from the point of view of social work

The debt traps from the point of view of social work Abstract This diploma thesis covers the topic of debts in Czech households not only as a negative social phenomenon but also as a "lifestyle" nowadays, mainly because we have been witnessing an increase in falling in debt, in inability to pay it back and in distraints. The thesis points out the biggest issues, risks and consequences of this phenomenon. At the beginning of a debt spiral, there is not only a need and satisfaction but also large marketing which is focused on vacations, electronics and, last but not least, the "favourable" loans. People get into the debt spirals mainly through a number of loans when the new ones are used to pay back the old ones. The newer loans are less favourable than the previous ones and therefore, the cost of the loans increases. Such situation is unmanageable in the long term and results in an inability to pay back the individual loans, in distraints and often even in personal bankruptcy. The theoretical part of the thesis covers the basic terminology, e.g. debtor, creditor, loan, distraint, and addresses causes typical for the topic of depts. The diploma thesis concerns itself not only with people who found themselves in the debt trap, but also with debt-relief companies which, in the debtors' point of view, require quite large fees. The thesis also mentions non-profit organisations and social workers who aim to resolve the debt problem through social work and services and to alleviate the situation. The practical part of the thesis was carried out by a qualitative research strategy and the technique of semi-structured interviews. The structured dialogues were completed with interviewing and the data were processed by the pencil-and-paper method. The thesis points out individual causes which lead the informants into debt traps. There are causes of falling into debt, apparent from the dialogues, such as losing a job, breaking up with a partner, family matters, entrepreneurship or financial illiteracy. Through mapping, a significant lack of informants' knowledge about social work and services in connection with debts has been discovered. The main merit of this thesis is collecting and providing information about factors which lead the informants to debt traps and to utilizing social work and services. These factors can be used by non-profit organizations for setting up effective public relations, i.e. for preventing intensification of debt traps. The thesis can also serve as an educational and preventive material about the topic of debts, connected to social work, and not only for students but for the public as well.
nalysis of Indebtedness of Students

This work pursues the matter of indebtedness of young people. It focuses mainly on analysing the answers given by the young people in a survey which was conducted between students. Based on the results given by the survey we estimate indicators such as an income, expenditure and how many youngsters already have an experience with loans. The answers from the survey are also used for descriptive statistics or evaluation of hypothesis. For this the chi-square test is used. From this test we are able to say whether the men are more likely to be in debt or not or if there is some connection between the loans and the education. The aim is also to compare the supply of loans for the young people which are offered either by the banks or the non-bank institutions. The information for the comparison is based on the internet sources.
