Travel contract under Czech and German Law

1 Abstract Title of the thesis: Travel contract under Czech and German law Area of the law: Civil substantive law It is the aim of this author to provide a theoretical analysis concerning the outcomes and implementation of the EC-Directive 90/314 into Czech national law by examining the construction, the materiality, and the meaning of the directive; identifying any deficiencies of the current legal regulation on travel contracts in the Civil Code (including actual or possible undesirable consequences); and offering possible solutions. The main part of this thesis is divided into two chapters. The first chapter, entitled Chapter 2, presents the background of the current legal regulation and explains why it has become necessary to codify these rules. The second of the two chapters, entitled Chapter 3, comprehensively deals with the travel contract itself

Brno: Mendel University in Brno, 2018. This bachelor thesis deals with implementation of Directive (EU) 2015/2302 of the Europian parliament and of the Council on package travel and linked travel arrangements to the legislation of Czech republic, its impact on travel agancies and target client. The first part describes legal framework of customer protection in EU and CZ, theoretical transposition of directive to the legislation of the Czech Republic and possible associated problems that might follow. The second part explains reasons of necessity of amendment to the act, main differences against directive 90/314/ECC, influenced areas and impact on travel agency activities.

Machkovs'ka, O. State regulation of tourism. Bachelor thesis. Mendel University in Brno, 2014. The bachelor thesis deals with state regulation of tourism and consumer protec-tion. The theoretical part is focused on determination of state regulation of tourism and consumer protection in this industry according to the New Civil Code. Furthermore, there is mention about Strategy of National Tourism Policy of the Czech Republic valid for the period of 2014-2020. The practical part focuses on examples of solving travel claims in selected tour operators and analyzing travel contracts. The thesis also compares changes of legislation of travel contract after 1.1.2014. In conclusion are given recommendations for consumers.
Travel agreement

A primary aim of this thesis is to analyse travel agreements of tour operators and travel agencies, in respect of their general terms and also the forms themselves. Besides this main purpose there are two additional ones - to research how the customers are successful in clearing their complaints about services provided to them (in case of the justified complaints) and to find out how the customers pay attention to control their personal data contained in the travel agreements and also how carefully they read general terms and conditions. All the mentioned aims have been achieved. The thesis includes two working hypotheses that were disproved after having got the respondents'answers.
