Legal and Economic Aspects of Cartel Agreements in the Czech Republic

The thesis is dealing with Impact of Cartel agreement on individual subjects of Competition within the Scope of wider macroeconomic context. On the basis of predicted behavior at microeconomic level are outlined possible macroeconomic Impacts. Current practice in protecting Competition in the Czech Republic is delimited in the perspective of possible philosophy-political approaches emphasizing the legal framework. Competition protection is generally aimed at consumer welfare, which can be considered to be the primal target. Fundamental terms are defined on the basis of factual usage with the focus on the problematical questions in practice. In the practical part is briefly introduced proceedings course including possible remedies.

V první části práce je charakterizována hospodářská soutěž. Je zde vynaložena snaha porozumět tomu, jak by mělo být nastaveno právní povědomí a právní řád vzhledem k přirozenosti soutěže na jedné straně a nutnosti regulovat hospodářskou soutěž na straně druhé. Následně je věnována pozornost právní úpravě hospodářské soutěže napříč českým právním řádem. Dále jsou vymezeny praktiky nekalé soutěže. Ve druhé části je již řešeno jádro práce a tím jsou jednotlivé druhy kartelů, řízení před Úřadem na ochranu hospodářské soutěže a soudní přezkum rozhodnutí správního orgánu. V závěru práce jsou uvedeny praktické příklady jednotlivých kauz, které se týkají kartelů. Dále jsou zde předloženy rozsudky vydané Úřadem na ochranu hospodářské soutěže v prvoinstančním řízení a vydané rozsudky Nejvyšším správním soudem. Cílem této bakalářské práce je přiblížit fungování hospodářské soutěže v České republice se zaměřením na jednotlivé typy kartelů a zhodnotit činnost správních a soudních orgánů při aplikaci právních předpisů na ochranu hospodářské soutěže.

- DEVELOPMENT OF DECISION-MAKING IN THE FIELD OF PUBLIC PROCUREMENT As the title of the dissertation suggests, its content is an analysis of decision-making in the field of public procurement, including its evolution. The dissertation is divided into three main chapters, namely the general conclusions on the legal regulation of the review of the procedure of contracting authorities, a specific analysis of decision-making practice and proposals for legal regulation de lege ferenda. In general, the dissertation focused on both national review and the supervision of public procurement by the EU institutions. The dissertant focused mainly on the description of the motion proceedings and ex officio proceedings, the imposition of corrective measures and also the legal regulation of offenses. In the chapter on the summary of general legislation, the dissertant also briefly described the role of the The Office for the Protection of Competition ("Office") and national administrative courts, as well as the role of the Constitutional Court. In the chapter on decision-making practice in the field of public procurement, which is a key part of the dissertation, the dissertation analyzed the issued decisions, especially in the period after the entry into force of the new Public Procurement Act. Evaluation of the Office for Protection of Competition Decisions Regarding Abuse of Dominance with an Effects-Based Approach

The bachelor thesis evaluates decisions of the (Czech) Office for the Protection of Competition (OPC) in abuse-of-dominance cases with an emphasis on its impact on consumers. The first part briefly summarises available effects-based approaches to abuse of dominance. The second part analyses five particular cases that were decided by the OPC. The author points out several recurring weaknesses of the OPC's economic reasoning. In some instances, the OPC seems to be using selective economic argumentation only to support the result at which it arrived by intuition. Economic evidence is thus interpreted with respect to the pre-defined conclusion; it is not investigated unbiasedly, and resulting justification is unsound. Although the OPC knows a wide variety of tools for economic analysis, it is sometimes unable to identify the situations at which individual tools should be applied.
