Legal aspects of brown coal exploitation limits

The thesis aims to provide an analysis of the legal limits imposed on brown coal exploitation in the Czech Republic, including an assessment of how these limits enter into particular stages of coal mining. The first chapter summarizes the applicable mining law legislation. The second chapter deals with restrictions set out by protection of the environment rules. Furthermore, the following chapter focuses on specific topic of so called ecological limits of exploitation. The fourth chapter points out the limits laid by the right of ownership. Finally, the thesis comprises a summary of contained conclusions.
Legal Protection of Inanimate nature

This thesis comprehensively analyse the issue of legal protection of inanimate nature. The thesis analyses the legal protection of inanimate nature only by Czech law and the primary source of this thesis is the Act No 114/1992 Coll., on the Protection of Nature and Landscape. The thesis is divided into two parts. The first part of thesis focuses on the specific legal protection of particular elements of inanimate nature in the Czech Republic, such as caves, paleontological resources and mineral resources. In this part, thesis analysis how these elements are protected by the law and how effective this protection is in practice. The second part of thesis focuses on territorial protection legal tools in the context of inanimate nature protection in terms of both general and special legal tools. It analysis legal protection of significant landscape elements and landscape character as well as inanimate nature protection through regulation of specially protected areas including Natura 2000 European protected areas. In this context the attention is also paid to protection of inanimate nature elements as protected habitats of animals and plants and their importance for the conservation of biodiversity. The concept of waste and the classification of waste

The thesis deals with the legal definition of waste; it analyzes the meaning of the concept of waste in international, European and Czech legislation. The paper mentions the rich jurisprudence of the Court of Justice of the European Union, which has significantly influenced the concept of waste in the Directive 2008/98/EC. The thesis also concerns with the Act. No. 185/2001 Coll., on waste, and with the concept of by-product and concept of end-of-waste status. The paper also shows the classification of waste in the Czech legislation and defines the categories of hazardous waste, non-hazardous waste and municipal waste.
Legal regulation of air pollution on municipal level

The thesis deals with the legal regulation of air protection on the municipal level. It is focused on providing an overview of legal instruments which are available on the municipal level, as well as the evaluation of their sufficiency and efficiency and point out the most significant instruments and some shortcomings of recent legislation. Some chosen instruments embodied in Czech law are compared with relevant German regulation. Also some specific, arguable constitutional aspects are taken in consideration and evaluated. The thesis provides a comparison of the old and the new Act on the Protection of Air at the field of interest.
New legal regulation of the protection of air quality

The theme of the theses is the new legal regulation of air quality protection in Czech Republic, which is mainly represented by the Act no. 201/2012 Coll. on Air Protection. The opening chapters deal with the definitions of the basic terms in this legal area, the characteristic of the main air pollutants and the development of the air protection legal regulation in Czech Republic. The treatise on the new legal regulation is divided by the legal instruments of air quality protection - the individual chapters deal with conceptual, administrative-legal and vindicatory, economical and specific instruments. The final chapter contains the summary of the major changes and the evaluation of the new legal regulation.
Precautionary principle and its role in environmental protection

in English The diploma thesis addresses the precautionary principle and its role in environmental protection. In the introduction the author deals with the origins of application of this principle, its definition and its primary characteristics. Precautionary principle is distinguished from prevention principle and differences between terms principle and approach are assessed. Subsequently the thesis describes the current state of incorporation of precautionary principle in the individual areas of environmental protection and specifies the typology of various incorporation methods. Furthermore, significant case law regarding the subject principle is introduced and the current importance of the principle is evaluated. Substantial arguments of precautionary principle critics are also included. In the final part of the thesis, the author outlines de lege ferenda ideas concerning the precautionary principle, including efficient methods of incorporation of the principle, solutions to flaws of current regulations and draft of template provisions of precautionary principle application.
European Legal Framework on Handling Chemical Substances

ANGLICKÝ ABSTRAKT This master's thesis analyses European legal framework on handling chemical substances. Primary focus of this thesis is on the Regulation (EC) No 1907/2006 of the European Parliament and of the Council concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals, establishing a European Chemicals Agency. A part of the thesis is dedicated to comparing analyses between American and Europeans legal framework and part is also dedicated to an attempt of monetary cost-benefits evaluation of this regulation. Legal regulation of waste disposal

The thesis deals with waste management. The aim of the thesis is to describe and evaluate present waste legislation including amendmets to several waste management institutions and comparison to waste legislation of European Union. The thesis is divided into eight chapters. The first chapter focuses on introducing into general range of waste management. The second chapter deals with sources of law, both national and international. The third chapter describes the central term of waste management and of the thesis, i. e. waste, and presents its definition, exceptions from the definition and exception from regulation of the Waste Act 185/2001. The fourth chapter focuses on the waste hierarchy and explains it. The fifht chapter includes the waste management plans, and presents them in accordance with their importance in the hierarchy of waste management plans. The chapter explains content and meaning of the waste management plans. The sixth chapter refers subjects to the obligations given by Waste Act . At the end of the sixth chapter author mentions the matter of legal liability in case of the subjects being in breach of the obligations. Legal regulation of air protection against pollution from stationary sources

The diploma thesis deals with legal regulation of air protection against pollution from stationary sources especially with the Act no. 201/2012 Coll. on the Protection of Air. The opening chapter introduces to the issues and systematics of the diploma thesis. The second chapter contains the overview of the most important pollutants with their impacts on human health and the environment. The third chapter concerns the international regulation of the air pollution protection including the European Union regulation. The fourth chapter describes the development of the air protection legal regulation in the Czech Republic. The fifth chapter gives attention to the definition of the stationary source of pollution. The sixth chapter deals with the level of pollution and the tools connected with this level. The seventh chapter is about the regulation of the sources of pollution. The final chapter summarizes the previous text and contains the evaluation of the legal regulation of the air protection.
Protection against noise and vibrations from the legal point of view

Noise and vibrations belong under the sources of endangerment of the environment and can cause permanent damage of human health therefore it is necessary to legally control them. A protection is provided by a regulation by international and domestic law. The most influence on Czech law have the legislation of the European union. The foundation of the domestic public law regulation is the Public Health Protection Act and the order of the government Nr. 272/2011 Coll. which sets the highest admissible limits of noise and vibrations. The regulation of the private law is centered to the instruments of the Civil Code. The so called new Civil Code brings many changes into this legal area.
