The European Court of Justice as an actor in European Integration
Pauk, David ; Martinková, Viera (advisor) ; Jeřábek, Martin (referee)
This bachelor thesis deals with the role of the Court of Justice of the European Union in the process of European integration. The aim of the thesis is to find out whether the Court of Justice acts as a political actor in its decision-making. The research has been carried out by means of a case study method of selected judgments of the Court of Justice of the European Union. The selected judgments concern the institution of EU citizenship, which was introduced into the political and legal space of the European Union by the Maastricht Treaty. The developed definitional criteria of a political actor, based on the works of political scientists and lawyers engaged in the study of European integration, were applied to the selected judgments. It was found that in most cases the Court does not behave as a political actor and, if it does, it usually pursues certain legitimate objectives with its decisions.
