The behavioral analysis and serial, mass and sexual murders

My diploma thesis deals with the behavioural analysis and perpetrators of serial, mass and sexually motivated murders issue. The behavioural analysis is built upon bases of different methods of criminal profiles formation - psychological profiling. Following the historical outset of the criminal profile, the method of the behavioural analysis and its particular components are introduced and discussed. The components are described through optic of the most commonly used typologies, e.g. perpetrators typologies, scenes of delict, victims and murders. Hereafter I pursue issue of criminal profiling utilization in practise, particularly perpetrator profile creation, crime linking and threat assessment. The last part dedicated to the behavioural analysis consists of behavioural analysis historical development in the Czech Republic and reflection of potential future development of this issue. The second part of my diploma thesis is focused on serial murder and serial perpetrator. The definition of multiple murder and differentiation from its individual types is given. The Scope of the Prosecutor in the Preliminary Criminal Proceedings

Resumé This thesis titled The Scope of the Prosecutor in the Preliminary Criminal Proceedings presents a compact view on the prosecutor's role and activities in the preliminary proceedings. At this stage, the prosecutor has a vital role and is regarded as the master of the preliminary proceedings (dominus litis), for he carries the ultimate responsibility for its results. In the court proceedings, where he is accorded the party status, the prosecutor represents the public prosecution. In relation to the police authorities, the prosecutor has a number of privileges that enable him to supervise the adherence of legality in the preliminary proceedings. The work is divided into four main chapters. The first chapter discusses the legal base of prosecution as a body of public prosecution in the criminal proceedings. This chapter also characterizes the institute of external and internal supervision within the system of prosecution. The second chapter defines the preliminary proceedings as an obligatory, pre-trial part of every criminal proceeding. Furthermore, this chapter elaborates individual functions of the preliminary proceedings, including its forms and stages. Specificity of interrogation of children

The aim of the thesis was to describe the main differencies between an interrogation of adults and children. The thesis is composed of six chapters, an introduction and a conclusion. The first chapter is focused on concept "a child" in the Czech legal order and International agreements. The next chapter describes specifics and problems of individual evolutionary periods of children. The third chapter explains the interrogation in a general meaning. The interrogation is included and modified in more statutes. I focused on provisions of a statute relating the interrogation in Czech law, especially in criminal law. Next part of this chapter deals with the interrogation and a criminalistics. How to prepare for the interrogation, the stages of the interrogation and tactics of its implementation. I also mentioned the forensic psychology which helps and supplements the criminalistics with its own methods and findings. The fourth chapter is an analysis of a testimony, in a first part in general meaning and the second part describes a process of formation of the testimony and the factors which can influence this process from an event to a record by an interrogator. Cizojazyčné resumé The diploma thesis deals with the methods of investigation of sexual crimes. Because the topic is too broad I've decided to focus only on selected issues of methods of investigation of child sexual abuse. Investigation of child sexual abuse is very specific in comparison to other sexual crimes. During the investigation the child victim must be handled very sensitively in order to avoid secondary victimization. The purpose of this thesis is to describe the specifics of investigation of child sexual abuse and other problems connected with it. The thesis is divided into six chapters. The first chapter is dedicated to historical and current legal regulations of child sexual abuse. At the same time it describes occurrence of this crime in the area of the Czech Republic. The second chapter provides criminalistics characteristic of child sexual abuse. The chapter consists of three parts. The first one is dedicated to the typical ways of committing this crime with focus on cybergrooming. The second part describes different types of perpetrators and also specifics of female perpetrators. Forensic Handwriting Examination The aim of this thesis is to introduce the Forensic handwriting examination as one of the disciplines of Forensic identification, to describe its methods and procedures, and to demonstrate them on specific examples. The aim of the practical part of the thesis is to apply the findings described in the theoretical part of the thesis to the handwriting examination carried out by the author of the thesis, to experimentally verify some of hypotheses presented in the thesis, such as the influence of various factors on the handwriting of an individual, and to examine the most frequent methods of deliberate alteration of one's handwriting. The first chapter of the thesis is focused on the definition of the term "Handwriting Examination", on a brief examination of the history of this branch of forensic science, and on the analysis of its relations to other fields of forensic science, especially to the graphology. - Crime of murder and killing under Section 140, Section 141 of the Czech Criminal Code The target of my thesis is primarily a closer analysis of the legal characteristics of subject matters of crimes of murder and killing under § 140 and 141 of the Criminal Code, based on the grounds of the available literature and case law. The first chapter outlines the history and conception of intentional killing on the Czech territory, including their punishment, since the primitive culture society until the adoption of the Law no. 40/2009 Coll. (Criminal Code). The second chapter is devoted to a brief definition of a new system of the problematics of crimes against life and health in the new Criminal Code, including various forms of intentional killing, and is designed as a general introduction for further explanation. In the next chapter, we discuss human life as an object of crime, with a focus on clarifying the issue of its beginning and end, because it is necessary to define the period in which human life is protected by the criminal law. Zusammenfassung Das Thema der Diplomarbeit ist Verkehrskriminalität und ihre Prävention. Ich habe dieses ausgewählt, weil ich es sehr aktuell betrachte. Der Verkehr ist gegenwärtig ein üblicher Bestandteil unseres Lebens. Verkehrkriminalität betrifft fast alle Menschen. Jeder von uns kann sowohl Obfer, als auch Täter werden. Zugleich handelt es sich um das Thema. Das die Aufmerksamkeit noch nicht verdient. Angesichts der Schadenhöhen, der Anzahl der Todesfälle und der Verletzten handelt es sich um einen Bereich, der einen erheblichen Einfluss auf das Leben sowohl der ganzen Gesellschaft, als auch einer individuellen Person hat. Das Hauptziel dieser Arbeit ist es, die Hauptuhrsachen der Verkehrkriminalität zu analysieren und anschlieβend die Vorbeugungen zu erzielen. The Determination of Modus Operandi

The purpose of my thesis is to provide description of modus operandi. Specifically it is focusing on determining factors and their influence on modus operandi. It is divided into seven main chapters. Theory is supplemented with examples of forensic practice. The first chapter is providing the description of term modus operandi. This section is also including the part dealing with terminology. Following chapter is about components of modus operandi. The components are divided by their character and their degree of complexity. The third section is dealing with determination in general. The thesis continues by two chapters describing the determinants of modus operandi. The first section is analysis of objective determinants and the following part is about subjective factors. Section of determination is devoted an immense part of my thesis. The sixth chapter is describing mechanisms of formation modus operandi. Conclusion is dealing with forensic significance of modus operandi, concretely the significance for creation of investigative versions, forensic record "modus operandi systém", forensic identification and also for forensic prevention.

Methodology of investigation of rape (specific issues)

Resume This thesis called Methodology of rape investigation (specific issues) is focused on problems with rape investigations, special attention is paid to treatment of authorities (and other persons) with victims in criminal proceedings. The reason for my choice of this theme is the lack of attention given to this topic (particularly handling with victims). Although in the last few years the situation is getting better, the specific investigating problems remain. The thesis is divided into five chapters, first two of them are more theoretical, other sections are rather practical and are based on my own empirical research from court cases which I have studied. Chapter One deals with the criminal view of rape, especially history of rape and legal definitions in Czech statutes. The next part of the chapter is focused on criminological aspects of this crime, i.e. possible causes of rape, typology of offenders and victims, definition of secondary victimisation etc. Chapter Two is about methodology of rape investigation, and is specialized on the most frequent investigating acts connected with rape, i.e. interrogation, examination of victim's body, crime scene examination, genetic expert opinion, psychiatric expert opinion etc. The end of the chapter reveals myths associated with rape. Tactics to avoid false testimony

1 Die Kurzfassung Diese Diplomarbeit befasst sich mit der Taktik der Überwindung der erlogenen Aussage bei der Vernehmung. Sie konzertiert sich in diesem Kontext auf ein Paar Themen, die unmittelbar vernehmende sind. Besonders handelt es sich um die Vorbereitung und den Verlauf der Vernehmung. Die Diplomarbeit befasst sich auch mit den Personen, die die andere vernehmen, oder die vernehmen wird. Bei den vernehmenden Personen konzentriert sich die Diplomarbeit hauptsächlich auf die Beschuldigte und die Zeugen, bei denen ein hohes Risiko sein kann, dass sie mit einer potenziellen Motivation lügenhaft aussagen können. Das Ziel der Arbeit ist, den Querschnitt durch die bisherigen Erkenntnisse über die erlogene Aussage bei der Vernehmung zu machen. Besonders wenn es sich um die Indikatoren und die nachfolgende Methodik handelt, die eine Anleitung sein können, um eine erlogene Aussage bei den konkreten Typen der Menschen zu überwinden. Am Schluss der Arbeit wird es sich auch mit physischdetektiven Untersuchungen befasst. Ein Teil der Arbeit sind auch die Ergebnisse der gegenwärtigen polizeilichen Praxis.
