Participation of experts and specialists in investigation

1. Abstract This thesis deals with specific means of participation of experts and specialists in investigation, that is it discusses expert opinion, authorized expert's report and participation of consultant in investigation. The topic is interesting because it offers an analysis of very important evidence used by the police, courts or prosecutors to learn about all the facts related to the criminal proceedings objectively. Lately especially expert opinions and expert's reports are increasingly needed to clarify the most serious crimes committed by means of technology and finance. In order to solve these crimes, the expert knowledge is necessary. It is that kind of knowledge that police, judges and prosecutors do not and quite fairly cannot have. This paper in its particular parts talks about expert opinion, authorized expert's report and participation of consultant in investigation as written above and also about their mutual relations. What can be said about the expert opinion is that it contributes to clarification of questions which require expert knowledge but at the same time the complexity of these questions does not ask for authorized expert's report. 1 Diploma thesis: Methodology of investigation of sexual crimes with special focus on the sexual abuse of the child Summary The aim of my diploma thesis called Methodology of investigation of sexual crimes with specials focus on the sexual abuse of the child was to clarify serious topic named sexual abuse of the child. The dissertation is composed of three chapters each of them dealing with different aspects of sexual crimes especially sexual abuse of the child. The first chapter of the study deals briefly with sexual crimes which create one of the most dangerous and harmful group of crimes. The victims of these crimes are faced with serious physical and mental consequences. It is very specific because of the assault against the intimate sphere of person that influences the free choice in sexual relationships. The pivotal part of my dissertation represents the second chapter called Sexual abuse of the child. The chapter is subdivided into two parts. The first part characterises forms of sexual abuse of children, victims and perpetrators. The most frequent situation of sexual abuse of the child takes place in the family and the most frequent type of perpetrator is man related with the family, for example the father. Interrogation Tactics The aim of my diploma thesis is to provide an overview of methods of interrogation. The topic Interrogation Tactics is very broad, so I am especially focusing on the use of tactical procedures in a situation when the person is not willing to testify truthfully. The thesis is split into 5 key chapters, each of those attempts to summarize the most essential issues within the relevant field. The first part of this work outlines general aspects and also analyzes problems of examination and statement. This chapter introduces characteristics, definition and representation of interrogation and its legal background. Complete concept of the most common kinds of examinations are also described here. In order to satisfy the objective of examination, i.e. to get knowledge of relevant facts, thorough and accurate preparation is necessary. Otherwise the examination may not fulfill its task successfully. I focus on that in the second part of this thesis. In the third chapter called "Interrogation Tactics" I concentrate on the actual practice of interrogation tactics. Title of the dissertation: Reconstruction of a criminal offence Key words: reconstruction, criminal offence, criminology Abstract This dissertation deals with reconstruction of criminal offence, its definition, the tactics used and the relevant aspects of the criminal law. The first chapter is concerned with the term of 'crime reconstruction'and the use of the crime reconstruction, discussing the historical development of crime reconstruction together with the development of the views and opinions dealing with the crime reconstruction. The second chapter considers specific types of crime reconstruction, that is a reconstruction of criminologically significant crime locations, significant objects and significant signs of a criminal and, finally, the reconstruction of criminologically significant actions and events. The third chapter deals with the legal aspects of the reconstruction of criminal offence, specifically its embedding in the criminal law. The fourth chapter discusses the difference between the reconstruction of criminal offence and the other methods of investigation, such as the initial investigation, verification of statements on the site and the inspection of the scene of crime. Methods of investigation of sexual crimes (selected issues)

The thesis deals with the topic of sexual offences investigation. Given its complexity, the thesis only focuses on particular issues, namely the special investigation procedure used in the cases of sexual offences committed against children. The thesis aims to provide overview of individual investigation procedures used in those special cases, to point out their advantages and disadvantages, and to explain reasons why sexual offences against children need to be treated differently. The thesis includes fourteen chapters dividend into sub-chapters. In the introductory part, the main of objectives of the thesis are defined; the following first chapter focuses on the term sexual exploitation and describes the legislation on this issue in the Czech Republic. The second chapter outlines typical ways of committing this type of offence; the third and fourth chapters focus on the subjects of sexual offences, both the offender and the victim, and answer the question if there is a typical victim and a typical sexual offender. Psychological profiling of an offender

In my thesis I focus on psychological profiling of an offender which is one of relatively new and rapidly developing methods of investigation. In its modern form it was developed in United States in early 70's and it is currently used more and more frequently. Therefore new possibilities of its use are still developed. The method that was originally used basically just to create the profile of an unknown perpetrator, is now used much more broadly. I chose it as a topic of my thesis primarily for its multidisciplinary nature, the breadth of its application possibilities and openness to new knowledge and theories. Not quite irrelevant reason was also a certain controversy that acompannies this technique. The purpose of my thesis is an attempt at comprehensive and sober perspective, organizing current knowledge and exploring how can psychological profiling help in linking crimes in series. In consideration of the variability of murders and of the overall natural development of the company, it is necessary to be consulting also the methodology of investigation as the process which is dynamic and subject to the development. One of the essential and the relatively unknown phenomenon in this area of the last time was the increase in committed murders made to order - hired murders. I was chosen the topic of my thesis "The metodology of drug criminality investigation" becuase I am very interested in this issues and I consider drug use and abuse as very present global problem. The thesis is divided into two parts. The general part contain six chapters. I begin with the introduction into the problem including used terminology and slang expressions too. Then I describe particular drugs and their consequences. The following charter is connecting of drug abuse with crime and developement and situation in the Czech republic before the year 1989, after this year and the present state. Chapter five is constituted by structure of internal body causing in the drug problems area. In the ending of the first part I present the progress of our legislation in the drug crime including the outline of legislation state in the EU states. 1. Summary Identification of corpses and skeletal findings The topic of my graduation thesis is the identification of corpses and skeletal findings. In this work I have described methods which are currently being used for an individual identification of people, and I have also paid a special attention to methods that are regarded as predecessors of modern currently-used methods. In each chapter of my thesis, I described different kinds of methods and I have also attached some short cases, just to illustrate the real work of police forensic experts after location of the corpse or the skeleton. In the initial part of my work I have also attached the Glossary of Terms that explains some complicated technical terms. Although some of the methods which I have described in my work are used in many other branches, I have focused on the use of these methods in the forensic practice (criminal investigation) with the possible collaboration of experts in the identification work in mass accidents and disasters. Nowadays, one of the fastest growing and most accurate methods of the identification with the widest spectrum of applications is the DNA analysis method, so I decided to devote a substantial part of my work to this method.
