Vergütungspflicht bei der Vervielfältigung von Urheberwerken - die tschechische und deutsche Regelung im europäischen Kontext Abstrakt Die Vervielfältigung zu privaten Zwecken ist eine der Schranken vom Recht des Urhebers, das Werk zu nutzen. Auf der Grundlage eines Konzepts, das in den 1960er Jahren in Deutschland entstanden ist, ist eine solche Vervielfältigung nur dann möglich, wenn dem Urheber für einen solchen Eingriff in seine wirtschaftlichen Interessen Vergütung gewährt wird. Wie auch in anderen Bereichen des Urheberrechts ist es auch im Falle des Systems der Vergütungen notwendig, ein Gleichgewicht zwischen den Interessen des Urhebers und der gesamten Gesellschaft zu finden. Ein weiteres typisches Zeichen im Zusammenahng mit dem Institut der Vergütungen ist die technologische Entwicklung, die auch der Motor bei der Einführung des Systems der Vergütungen in den 1960er Jahren war. Die Arbeit widmet sich im ersten Kapitel den Gründen für die Einführung des Systems der Vergütungen und den Möglichkeiten seiner Ausgestaltung. The concept of public in copyright law

The thesis provides an overview and analysis of the concept of public in copyright law. The thesis begins by explaining the international, European and Czech regulation. The thesis highlights areas where is a need for a specific interpretation of the notion of the public - particularly the publication of the work and the right to communicate the work to the public. A substantial part of the thesis is devoted precisely to the right of the communication to the public. The thesis discusses the areas of use of work that appear to be borderline in terms of assessing whether they are private or public, for example use in offices, in public establishments, in taxis, in public transport, in hotel rooms, or on the Internet. The thesis focuses to the foreign national legislation and case law and the case law of the Court of Justice of the European Union, which is crucial for interpreting of the term of public in EU member states.

Rozvoj internetu, jako fenoménu konce 20. století, sebou přináší mnohé otazníky a výzvy, jak technické, tak právní, na které je mnohdy třeba odpovídat a řešit je bezprostředně poté, kdy vyvstanou. Postupem času toto "kybernetické" prostředí přestalo být ryze vědeckou záležitostí a začalo se, čím dál více, komercionalizovat. Právě spolu se zvyšujícím se využíváním internetu jako virtuálního tržiště, se začaly objevovat problémy, na které bylo potřeba adekvátně reagovat. S velikým zjednodušením lze pojmenovat dva stěžejní okruhy problémů, se kterými se "provozovatelé" internetu v současnosti především potýkají, a těmi jsou zabezpečení dostatečného počtu "internetových adres" a vypořádání se s neduhy, které registraci těchto "adres" provázejí. Těmito jsou především spekulativní registrace doménových jmen, když tyto zcela oprávněně vyvolávají reakce subjektů, které se takovou registrací cítí poškozeny. Životní cyklus doménových jmen, tedy proces počínající jejich registrací a případně končící zrušením takové registrace, popř. diskvalifikace doménového jména z možnosti jeho další registrace, je upraven zejména tzv. soft law - tedy pravidly vydávanými jednotlivými správci TLD. Copyright and the Internet - modes of use and the scope of protection of a work

Intellectual Property Rights and the Internet: Ways of Use and the Range of Protection of the Works The main scope of this thesis is to analyze the ways how copyrighted works are used in the environment of the Internet and how the works are protected, with emphasis on identifying current problems. I also asses the most common ways of infringement of the intellectual property rights, all this under the Czech act on intellectual property, the EU jurisdiction and also some international treaties. The thesis consists of seven chapters including the introduction and the summary. In the introduction I mention the variability of the world of computers and Internet in comparison to the conservative world of law and the rising importance of information in today's (information) society. I also state some of the main reasons why I am interested in this topic. In the second chapter I present the respective sources of law. In the first part of the second chapter there is a brief general overview of the sources, and in the second, more voluminous part I assess the question of the governing law. CONTRACTUAL COPYRIGHT LAW This thesis is dedicated to the Czech Copyright Law, which is part of Intellectual Property Law. The core of this work is lying on description and recognition of contractual concepts of Copyright Law in Czech Republic, namely the last two Copyright Acts. The first Copyright Act was valid from 1965 till 2000. The second Copyright Act is effective since 2000. Chapter 1 covers the sources of Czech Contractual Copyright Law on different levels, from the constitutional grounds to the regulations. Chapters 2 and 3 are initial introduction to the Intellectual Property Law. It provides basic explanation of intangible property terms. Chapter 4 tries to briefly show the history and the development of the Copyright Law on the Czech territory, particularly Czech Contractual Copyright Law. Chapter 5 deals with provisions of Copyright Act 35/1965. It concentrates on contracts for the distribution of a work and contracts to produce a work. Chapter 6 is devoted to the effective czech Copyright Act 121/2000 and its provisions related to contractual law. With short notice about contract for a work done. The Internet and copyright-the scope of liability of individual parties involved and modes of protection against piracy

Resumé The Internet and copyright - the scope of liability of individual parties and modes of protection against piracy. The main purpose of my graduation thesis is to analyze and evaluate the current situation in copyright law, with an emphasis on the general liability of the Internet Service Providers and other respective subjects in the information society. An inseparable part of this thesis is an overview of international treaties, European law and national law. The final part highlights new trends in copyright piracy with the provisions for combating these. From my perspective there are two reasons why this topic attracted my attention. Firstly, I could hardly hide my personal interest as a person who is a computer specialist by profession. Secondly, copyright law is a subject of perpetual and significant change, inspiring new ideas and new approaches. The work is divided into five chapters, which are divided into various subchapters. An introduction to the topic is broadly provided in the first and second chapter which describes this new medium of the Internet from several angles. - English The thesis deals with the issue of non-contractual legal institutions of the use of copyrighted works. It describes the ways of use of copyrighted work without the contractual arrangement with the author. Namely, I talk abou the free use and statutory licences. The statutory licenses, which are the major focus of the work, are divided into chargeable and free-of-charge statutory licences. I also entertain the interpretation of the so-called three-step test. In the thesis, I also deal with issue of copyright law in general.
Trade mark and unfair competition

In my thesis "Trade Mark and Unfair Competition" I deal with the issue of an unfair competition in relation to the registered trade mark and its manifestation in practices of the national judicial system. In my opinion the theme of an unfair competition is quite topical. Due to technical development and production increase as well as economical advancement, the forms of an unfair competition are becoming more specific and sophisticated. It is therefore necessary to recourse this phenomenon and guarantee to the registered trade mark proprietor the possibility to exercise his rights. While studying the relevant sources I came to realize, that due to the amount of these sources it will be necessary to focus on selected aspects of the investigated problem. My intention is to focus on those forms of an unfair competition which most frequently encroach upon the registered trade mark rights, and analyze the possibilities how to effectively fight such practices. My thesis consists of five chapters (marked by Roman ciphers) which are further divided into sections and subsection (marked by Arabic ciphers) laying out specific aspects within the frame of a given chapter.
