System of workflows in an international company OVB Allfinanz

This bachelor thesis is focused on functioning of the independent financial advisory company OVB as a form of a multilevel marketing system (MLM). The purpose is to describe the system, particularly its development, principles and how is legally regulated. Firstly, the marketing is briefly defined and MLM is specified as one of the form of direct sale. Secondly, the thesis is focused on the company itself. Basic information about the company, activities of financial advisors and its historical development are provided. This includes legal regulations of the company and its advisors. They have several certifications at their disposal, which are essential to conclude financial and insurance contracts. Who can become an independent advisor and what requirements needs to be met is derived from law. An essential part of this thesis is a description of activities of financial adviser from the beginning of his collaboration with the company. This includes getting new clients, progress in the career plan and dealing with clients. In conclusion, the results of the thesis are summarized. The situation of financial advisory services in the Czech republic and its anticipated development are evaluated.

Rental, tenancy and leasing - Conformity and differences

The thessis focuses on comparison of rental, tenancy and leasing in legal and practical perspective. The aim is to find out how can these instruments be used for acquisition of movable property for private needs. A car has been chosen as an example. For research and evaluation there have been chosen methods of analysis and comparison. Common habit of private persons in acquisitions of cars is to take a credit or leasing from financial institution. The author of this thessis compares offers of those two methods along with an offer for rental as well as their terms and conditions. Car rental has come out as the cheapest in examined case. The results of examination cannot be generalized, because this case has been evaluated under specific conditions.
Compensation for material and non-material damage under the new Civil Code

On the 1st January 2014 came into force the Act no. 89/2012 of Collection of Laws., or the new Civil Code. In the recodification of Czech private law it is considered to be the most important piece of legislation. My bachelor thesis Compensation for material and non-material damage under the new Civil Code highlights the most important changes and impacts that a new Civil Code brought in the position of the victim, points to new cases of damage or injury, as well as new ways of compensation.
Types of businesses in the Czech republic - legal and economic aspects

The thesis deals with business activities led by individuals or partners in companies and corporations, and franchise business. The theoretical part of the work is to describe and compare the different legal forms with respect to legal and economic aspects. Another aim is to describe the development of franchise business in the Czech Republic and to characterize the various terms associated with franchising. The aim of the practical part is to show the example of the Czech company, which is a gastronomic concept of restaurants Lokál, how a franchise system is created in the Czech Republic.
Selected forms of entry on foreign market

The aim of this thesis is to provide a comprehensive overview of the possible forms of entry on foreign markets. Various inputs are compared according to an advantages and disadvantages. Diploma thesis is focused on trading with West Africa, particularly with Nigeria. Therefore I will bring the importance of the process of discussions and negotiations with respect to awareness of differences in cultural aspects of the negotiations and contracts. In conclusion, I refer to the establishment of a specific joint venture in Nigeria. Any input options on the international market are assessed in the context of trade in goods.
Electronic Public Procurement

This thesis deals with the issue of electronic public procurement. The aim of this thesis is to confirm or disprove the following hypotheses. The first hypothesis of this dissertation is the claim that the current legislation constitutes an adequate legal basis for the implementation of electronic public procurement. The second hypothesis states that the electronic public procurement is more efficient and more transparent than the public procurement without electronization. Examining the first hypothesis was chosen in order to determine whether it is necessary to change the law for the possibility of fully electronic public procurement. The second hypothesis, then, in essence asks whether electronization of public procurement improves the efficiency of public procurement and whether it contributes to increase the transparency of public procurement.
Problems of European company in practice

European company is a supranational form of public limited company. The aim of European Union was to make unified legal form for enterprises. The aim was not very successful because of disagreement of member states on employee participation. Also the fragmentation of legal frame of European company is too deep. The thesis analyse legal basis of European company and ways of its establishment. Examples from practice of Court of Justice of the European Union show difficulties in seat transfer before European company existed. Statistics and charts demonstrate unique position of Czech Republic. It is because of the absolutely highest number of established European companies, which is caused by trading trend with ready-made companies.
Mediation as an Alternative Dispute Resolution

The submitted thesis deals with Alternative Dispute Resolution (ADR), particularly mediation activities. The aim of this thesis is to introduce mediation as an alternative method of conflict resolution, that is still relatively neglected in the Czech Republic, through a summary of theoretical knowledge in terms of its practical operation. Particular attention is paid to the recent regulation relating to mediation in civil matters and certain essential institutes that are affected by the new Mediation Act. The work is divided into five chapters. The first chapter defines the general concept of ADR and outlines the different types of ADR. The next part of the thesis presents in detail the mediation, a mediator and requirements for the performance of this function. There is also clearly described the course of mediation process. The third chapter deals with the regulation of mediation in the EU, which is the starting point for each national system. The fourth chapter is devoted to the regulation of mediation in the Czech Republic. It describes the situation that prevailed during the period without comprehensive regulation of mediation in civil matters, the legislative process of preparation and adoption of the Mediation Act, newly enshrined institutes and there is also a definition of the obstacles that could hinder penetration of mediation into wider practice. Finally, there is a comparison of the situation in the Czech Republic with the application of mediation activities in the USA and in some EU countries.

The Food Safety and Quality Control System in Czech RepublicThe thesis describes the way how is the food safety control and quality protection provided in Czech republic. There is the law definition of the all forms of food during the food production chain from the primary production up to sale to the consumer in the work. The thesis focuses on the requirements laid down in the Czech and European food law on the food producers and sellers. The thesis also deals with the food contamination and quality aspects - nutrition value and quality branding. There is also chapter about the quality management system certification and chapter about the current cases related with the safe food area in the Czech republic in 2012 (Methanol, Polish technical salt and horse lasagne).
