Cyberspace and information security Abstract The dissertation deals with information security in cyberspace and cybersecurity. Within the academic community the topic is rather neglected, even though cybersecurity may be seen as a pillar-stone for the undisturbed performance of public administration. The thesis deals with the topic in broader theoretical and practical contexts. Technological changes in society have major influence on legal regulation and practice. Because of that, the first part of the thesis focuses on the key social changes related to digital revolution and globalization, on the values of the information society and on the principles of cybersecurity regulation, as well as on the issues regarding the applicability of law within cyberspace. The second part of the thesis discusses the role of public power in safeguarding the information security in cyberspace. The concepts of cyber defence and cybersecurity are discussed. The concept of information security is presented through the confidentiality, integrity and availability components. The international element is addressed with the perspective of selected rules of the second version of Tallinn Manual. Public Law Aspects for Undertakings in both Electricity and Gas Industries The doctoral thesis named "Public Law Aspects for Undertakings in both Electricity and Gas Industries" is focused on bringing a complete view how the public interest is represented in relation to the conduct of enterprise in infrastructural businesses as the sectors of electricity and gas industries concern that are in many ways similar to each other and are also managed by the comparable European law regulation. The public interest, either comes from the European or Czech legal regulations interferes in many different variations and modifications into the energy business. From time to time, legislator emphasizes the partial individual interest (e. g. being part of the constitutional order as in the case of the protection of ownership) in the wording of the Energy Act as well as in the other public law as goods protected by the public law. On the other way, also much more typical general interest is defended to achieve wellbeing of the whole society that is to be preferred to those interests of individuals. Planning permission procedure: process, decision and means of defence Abstract The topic of the thesis is the planning permission procedure, which is regulated in Act No. 183/2006 Coll., on town and country planning and building code (Building Act) and its goal is to issue one of the types of planning permission. Planning permission procedure follows town and country planning and at the same time other administrative procedures follow planning permission procedure. In many cases successful planning permission procedure is an indispensable and key precondition of the realization of applicant's intention. The thesis deals with the procedure itself, specifically elements of application for planning permission, commence procedure, types of delivery of written instruments, defining of participants of procedure, applying the principle of concentration, conditions and content of binding assessments for issuance of the decision, objections and remarks. Also the thesis focuses on planning permission itself (its elements and content), types of planning permissions, time-limit for issuing of the decision and methods how application should be considered. 1 Expropriation, Abstract Expropriation means withdrawal or limitation of someones property. This represents major interference into the fundamental right to property, as it this encorporated into the article 17 of European Union Charter of fundamental rights, as well as into the article 11 of the Charter of fundamental rights and freedoms, which is part of the Constitutional order of the Czech Republic. However, in the public interest, under the law and for compensation it is possible to initiated proceedings. Expropriation is permitted only in extreme cases where the public interest in the realization of a particular project outweighs private interest. Law sets out strict conditions for expropriation. The legal basis is the Charter of fundamental rights and freedoms according to which expropriation is possible only in public interest, under the law and for compensation. A specific regulation governing the whole process of expropriation is Act No. 184/2006 Coll., on expropriation. The partial regulation is also in the Act No. 416/2009 Coll., on accelerating transport, water, energy and electronic communication infrastructure. Public-law corporations include territorial self-governing units, professional and business chambers, and public higher education institutions. They are public entities different from the state. In order to ensure the legality of the public administration entrusted to them, they are subject to state supervision. This supervision is part of the control activities in public administration and falls within the remit of administrative control. In the remedial phase, it usually follows a judicial review consisting of a review of the lawfulness of abstract and concrete acts issued by the bodies of self-government. Two introductory chapters are devoted to the theoretical basis of state supervision over self government.
