The process and conditions of insolvency proceeding – Schuss Praha s. r. o.

This thesis deals with insolvency proceedings both from theoretical and practical point of view. The aim is to make the best and most accurate definition of the procedures of insolvency proceedings by the bankruptcy court, trustee in bankruptcy, but also the debtor. I tried to accurately describe the stages that the proceeding goes through, from an insolvency petition to the court decision of its termination. I applied the findings on a practical example of a particular company, Schuss Praha s. r. o.
Insolvency crimes

As it is evident from the theme of bachelor thesis, it deals with insolvency crimes. The aim of this thesis is to create a unified overview of selected insolvency crimes and also provide an explanation of basic concepts of criminal and bankruptcy law. The thesis is divided into six chapters. The first five chapters are devoted to the basics of the criminal law, for example what the crime is, which charakteristics it has, etc. The final chapter discusses the mere insolvency crimes.
Insolvency proceedings from the viewpoint of a creditor

This thesis first describes the insolvency proceedings in general, explains basic concepts, describes the different stages of insolvency proceedings and introduces the reader to the entitiesin the insolvency process. It also explains what is a bankruptcy and presents possible ways of solving it. The current situation in relation to insolvency proceedings is shown based on the basic statistics. In the next section, the thesis is focused on the classification of debts and the possibility of creditors to submit their claims in an insolvency proceeding. It also deals with special cases that may occur. The final part of the thesis describes an example application of claims in practise, incl. complications that the creditor must solve.
Insolvency resolution methods of natural persons in Czech republic

This bachelor thesis presents and describes insolvency resolution methods of natural persons according to actual Czech insolvency act. In connection with a significant increase of initiated insolvency proceedings in last three years is this thesis focused on extremely indebted households. First part deals with basic concepts and phases of whole proceeding. In second part reader discovers particular resolution methods, which are well known bankruptcy leading to liquidation and new institute of personal bankruptcy. These chapters clearly define differences, positives and negatives connected with each resolution method. Last part refers to specific advantage for debtors, which comes with personal bankruptcy. The analysis, necessary for creating this part, is based on real data from insolvency register.
Oddlužení jako způsob řešení úpadku

The Bachelor's thesis deals with the discharge of debts of a natural person which is governed by the Act No.182/2006 Coll., on Insolvency and Methods of Resolution (the Insolvency Act) and that came into force on January 1st 2008. The aim of this thesis is to provide a fundamental analysis of this non-eliminative method of resolving insolvency and the underlying issues are illustrated by the rulings of the high courts and the Supreme Court of the Czech Republic. The last chapter is devoted to the collective debt relief of the husband and wife, whose bankruptcy estate belongs to community property; this issue is practically created by the practice of the insolvency courts, because the Insolvency Act does not introduce it.
Discharge of individuals - method of solving bankruptcy

This thesis deals with the discharge of individuals in the Czech legal environment that is regulated by Act No. 182/2006 Coll. Insolvency Act. The aim is to show the course of insolvency proceedings with a focus on discharge of individuals and then make comparisons with the law of bankruptcy proceedings in the United States and Spain. Finally the real example of a specific individual discharge is shown.

The thesis describes a contemporary insolvency proceeding in the Czech Republic that complies with the Insolvency Act. It deals concretely with a situation when it was already decided by a court about an existence of a debtor's bankruptcy. It describes individual ways of dealing with bankruptcy. It concentrates on a process of insolvency proceeding in Austria and Germany and briefly also on an European insolvency law. The practical part analyses a process of reorganization granting on an example of the company SCHOELLER LITVÍNOV, k. s.
Comparison of the Slévárna Losenický and the Slévárna a strojírna companies based on solvency and bankruptcy models

This bachelor thesis is aimed at comparison and evaluation of financial health of the Slévárna Losenický s.r.o. and the Slévárna a strojírna, a.s. companies based on financial analysis application, particularly solvency and bankruptcy models, in the years 2004 - 2008. The bachelor thesis also deals with the explanatory power of the models. Both of the selected companies differ deliberately in their business success. The first mentioned one seems to be prosperous, while the second mentioned one has been undergoing insolvency proceeding since September 2009, but both of them are from the same branch of business and comparable with their amount of sales. In the theoretical part the bankruptcy theory, some elementary methods of financial analysis, i.e. horizontal and structural analysis, main financial ratios and net working capital indicator, are described first and then the extra attention is devoted to the solvency and bankruptcy models including their construction and evaluation criteria. In the practical part the mentioned methods and models are applied to both the selected companies and in the conclusion the explanatory power of applied solvency and bankruptcy models is evaluated.
Winding up of the commercial company

I have my thesis dividend into two parts. In the first part (theory) I tried to draw up the legal background of the winding up of the commercial company, then I aimed to general aspects of the winding up with liquidation (general reasons for winding up, liquidator, insolvency proceeding), specifics of the winding up with liquidation appertaining to particular type of commercial company and finally I described the winding up of the company with the legal successor (legal forms of conversions). In the second part I made up an imaginary limited lability company (I couldn't get any real dates from the existing company because they are all subject of business secret) and tried to illustrate the process of winding up of the company with liquidation. I put emphasis on particular steps of liquidator and the formal standpoints of the liquidation process.
