International Commercial Arbitration and the participation on national courts

INTERNATIONAL COMMERCIAL ARBITRATION AND THE ROLE OF NATIONAL COURTS SUMMARY International Commercial Arbitration as a form of alternative dispute resolution has flourished over the past decades. Parties to an arbitration agreement choose to have their dispute settled by means of arbitration and thereby exclude national courts from deciding on matters covered by their agreement. Arbitration thus allows each of the parties to avoid the home courts of the other party and allows the parties to adopt their own rules of procedure. However, parties' autonomy is not unlimited. It's limits are set down by the rules of the law of the seat of arbitration (lex arbitri) and also by the rules of the state in which enforcement of the final award is sought. Moreover, the arbitral process is subject to certain supervisory powers entertained by the the court of the seat of arbitration. The international trend is to limit these supervisory powers. The relationship between national courts and arbitral tribunals is said to be one of partnership. This partnership is not a partnership between equals. Arbitrators are dependent on the underlying support of the courts. As the arbitral awards are made by private individuals (or private arbitral institutions) their binding force must be sanctioned by national legal orders....

IPO on Central European stock markets

The thesis deals with recent Initial Public Offerings on Central European stock markets. It tries to explain, why there have been so many IPOs in Poland, whereas only a few in the Czech Republic and Hungary. It came to the conclusion, that the main reasons are as follows: (1) differences in equity culture, (2) the quality of commercial law and other legal issues, (3) high demand for domestic equities by Polish pension funds, (4) WSE's efficient marketing policy and market segmentation, (5) quantitative features of Polish market. The analysis of Polish IPOs discovered, that most of them are low-volume offerings, even compared to those in the Czech Republic. Also, the liquidity of these shares, turnover ratios and free float are quite low. The after-IPO performance is also unsatisfactory. This means, that the contribution of Polish IPOs to further capital market's development is not as strong as one could expect. Considering the PSE's and BSE's point of view, the situation is not alarming, however, some particular reasons of the lack of IPOs may be dangerous.

Restrictions of the free movement of workers on the basis of judgments of the Court of Justice

Freedom of movement of workers constitutes right of citizens of the Union to move and reside freely within the territory of Member States for the purpose of employment. But this right is not an absolute one. Bachelor thesis focuses on restrictions which arise out of EC Treaty, such as limitations justified on grounds of public policy, public security and public health or employment in the public service. Other limitations arise out of the disunity of national provisions. In order to reduce such limitations the Council shall adopt provisions for the harmonisation of legislation. It is typical in the process of recognition of diplomas and qualifications. Main legal sources of the bachelor thesis are judgments of the Court of Justice.

Reinsurance for insurance companies

The thesis deals with the theoretical and practical aspects of reinsurance. In the theoretical part the types and forms of reinsurance cover are described including the advantages and disadvantages for each one of them. The thesis also describes the reinsurance from the legal point of view and the explanation of contract clauses is included. Special accounting treatment of reinsurance is described and at the end is the practical part which deals with mapping of processes in the reinsurance department.




Resolution of erosion control measures on model catchment using CN method.
NOVÁKOVÁ, Eva
The goal of this thesis is to evaluate erosion processes and runoff conditions in a part of catchment Zubčický potok containing the land arrangement Věžovatá Pláně. I drew up the area description for this catchment in terms of geomorfological, geological, pedological, climatic and phytogeographical aspect. For the evaluation of erosion processes in the solved area was used the universal soil loss equation by Wischmeier and Smith and in the microcatchment was used the CN method. Further, flow conditions was evaluated using Čerkašin equation. The result of this thesis is evaluation of erosion and runoff conditions, concept of erosion control measures and evaluation their impact on erosion and runoff conditions in the microcatchment.

Sociální a demografická analýza vybraného území

V této práci se zabývám sociální a demografickou analýzou okresu Domažlice, se zaměřením převážně na demografickou analýzu. Zjišťuji zde vývoj počtu obyvatel, jaká je v okrese úmrtnost, porodnost, potratovost, sňatečnost a rozvodovost v porovnání s celým krajem a Českou republikou. Dále zjišťuji národnostní složení, jak se v průběhu posledního století vyvíjelo a co způsobovalo změny, jaká je vzdělanost a sídelní struktura okresu. V dalších kapitolách své práce se zabývám přírodními poměry okresu a ekologií, jaká je kvalita ovzduší a vod a jaká je zde možnost jejich ochrany. Dále zjišťuji úroveň hospodářství a infrastruktury, a to jak sociální, tak i dopravní a technické.
