Enactment of the health sector in the new Civil code and comparison with the Civil services law
JANOŠŤÁKOVÁ, Iveta
Numerous separate legal norms dealing with the individual spheres of everyday life exist in the Czech Republic at present; some acts mutually overleap and complement one another. Provision of healthcare and healthcare services is regulated by numerous international and national regulations in compliance with adherence to the basic human rights. The healthcare law issues are particularly dealt with by Act No. 372/2011 Col. on healthcare services and the conditions of their prevision, which became effective on 1 April 2012 and substituted Act No. 20/1966 Col. on people health care. Acceptance of the Healthcare Service Act completed the post-revolution changes in healthcare. The Act represents a relatively comprehensive system of rules, among others it regulates the rights and obligations of patients, healthcare providers and healthcare staff in provision of healthcare services. Recodification of the private law was completed in 2012. Act No. 89/2012 Col., the Civil Code was passed within that. It became effective on 1 January. This thesis is divided into five chapters including the conclusion. The first chapter tries to outline the development of the legal norms in healthcare and social sphere in our country. The development of the social-healthcare policy of the state from the late 19th century was later slowed down by the world economy crisis, the Second World War and the consequent normalization. The second chapter gives a brief introduction in the healthcare issues and is divided into several subchapters. It defines the basic terms health and disease. It specifies the individual models of human approach to health, the structure of the Czech healthcare; a part of the chapter deals with the physician-patient relation, particularly with its modification from the paternalistic approach of a physician to a patient to the partnership relation, in which a physician and a patient become equal partners. The third chapter introduces the international and national regulations forming a part of the current healthcare legislation. This legal norm expresses the willingness of the society not only in the Czech Republic to protect the basic values of a human being in healthcare provision. The fourth part of the thesis focuses in detail on selected spheres of provision of healthcare and healthcare services under the effectiveness of Act No. 372/2011 Col. on Healthcare Services and the newly passed Act No. 89/2012 Col., the Civil Code. The new regulation introduces a new type of contractual relation, a contract of healthcare, which should regulate the legal mode of the healthcare provision, including the position of a healthcare provider and a patient in healthcare provision. It also includes a complex regulation of intervention into natural person's integrity and the necessity of his/her agreement with such an intervention. This part of the thesis examines the relation between the Healthcare Service Act and the new Civil Code. The aim of the thesis was to map the previous and the new healthcare legislations and to specify the basic differences in the legal norms, and to assess the consequences of the changes in the regulations for a patient upon comparison of both the legal norms. This thesis is a theoretical one, based on detailed studying and on a content analysis of particularly regulations, specialized literature and further available sources. The conclusion, i.e. the fifth chapter summarizes selected problems of provision of healthcare and healthcare services. The new civil code is based on the requirements of the modern society and provides much higher improvement of patient rights. This levels the legal positions of both the involved subjects, the physician and the patient. Healthcare provision is however primarily regulated by the Act on Healthcare Service Provision and the Conditions of their Provision, namely in more detail than by the new Civil Code, which is in the subsidiarity relation to the special regulation.
Rights of insured persons and patients by legislation
VLČKOVÁ, Simona
Even though the health care services in the Czech Republic are of high international standards and accessible to majority of the population, some drawbacks may be noticed in terms of the approach of health care providers to patients and patient rights. Until 2011, the Act No. 20/1966 Coll., on Public Health Care, had regulated the health care provision and patient rights in a complex way. Gradually, it became clear that the main part of regulations did not consider the patient-specific needs adequately. Legislators' efforts to bring the patient rights in conformity with the principles of the Constitution, Charter of Fundamental Rights and Freedoms, and the Convention of Human Rights and Biomedicine have led to the Act No. 372/2011 Coll., on Healthcare Services, which has replaced the Act on Public Health. The new foundation of patient rights guarantees that the failure to fulfil may be rectified as only the rights defined by law can be effectively enforced. The prerequisite for a patient to exercise and demand his/her rights to be fulfilled is their knowledge. This dissertation aims to provide a concise overview of the progression of patient rights and their origins within the international and national context, to outline some rights of an insured person and a health care user more in-depth, to introduce the protection of patient rights, and to verify the knowledge of selected rights among the patients in the South Bohemian region. Based on my own research which took place in outpatient and inpatient facilities in the South Bohemian region by the questionnaire form I wanted to find how are patiens informed about theirs rights and whether they are actively interested in them. I chose two hypothesis. The first hypothesis was verified claims than the patiens over the age of 50 have more knowlidges about their rights than the patiens to the age of 50. From the results of statistical data exploration it shows implies that the patiens over the age of 50 have really more knowlidges than the patiens of the second age category, therefore the hypothesis was confirmed. The second hypothesis should confirm whether the patiens are passive at getting informations about the patiens rights. The survey shows that the patiens are active and they are interested in finding out informations. The second hypothesis didn´t confirmed. My purpose wasn´t describe in detail all patient rights. I wanted compile basic patient rights and rights of an insured person and a health care user which can be used to more patient know-how, for use of health professionals utilization or to teaching students of the Social and health faculty of South Bohemian University.
Availability and use of health and social services for people with mental disease in České Budějovice
KORTIŠOVÁ, Jana
The aim was to explore users' satisfaction with availability of healthcare and social services for people with mental illness in České Budějovice and also to map the use of these services from the users' perspective, but also employees' perspective. To obtain the necessary data I used quantitative research, a questionnaire technique. In total 77 questionnaires were distributed - in Domino and Fokus organizations in České Budějovice and also in the psychiatric ward in hospital in České Budějovice. Respondents were not only their users, but also staff of these institutions. The research shows that the most used service are day care centers, counseling and therapeutic services, and on the contrary, many users and workers lack social housing. Regarding health services, the most interviewed clients uses the services of a psychiatrist or general practitioner from whom the largest percentage of respondents obtains information about the services. The workers' responses showed that the vast majority of users of services has an interest in the offered programs, and in their opinion, primarily programs for use of leisure time, social and therapeutic programs should be supported. The greatest problem is seen in high financial demands on services and associated uncertain funding of social services and poor linkage between health and social services.

Health and social services offered to residents of socially excluded localities in České Budějovice
SÁDOVSKÁ, Petra
My diploma thesis focuses on finding out what health and social services are provided to the inhabitants of socially excluded localities in České Budějovice. Social exclusion is a process within which the access of individuals, groups of individuals or a community to sources, positions and opportunities enabling the involvement into social, economic and political activities society, is substantially impeded or completely prevented. The seriousness of the situation is illustrated by the fact that the year 2010 was declared the European European Year for Combating Poverty and Social Exclusion. One of the possibilities to deal with this situation is to provide health and social services, such as field programmes, social counselling, low-threshold services for young people and crisis assistance. My thesis aims at finding out whether health and social services provided to the inhabitants of socially excluded localities in České Budějovice are available, sufficient, oriented in the right direction, and whether they are used. At the beginning of the theoretical part, I made a brief definition of the terms social exclusion and poverty. Further, I described the main problem spheres of socially excluded citizens to which health and social services should react, and I also added a description of the current situation in individual socially excluded localities selected and of the specification of health and social services that the thesis deals with. The end of the theoretical part contains a summary of the theoretical part and subjects for my own research. The objective of my thesis was to survey the availability and sufficiency of services, especially in the health and social services offered to the inhabitants of socially excluded localities in České Budějovice. The defined objective of my thesis was achieved. To achieve it I used in the practical part the qualitative research, questioning method, the semi-controlled interview technique and analysis of the available data. Research was carried out in two selected sets, one of which consisted of inhabitants of chosen socially excluded localities, and of providers of health and social services in České Budějovice. The data obtained may be used by providers of services to consider an extension of these services. Further, it may serve as an output for an expert article or a basis for further research realised in this field.
